Hi everyone.....l really need some help with this please as l have searched for over two hours and can't find the thread l want.

 

I have sent CCA requests to several DCAs and Credit Card companies.

A couple have supplied actual detailed credit agreements, but most have sent me what appear to be photocopies of application forms which do not contain detailed information of the 'credit agreement'.

 

I know l read somewhere on the site that an application form is not a true copy of a credit agreement, but l can't find what l need.

 

Can anyone help with this? Please? I have hit a brick wall with my campaign until l can find and evaluate this information. Many thanks................Valdez

Try the Debt Collection Agencies section - bailiffs etc, you will need to look through lots of threads but I'm sure you'll find something there that will help!

Hi Valdez,

Below is an extract from the actual Act of what you should receive. Application forms do not comply with the request. Bear in mind that the price

is now £1 and not 15p.

 

The creditor under a regulated agreement for fixed sum credit, within the

prescribed period after receiving a request in writing to that effect from the debtor and

payment of a fee of 15 new pence, shall give the debtor a copy of the executed

agreement (if any) and of any other document referred to in it, together with a

statement signed by or on behalf of the creditor showing, according to the information

to which it is practicable for him to refer,—

(a) the total sum paid under the agreement by the debtor;

(b) the total sum which has become payable under the agreement by the debtor but

remains unpaid, and the various amounts comprised in that total sum, with the

date when each became due: and

© the total sum which is to became payable under the agreement by the debtor,

and the various amounts comprised in that total sum, with the date, or mode of

determining the date, when each becomes due.

Firstly, many thanks to everyone who has responded to my request for help. Even Meagain who was typically cryptic in his/her comment.

 

Ladybird....where do l find the thread ref Consumer Credit Act? I have searched and couldn't find it. Ecuse me if l am being thick!!

I have been looking at one application form with all the CCA regs on but no credit limit / APR etc are quoted, and this is making me think it is uneforceable.

 

 

when is the agreement from? pre or after 31.5.05 ?

Have a look at the OFT guidelines which explain what is an agreement and what it must contain. No definitve answer on the application vs agreement argument but can provide enough ammunition to show the document is not enforceable
