    • Don't appeal. This is a well known scam site to us. It's even been exposed on national TV by Joe Lycett! The traditional route was that we'd push Starbucks to cancel the PCN but that hasn't been working as of late. You've got 2 options: 1. Pay the £60 and the matter goes away. 2. Ignore them and engage with us. We'd rather you choose option 2. We'll be with you every step of the way. The good news is that MET rarely goes to court with this, providing you engage with us properly. The times they have is when people have either come to us late or have ignored our advice. Many times, once defended properly with our advice, they claims are either discontinued by MET or struck out by the courts. Get reading up by using the search feature and searching "Southgate Park", go see how many cases we have here of this scam site, get used to the process. Get reading at least 20+ threads
    • As above so it is essential you don't appeal and accidentally reveal who was driving. Stay quiet to Met and their pet DCA unless you get a letter before claim.
    • Hello, welcome to CAG. Thank you for the information. To answer your question, we don't recommend appealing at all. It will be a waste of your time and you could end up outing the driver. Ask any questions that you have but basically you keep an eye on this, keep the correspondence and if MET ever they send a Letter Before Claim/Action.     • Hi All, Can ii get advice on this PCN received at the services near stansted airport. Picked someone up at night and went to grab coffee and snack in mc Ds, and didnt realise there was zones in this car park, it was late dark and pouring with rain so obvious u see the large 60mins parking free and dont stand around reading everything. My son and his mother were in the back of car still as he was sleeping.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Opticians booked me in for eye test recheck appointment, then told me appointment not on system and refused restest because I asked for refund on glasses!!

I went for an eye test, was told distance and near is weak and glasses required. I was never told I didn't need to buy seperate pairs for distance and another pair for near. I only found out about Varifoculs after I paid for distance and near glasses.

he glasses I was given had a problem...when I walked on any kind of stairs/steps and looked down they appeared to be floating in the air and it was difficult walking on steps or stairs.

I went back to the opticians and told them this and asked for a refund. A member of staff told me he would book me in for a recheck, to figure out why the problems with stairs/steps appearing to be floating when I wore the glasses. The refund was actioned and I received a text message about my next appointment which was the recheck eye test.

On the day of the appointment I arrived and was told my appointment did not exist on their system. The person that actioned my refund supposedly did not put me on the diary booking system. I was told the opticians had phoned me and sent me a message. I replied they was no call or text received from the opticians.

The lady that dealt with me was going through the notes the person who actioned the refund put on the system the week before and I think I caught a glimpse of the word 'recheck' BUT the lady was just staring and scrolling up/down on the screen.

I explained I took the day off work to be told my appointment did not exist which was inconvenience and stressful, with also being told I had to now pay another £25 for an eye test!

I asked for the complaints procedure to be told to send an email to their customer care team?

Where do I stand with this?

I would go somewhere else for a new eye test, not on the High Street, private patient at Moorfields in your area would be best.

If you paid by Credit Card go back to the Opticians, complain and say you want a refund (do that anyway) if they refuse you can open a dispute with your CC provider for a chargeback.

Hello.

Came on the forum for something completly unconnected but this popped up on my search.

My partner who is sitting next to me happens to run a successful independant independant opticians in the Barnham area that is just about to open a second branch and I showed her this post.

So just a couple of general points she made.

1. It sounds like you have gone to a large chain that often says something like "should've gone to s#######s". Dont go there. She gets a never ending stream of discgruntled and badly served customers from high street chains, as do most other small indipendants. Almost invariably, you will get better service and better aftercare from small independants. Sometimes this does mean more expensive than the large high street chain due to the bulk buying power they have and the cheaper lower quality lenses they tend to use. But hey, you only have one pair of eyes. Look after them...

2. It sounds like you were badly advised by the dispensing optician. All her customers are advised of all options and the pros and cons explained. But please be aware, not everyone can wear varifocals, some people just dont get on with them and cant wear them. From a cost point of view, they can be more expensive than seperate distance and reading glasses. They are not a magic wand alternative, you might not get on with them.

3. The issue with the 'floaty' feeling when looking down isnt unusual, and can sometimes be resolved by a simple re fitting and adjustment by the dispensing optician (which would be the first option), you may have had the glasses measured incorrectly by a poorly trained dispenser, so that would need to be checked and you might need the lenses re measured and replaced, or you may need lenses with a different base curve (which would be a later option). None of these options should result in any additional financial cost for you.

4. There should be no reason for you to have a retest. The test will have been done by a certified optometrist and it should be roughly in line with all your previous prescriptions. If there was an alarming difference to previous prescriptions or eye history, that may be a red flag that needs looking into further.

5. IF there was any legitimate rerason for you to require a retest, there should be no cost to you for this.

6. In an independant shop the complaints dept is more often than not the dispensing optician you are speaking to. Future custom depends on current face to face customer service not a tv advert.

 

Hopefully some of those points may help you with your next optician.
