Hi,

I recently received a PCN notice from debt collectors for a traffic violation on a school street, where cars can't drive down during certain times of the day. We have realised that we failed to update our V5C when we moved house a year earlier, which is what caused this notice to go to the wrong address and result in a debt collector notice.

 

Fair cop, we've paid the fine and updated the V5C.

 

The problem is unbeknownst to us we've committed this violation multiple times, which is now resulting in 10 charges from various bailiffs representing Croydon council at a staggering fee of £280 per claim. Whilst we admit we have made mistakes in not realising the school zone and not updating the V5C, these multiple charges are obviously not intentional (we didn't even see the street sign until we received the first fine) and crippling us financially.

 

Is there anyway we can plead some sort of defence to this to Croydon council or the courts?

you need to read here

and all its posts 

and use the correct forms and appeal each one individually

Thank you! One thing that concerns me about challenging is if there’s any chance of being hit with a £1k fine on top of these from the DVLA for not updating the V5C. Scared of losing and adding an extra fee on top.

The two matters are unrelated and the people interested in the traffic violation are unlikely to trouble the DVLA. Although failing to update your V5C carries a maximum fine of £1,000, if you were fined in a Magistrates' Court the fine would be income related and also take account of your (presumably) guilty plea. In practice the offence is rarely prosecuted and would normally result in a £100 fixed penalty if actioned. But the DVLA rarely take enforcement action for the offence.

The forms are not to challenge the pcn's .

Merely to exercise your right to have everything reset because you did not, for whatever reason (other than you purposely ignore them), receive them

thats great..thankyou fort coming back, many don't BOTHER!!

 

to help others in the future in the same boat, p'haps when you get 5 mins, type us out a rough resume of how you did this and the benefits of doing so , and dont forget a bailiff are not mere debt collectors!!
