Hi im looking for some help I did have a loan off this company but missed a payment. I did try talking to them to say they were unhelpfull would be an understatement they said my offer of payment was too low then I started getting texts and emails and phone calls saying they cost £5 each sometimes 3 or 4 a day I tried communicating via texts and emails getting threating genric replies al while the added charge after charge a default charge now legal charges. Iv got to the point saying ok issue the claim Ill challenge part of the claim as the unfair charges. He still emails and texts and calls I asked why he was doing so if he had issued a claim no reply to that have been waiting a week for this claim not had it yet. Do I have any chance disputeing the charges ?? I wouldnt mind I said Im happy to pay the original loan and some FAIR charges but they said no. Any help would be appreciated James

Suggest that you phone Consumer Direct to make a complaint. They are the OFT/Trading standards helpline, so they should report for you. The number of contacts and the connected charges for these should be seen as unfair.

I would also suggest that you phone the National Debtline for advice about this. They may suggest making the payments that you can afford, so the loan company cannot say that they have not been receiving any payment at all.

He mentions he is a peer to peer lender, well once his 'peers' realise his dodgy operations they will either jump ship quickly or make sure the other 'peers' know not to work with him.

 

I wonder if the banking authorities are aware of his activities, I think he needs a licence of some sort for his operations, either in the French marketplace (very much tougher regulations there than here) or from the UK market, unless of course he is hiding under an offshore venture company.

Basically it is a modern term for a loan business, several people put in funding, ie £2,000 each between 4 or 5 people, so you have a 'kitty' of £10,000, you lend that £10,000 out to various interested parties at a silly rate of interest, usually 45% over a short time, ie 6 months, and then you sit back and rake in the rewards.

 

It goes under a lot of names, micro economics, niche mini lenders, and the earlier probably more apt title of 'pyramid selling'. The more 'grander' version is venture capitalism.

I'd say he hasn't got a hope in hell of going into peer-to-peer lending. That market has pretty much been cornered by Zopa. Besides which...given 'the current financial climate'...if I happened to have a few grand floating around spare, I wouldn't be risking it loaning it to people who are just as at risk of losing their job as I am (even if their credit was A+ - that can change very quickly). This may be the worst time in history to decide to try to set up a new peer-to-peer lending network.

Sorry, but how are this lot going to help anyone "get back on track"? There's nothing on their site that suggests they offer credit counselling services (correct me if I'm wrong - I'm tired and I've had two glasses of vino).

If Hart had called my work, i think i would havebeen tempted to call the police.

 

I'm really suprised that the judge in this case has awarded judgment in Hart's favour.
