So are you saying that there were two telephone calls?

He telephoned Aviva to take out the policy. He gave them his telephone number and then they called back the same number to check that it was him and they ran through the policy with him.

I think what's happened is hes done a quote online on which he put himself as single and me as married which I am  and hes given his phone number 

The call handler had then spoken to him on that number and hes vlaimed to be my husband and I think she had suspicious to which she referred to thr manager and then set the policy up 

The FOS investigator said in the inception call he claimed to be my husband so that's the only explanation I can think of

The further edit is fine would it be worth me turning in the letter bank charge backs were done to which aviva happily refunded the money back to him without challenging the bank yet Mr Z had controlled the policy and aviva were speaking with him directly and he had full use of the policy 

 

I think the big about he stopped paying premiums isn't accurate as the premiums were fully paid he went onto putting a charge back claim either late 2019/early 2020 and he started off with small chargebacks like £204 before he went for the full whack spanning over 3yrs

Why did he start the chargebacks? Did he suddenly run short of money?

I see also on page 18 that they identify you as the caller – presumably to inform them about an accident? Can you tell us about that?

How does that run with the fact that they say they have never spoken with you

I havent spoken to them as explained before aviva haven't spoken to me throughout the policy unless he has had a female friend or female voice on the phone to impersonate me to verify my details etc is my only explanation the fact the claim went to trial I have no court orders nothing sent to me 

@unclebulgaria67 he paid by direct debit

You asked me earlier on if I was happy with the draft letter.

I'm afraid that you are going to have to adopt a different mindset. The question is whether you are happy with it. It's going out under your name on it represents the facts as you believe them to be.

So please will you check it over and see that it addresses all the points.

I would point out that since I post up the first draft – which you accepted, you then went on to give us extra information which necessitated further edits.

You want to get into a position where it doesn't need any more edits because it gives the whole picture.

Well if you have read the draft letter which I have proposed, you will see that it refers to 3 pieces of evidence.

You can't submit the letter as a complaint without giving the supporting evidence
