    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I see Sunaks trying to regenerate his leadership bid with the inevitable (as Johnson needed a distraction) windfall tax, by saying the energy market isnt working and batting any potential change (actually doing something) into the long grass - maybe while they wait for the flack on dodo to die down so she can run a UK VIPals energy system .... or labour win the next GE and he can forget all about it ...

Most likely Johnson doesn't want another paterson issue next week when the next corrupt/whatever MP issue arises .. let lone pictures of ministers at some of the parties ..

 

But its is what Johnson does, break the rules, allow others to break the rules, then change the rules so breaking them isnt anymore.

Change the rules to fit the  bad/corrupt behavior ... scummy actions

thats quite a surprise to me .. but when you only glance into it, it should have been seen by anyone with detailed knowledge of the international agreements ..

 

I'm seeing some strange reports re the energy companies responses to the oil drilling tax relief. Need to look a little deeper, but that is also quite a surprise to me if true, and raises some really serious questions ..

The UK may have (not) left the EU and be threatening to renege on their international agreements ..

but everyone else wants closer ties with the EU and WON'T renege on theirs .. many of which have far wider implications for international trade espacially in someone on the brink of a trade war with the EU generated by breaching international legally binding agreements.

 

Even without that understanding Brexit was Brexshit, with that extra understanding its utter twatishness.

 

Johnson and all his ilk need to be gone.

Looks like at least some of the big energy companies are saying themselves that tax relief should be on renewable investment, not oil drilling ..

So who TF is pressing for tax  releif on north sea oil drilling?

and FAR more importantly why is it being actioned?

oh, and regarding the 'pressure' for the gov to give tax relief to largely useless to the UK public North sea oil drilling ..

... Seems its the UK gov is the unconscionable reprobate thats applying the pressure to expand oil drilling, not the industry ...
