Hi folks - made mistake of posting this on Dellers's old thread - oops.

 

I sent my AQ on 7th Dec for deadline of 18th and have heard nothing since. Should I phone the court to ask the situation as I thought I might have heard something by now even accounting for the xmas break?

Got court date for the 9th March at Northampton in post yesterday.

 

Says its allocated to the small claims court. Order also says ' the claimant shall file and serve a schdule setting out the charge claimed, the date it was incurred, the reason for trhe charge, the account number, by 4pm on monday 5th Feb - i e tomorrow.

 

The parties shall give to each other standard disclosure of documents by serving copies together with a disclosure statement by 4pm Monday 19th Feb.

 

I have already sent the details to Natwest ( three times ) and direct to the court manager once by recorded mail.

 

Do I have to sent it all again or is this a standard type letter and I can assume the court and Natwest have all the details already. Doesn't give me much time to take into the court by tomorrow.

I suggest you call the court, with the recorded delivery receipt in your hand (if you haven't got the confirmation of delivery to hand, go on the Royal Mail website and use the number to track its delivery).

 

Ask why they're asking for it as you've already sent it.

 

BUT - what details have you sent? Did you send a spreadsheet with all your charges on it, as described by the bank, individually itemised, with amount, etc?

 

Whatever you do, DON't ignore the Court.

 

On the bright side, the The disclosure indicates you're getting closer to closure. Expect an offer from them this week.

Natwest do love to straggle the life out of the claims but Im surprised that the courts have done the same - actaully Im not as my natwest claim was messed around due to my local court just shoving it as far from their dockets as posible (we had 4 transfer hearings as it holidayed around the UK).

 

But yes as westy says -

 

Phone the court.

 

if in doubt send them your schedule of charges again (what you got to lose bar 30p Stamp)

 

And check your post as your cheque shall be here as soon as cobbs get their court date!!!!!

Good to hear that you've finally got your court date.:)

Shouldn't be long now, it's just a shame they don't bother to settle before we start getting the bundle together.

Thankfully, I've just started printing out the correspondence bit as my bundle has to be in by next week, however, if they muck me about (and I am expecting this) then I'll still have to send it all off. I reckon it's goona be at least 300 pages worth all-in-all:(
