    • Thank you for all your help but I have a couple more questions. I'm just about to fill the Statute Barred letter in. The letter from Intrum UK states all correspondence should be sent to ResolveCall's address and the only one for Intrum is the Intrum group address. Which address should I send my letter to and also do I need to include my name where it asks for the address? Thanks again Jimmy

    • They didn't turn up because they knew they would lose so they saved the cost of sending a brief saving them a couple of hundred pounds at least. But still a big relief for you now that it's all over . So congratulations plus you can enjoy your trip that much more.

Even at my age there is quite clearly a PCN envelope by the windscreen wipers on your car on some of the photos.  But as I said in the IPC letter, that is not the dispute. The dispute is that CPM sent you the second PCN on the 28 th day of the issue date of the first PCN. It should not have been sent until the day AFTER the original PCN was issued. Therefore they broke the Act, they breached the IPC Code of Conduct and their agreement with the DVLA. It is something that the IPC cannot ignore since to do so will bring the ICO down on them and the DVLA should ban CPM from getting data from them once they know if the ICO do nothing. The minimum I expect is that your PCN will be cancelled. But it is up to you. I have given you the details, you have copies of both PCNs sent to you on the sar  with all  the relevant dates.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all, my first post :D

I'm hoping...in fact - going - to reclaim my bank charges from LloydsTSB!!

However i've only got statements for the last 3 years so i'm unsure how much to claim...

I was told on MSE just to ask for ALL charges to be returned...but i'd rather claim an actual figure. I don't think it's gonna be more than a few hundred though but still....:p

Do i need to order old statements to check charges...? How much will this cost?

How did you get your statements for the last 3 years, did you already have them?

 

If you need the rest then use the DPA SAR letter in the library, it will not cost more than £10.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

Nah, shes only a lacky. Martin Orton's the big cheese as far as the charges thing goes. Not a very nice man either, from my experiance anyway.:evil:

The letter i have telling me to 'Buzz Off Peasent' was from the Colmore address.

I will try and call Mandy tomorrow and see if she wants to take me seriously before the Moneyclaim.

I sent my SAR to LLoyds on 14th Sept, unsurprisingly I havent received anything back yet, and the cheque hasn't been cashed...

Just wondering if i have sent it to the wrong address....:rolleyes:

I sent mine to Martin Orton and received back yesterday from Customer Service Recovery, Andover. Your address should be fine. They do seem to be be slow and stalling til last moment as mentioned before. Just hold tight - they are inundated I think!!! I rang the following number in B'ham and they confirmed that SAR had been received: - 0121 633 5452

I sent my S.A.R - (Subject Access Request) to LLoyds on 14th Sept, unsurprisingly I havent received anything back yet, and the cheque hasn't been cashed...

Just wondering if i have sent it to the wrong address....:rolleyes:

 

I sent mine on the 13th so we are pretty much in synch... I still have nothing yet!

did you get a reply ? i am just typing out my SAR letter to the address, that you have put do i just send it to martin orton or a specific dept, as i am baffled at even this level, :confused: i would be interested to see how you have got on, as tsb seems difficult

i sent the letter on sept 14th, think it was delivered on the 16th, so the 40 days is up on 26th oct i think...:rolleyes:

i gave them a call last week (0121 633 5452), they said i should receive something in the next 10 days...:lol: ...

so i'll just have to wait and see i guess...

I would send them the first letter requesting repayment of charges and say unfortunatly because they haven't responded to your S.A.R you cannot tell them the exact amount at this time but you will when they send the statements. (which they should have sent by now).

Hello everyone!

Thanks to all who have helped me so far.;)

I received my statements from Lloyds yesterday, and i've calculated my list of charges...one of which is an eye-watering £60!! :eek:

I know you can only claim back charges from the last 6 years...so does this mean i can only claim back the charges on the list below from the one dated 24/10/2000? As the 5 before this fall before the 6 year cut-off point if I post the next letter tomorrow.

Any advice gratefully received.:D

The 6 years counts from when you first contacted them i.e. when you sent the S.A.R - (Subject Access Request). So count 6 years back from this date.
