  1. Hello, Court date set but now more charges. Can I add these on at this late stage? I have had mores charges accrue since MCOL, AQ and now court date. Can I add these at this late stage or should I start new claim at a later date when current claim completed? Also any pointers on court bundle and preparation for court? Is there a section on this? Thanks in advance for any help. ninap
  2. Thanks for the replies. Haven't been on for a while. But just to confirm that after I sent back amended terms to SC&M, money was put straight into account (I didn't realise until checking account). I did specify on the terms which I amended that payment was to be made by cheque which they obviously ignored. Was a shame as Lloyds credit card took a lump sum out of £230.00 the next day! They apparently can take large amounts without telling you as long as there are funds in your account, but I was SO annoyed! I had withdrawn all funds and cancelled DDMs and opened account with A&L. Just be careful this doesn't happen to you. Keep checking your account and get the money out straightaway. I have learned the hard way, but to be fair as I had not heard to the contrary was awaiting cheque. Good luck to all of you. I believe they are being worn down. Just CC and another to go with Lloyds and 2 with EGG, bliss!!
  3. Hello downsouth, Thanks a lot for giving details of your letter to SC&M. Just what I needed to draft up as I can't agree to conditions as going after them for more!
  4. Claim was for just under £1500. Sure I've read posts where they normally settle quicker only for lower sums of £750 and under. Does anyone have any answers to my initial post as to how to respond to SC&M?
  5. Hi, I returned AQ 2 days ago so would have been received by court yesterday. Today received letter from SC&M offering full settlement. Their letter dated the same day I sent AQ to court so they can't know I completed AQ. Settlement offered of all charges plus court fee plus accrued interest. Can't believe it, thought I would have to pursue further - am I one of the lucky ones????? I do need some advice though with regard to their 'conditions' which have 5 points and read as follows: - 1. "The above amount will be credited to your account." - I want payment made by cheque. 2. "The payment will be made in full and final settlement of your claim" - I have another £90 in charges they will add at beginning of Feb for this same account and also have first 2 years claim which have just sent LBA for (could only get last 4 yrs statements off internet banking and so went for those 4 yrs first), plus Credit Card charges which I have just issued with MCOL. Their final 3 points are standard and are not of any concern to me to agree with as I will not be banking with them for much longer and so will not get charges. How should I word a letter to SC&M? Basically I want payment by cheque. Shortly I will also want the additional £90 charges (which will show on 01 Feb's statement) and I will also be claiming for initial 2 yrs when I get decline letter from my LBA. They will not be aware of these extras at the moment, so should I put claim in with MCOL for Feb's charges when I get them with the first 2yrs charges? Hope this makes sense! Help someone please?!
  6. SUCCESS!!!!!! Thanks to those of you who replied on thread and encouraged/helped me. Received letter today from AOL reiterating what they had originally said, BUT final paragraph said that as goodwill gesture they are refunding the full amount of £66.00 to my bank account. Every bit helps and without this great site and helpful advice I would have never pursued. Thanks to you all. Nina
  7. Thanks to you for help. Will send letter tomorrow and see what happens. Not giving up though, determined to get full refund!!
  8. Hello, I am due to send off MCOL for period 2002-2006 (only just raised fee). I had to request the first 2 years (2000-2002) by SAR as I couldn't get from internet banking with Lloyds and I have just received details for these 2 yrs. I haven't sent prelim request for these first 2 years of the 6 year claim. Do I need to go through the whole procedure (prelim, LBA,etc) or can I just add to the details for last 4 years where I have done prelim, LBA (all procedure adhered). Also, I am treating the 6 yrs as going back to date I sent SAR. Do you agree? Final point, also have just received details from CC with Lloyds. I am assuming this is definitely treated as seperate case from current account charges? Sorry for so many queries, but don't want claim thrown out. Thank you in advance for any help. Nina
  9. Hello, Can anyone tell me if there is a good letter template I can use to send to AOL. Basically I agreed to have internet access with them, but at no time did the service work. I telephoned on a number of occasions and spoke to their technical area who talked me through connection, but it would not connect - they acknowledged this. They were meant to come back to me after speaking to BT as to why there could be a problem. They never got back to me so I called them again. I had approx 5 conversations with Technical until they agreed to cancel the contract. Unfortunately in this time they had taken £82.00 from me, but in the last conversation with them they agreed to refund the last month payment I had made. I did send a letter to them outlining the above and my dissatisfaction, but after some time got a polite 'get lost' letter. As I had failed to cancel within their initial period allowed for cancellation I would not get any money back. Can anyone help point me in the right direction as I feel they are completely at fault customer service wise as AT NO TIME did I receive a service. Thank you in advance!
  10. Thanks moltonbrownqueen, Will send today. Appreciate your help.
  11. Hello all, Have just completed MCOL for current account with Lloyds, just need to find pennies to pay fee!!! Now ready to send prelim letter regarding Credit Card. Please could someone confirm that the prelim letter for Credit Card is the same as norm. I seem to remember seeing another one somewhere, but have really searched and can't find now. Also has anyone got best address to send Lloyds CC letter? Thank you. Nina
  12. Thanks for your helpful reply Gary. Sorry, one other query. Do I take the 6 years history as the date I sent first request to Bank for info - SAR, first request for payment letter, etc or from day N1 handed in? Thank you Nina
  13. Hello. I am at stage where reply negative to LBA. I am going to complete N1 form and hand in at court. Does anyone know best way to find nearest court to take form? Also going for CC late payment charges. Is it still £20.00 I should be reclaiming and not £8 (amount above present charge) for each charge now that fee has been lowered to £12. Thank you anyone in advance. Nina
  14. Hello, Just received statements for 2000-02 (was able to get last 4yrs off Lloyds site). Can someone just confirm a couple of points for me? With regard to the 6 yrs, would this be from date the letter was initially sent to LLoyds (sent 18 Sept) - can I only go back to 18 Sept 2000? Also was 'Overdraft Usage Fee' the old term for O'Draft excess fee? Seem to be many of these pre 2002 and can I claim for these? Had get lost letter from LBA so will get reading to see what I do next. Thanks to anyone who helps me with these queries. Nina
  15. Thank you Lucid and Reload. I will go through with first one (2002/2006) now to completion (LBA sent yesterday). As you say they are stalling and still a couple of weeks left for statements to come back on periods 2000-02, it would be good to get one completed before Christmas! It really is good to have people to help, hopefully Lloyds heads are spinning from all these cases! Nina
