    • Well I sent them the letter of claim, the only responses so far was a few emails reopening the claims on the parcels where they asked for information such as proof of value (which I get) but other things like photos of the parcels, which I haven't got as I never took photos of them. It's been well over the 14 days since I sent the letter now anyway, so what do you think I should do now?
    • Know it has already been answered, but? Does not explain why JCI has registered a different default date when they get the information from the original creditor, Virgin
    • Since you were stopped at the time there is no requirement for the police give you anything there and then or to send you anything before they have decided how to deal with the offence.  They have three choices: Offer you a course Offer you a fixed penalty (£100 and three points) Prosecute you in court  The only option that has a formal time limit is (3). They must begin court proceedings within six months of the date of the alleged offence. Options (1) and (2) have no time limit but since the only alternative the police have if you decline those offers is (3) they will not usually offer a course beyond three months from the date of the offence and will not usually offer a fixed penalty beyond four months from that date. This is so as to allow time for the driver to accept and comply with their offer and to give them the time to go to option (3) if he declines or ignores it.  Unless there is a good reason to do otherwise, the action they take will usually be in accordance with the National Police Chiefs' Council's guidance on speeding enforcement. In a 40mph limit this is as follows Up to 45mph - no action. Between 46mph and 53mph - offer a course Between 54mph and 65mph - offer a fixed penalty Over 65mph - prosecution in court So you can see that 54mph should see you offered a fixed penalty. Three weeks is not overly long for a fixed penalty offer to arrive. As well as that, there has been Easter in that period which will have slowed things down a bit. However, I would suggest that if it gets to about two months from the offence date and you have still heard nohing, I would contact the ticket office for the area where you were stopped to see if anything has been sent to you. Of course this raises the danger that you might be "stirring the hornets' nest". But in all honesty, if the police have decided to take no action, you jogging their memory should not really influence them. The bigger danger, IMHO, is that your fixed penalty offer may have been sent but lost and if you do not respond it will lapse. This will see the police revert to option (3) above. Whilst there is a mechanism in these circumstances  to persuade the court to sentence you at the fixed penalty level (rather than in accordance with the normal guidelines which will see a harsher penalty), it relies on them believing you when you say you did not received an offer. In any case it is aggravation you could well do without so for the sake of a phone call, I'd enquire if it was me.  I think I've answered all your questions but if I can help further just let me know. Just a tip - if you are offered a fixed penalty be sure to submit your driving licence details as instructed. I've seen lots of instances where a driver has not done this. There will be no reminder and no second chance; your £100 will be refunded and the police will prosecute you through the courts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No there is no signature on the letter,but this is Southern Pacific Mortgage Company Ltd trading as London Mortgage Company & not LMC Ltd. The reg no I have is (3266119) whereas LMC Ltd reg no is (5673094).

LMC is my administrator on behalf of SPML.

 

Work that one out if you can...a trading name & a ltd company!quote LD.

You have quite simply suffered for too long,we must endeavour to sort this out once and for all step by step and piece by piece.So lets start with fundamentals.Re:the above.

It would appear to be some sort of fraudulent misrepresentation.

Your mortgage contract was quite simply with matlock bank, who then gave you notice I presume of legal assignment to LMC ltd

For the loan to have been legally assigned to spml you should have been served with the statutory s136 notification otherwise any assignment to spml is only equitable and basically they cannot repossess you.That is law and written in stone.

The reg no 3266119 is that of spml.

Did you receive this notification in both cases,if not this is challengeable in court or/and the land registry

LMC ltd or Matlock are the rightful owners of the legal charge on your property if the s136 notifications were never served,you can challenge this through the land registry and its adjudicator if this is indeed the case,this is a free service which I could assist you with.It commences with a simple letter of formal objection to the Land Registry against the registered chargeholder whom I presume is spml and may insulate you from further litigation until the true facts are established.They then must refer the dispute to their adjudicator.

 

LMC is my administrator on behalf of SPML.

I presume your loan is FSA regulated if LMC which is not registered as a company or registered with the FSA it cannot administer your loan.LMC ltd is also not authorised by the FSA so the same applies.

Fortunately I have a day off tomorrow.

 

No notice was given,I will have to look back through my docs from when I sent a SAR & see if it was included in there,although not everything was sent & lots of paperwork was missing.

 

I have been to the LR twice & both times I have been told their is nothing that can be done without an order from a DJ or if a solicitor takes it to court.

 

Yes Matlock t/a london mortgage company was who we took mortgage out with & now it is SPML t/a LMC.

1st time in court I queried defendent & solicitor told me it had been assigned on 2nd may 2006,which ties in with spml 06 a/c.

Mentioned a couple of times when in court about the LR & spml being on the charge 4 months prior to them assigning.

There is nothing in my t&c's re administration,only thing it mentions is "we may sell your mortgage on".

 

What would the statutory s136 notice look like? would it come in the form of a normal letter on letterheaded paper?

I am intensely irritated my post of yesterday between posts 6244 and 6245 from littledotty has been removed for no apparent reason.This post was a call to action with a link to the new dedicated site.There was no reason whatsoever for removal of this post and its removal is downright conspiratorial.Would someone please pm me with this post and I will take it up with the site administrators and founders if necessary.It concerned a reference and link to the site below and the direct assistance it was offering as it has been started by members of this site.

Until the site team are able to offer a valid public reason as to why my post was removed I will keep posting similar.We are all fighting the same cause here,not each other and what is supposedly a democratic forum specifically created by its founders as a CONSUMER ACTION GROUP has become apparently an action group with the permission of your adversaries?

Littledotty the letter of assignment could take a simple form such as a letter from matlock bank stating they had sold your loan and all rights to LMC ltd.

Please contact the land registry and ask them if they have ever received a copy of a statutory s136 notification assigning the legal charge on your property to any other entity and ask the solicitors in your current litigation to produce the same.I will draft a template letter for you if you like.

Please inform me of all the entries on your land registry document in relation to the charges from the beginning.

In fact it was myself who took the decision to moderate the earlier posts.

After doing so I attempted to send a pm explaining the reasons,but due to connectivity it appears the pm did not go-In apologise for that.

I do not apologise however,for moderating links that are not with CAG approval,and although the intent may be honourable,you will appreciate that if we allowed external blogs and links to be posted willy nilly,then where would we be ?

You will say the cause is just and deserving-but so is the causes of our debt collection forums,Bailiff forums,parking forums and all the others.

I dont have to explain this-its common knowledge.

 

The top and bottom is that no permission was sought and the way in which it was done clearly was not done by the book.

 

The thread here has been going for almost 18 months and its a good assumption that a google search or even a yahoo one would bring people looking-here in any event.

My own issues with SPMl have been resolved - to a fairly satisfactory financial conclusion (SPML have suffered some financial loss) - my horror at the damages the fall out of the collapse of Lehman"s has caused to so many remains undaunted. These people must face the music ... I have raised issues with contacts in the media and the political world I urge everyone to take positive action, the courts seem to be on our side, but the political world needs to be taken by storm. Surely this week is the time?

been off for a long time [ill health] read through the past months pages and seems I have not missed a lot in terms of the thread name.

so to bring it on topic a family member have had a loan since 200x with LMC aka LPL aka SPPL aka SPML aka ? and in all that time the only thing they have had from this lot is a yearly statement on LMC headed paper on the bottom of which states LMC is a trading name of SPML other than that nothing whatsoever .

until last month and to answer little dottys last post the letter of intention to pass over to Capstone this time on LPL paper and at the bottom of this states LPL is a trading name of SPPL And SPPL is a appointed rep of SPML .As dotty says it makes you wonder ,they pay by DD made out to LMC their bank statements state LMC so must have an account.

 

To my main point they have a chance of paying off this loan and my way of thinking in the current climate is of asking for a FULL AND FINAL settlement of x amount ,question is who would they be asking considering as we understand it not one of the above own it nor does even the SPV :confused:

SO SHOULD WE WRITE TO THE INVESTORS AND ASK THEM IF THEY WANT THE MONEY:D Only joking on that bit but it does make you wonder to who and to where would the money be going

It has become apparent that capstone are desperate for funds to pay their various masters as they are the channel through which all passes I would suggest you write to them and ask them what discount they are prepared to offer.

There is news on the site who's link is currently forbidden that large discounts are currently being offered to good payers to settle their accounts.

If Martin3030 REALLY thinks that fighting these sub prime dogs is the equivalent of fighting a parking ticket I suggest he reaches for the drawer and gets a good hold of the pearl handled revolver. At least he'd be dignified in doing so.

I am absolutley mortified in whats been going on here! I thought this site was to help others in simular situations? The capstone wordpress is easy to navigate around instead of trawling back & forth between posts.

 

Why can't we work together on this as a partnership? At the end of the day it's helping peoplefrom losing their homes.

I've had PMs from people feeling that the only way out of this is to KILL THEMSELVES.

 

This site relies on US to do the work for them whilst THE PAID moderators line their pockets.

 

I'm fed up to the hind teeth of the MODS undoing all of that work because the very enemy the troops are fighting on a daily basis have a hot line to the CAG command.

 

In the light of people posting desperate messages feeling that they must commit suicide to get out of their desperate situation does MARTIN 3030 STAND by his comments that this thread is the equivalent of threads elsewhere fighting parking tickets?

 

If he does not then he should issue a public apology. Or resign.
