    • Have we seen your court bundle?   If we haven't then it's probably an idea to post it up here especially the index page and the witness statement so we can see if there is anything which might need adding or changing 
    • "Care to briefly tell someone who isn't tech savvy - i.e. me! - how you did this?" Its pretty simple although not obvious. You open the google maps app > click your profile picture > Click Timeline from the list > click today > choose the date you want to see the timeline from. Then you'll see your timeline for that day. Often, places you have visited will have a question mark beside them where google wants you confirm you have actually visited. You either click 'yes' if you have, or you click 'edit' to enter the actual place you visited. Sometimes, you'll see 'Missing visit' This probably happens if your internet connection has dropped out at that time. You simply click 'Add visit' and enter the place. The internet on my crappy phone often loses connection so I have to do that alot.   OK dx, understood mate. 
    • I have now been given a court date vs Evri, 4th Sept 2024. I have completed my court bundle, when am I expected to send copies to the court and Evri and should it be in hard copy or electronic? The Notice of Allocation states that no later than 7 days before the directions hearing both parties must send to the other party their final offers to settle. Does this mean I will have to tell Evri what I'm willing to settle? Rgds, J
    • Ok how about this to the CEO? I know it sounds super desperate but lets call a spade a spade here, I am super desperate: Dear Sir, On 29th November 2023 I took out a loan of £5000 with you. Unfortunately very early into 2024 I found myself in financial difficulty (unexpected bills and two episodes of sickness and the tax office getting my tax code wrong resulting in less pay for two months) and I contacted you (MCB) on 13th February 2024 asking if there was any way I could extend the length of my loan to 36 months. I fully explained why I was requesting this and asked for your help. I did not receive a reply to that email so I again contacted you on 7th March 2024 to advise you of a change in my circumstances which resulted in me having to take out a DMP and asking you to confirm that the direct debit had been cancelled. You would have also received confirmation of this DMP from StepChange but you did not acknowledge receipt of my email. I have only managed to make one payment from my loan but did try and contact MCB to discuss extending my loan, help etc.  I have now therefore fallen behind on several of my debts, yours included, and as a result you have lodged a Cifas marker against my name for "evasion of payment", which has resulted in me having to change banks, which has been an extremely difficult process because of the Cifas marker. I do not feel you have been fair or given me the opportunity to fully explain my situation to you before you lodged the marker against my name. I appreciate it is a business and you have acted accordingly, but I did try to make contact to arrange alternative arrangements and at no point, not even to this day, did I ever intend to not repay my loan. I cannot stress to you enough how much this has affected my mental health. I am having trouble sleeping and my existing health condition has been exacerbated by all of this. What I would like you to do is to please, please remove the Cifas marker and let me make arrangements to pay the loan back through a DMP.  Please sir, I am begging for your help here. I am not a dishonest person and I have never been in a situation like this before. I am desperately trying to make things right but this marker is killing me. Please can you help me?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

@theoldrouge  of course the whole way the world financial system works now is fake.

 

How much wealth actually relates to real assets ?

 

Back on to the thread topic of Covid, if the world is now going to be  having one pandemic after another, then the US, UK and European countries will continue to look after their own populations, as they have the scientists and the pharmaceutical production facilities available to them.  But this is short sighted, as viruses could mutate and spread from countries with unvaccinated populations.

As stated previously UK Government appears to be set on a herd immunity strategy, now that most are vaccinated. The Health Secretary has said that we must live with the virus.

 

However, this means we will have a very disruptive period, as Omicron is probably not going to be the last variant. There will be issues with services and supplies.

Boris Johnson is tasking ministers with contingency planning in a bid to reduce possible disruption to public services and supply...

 

Personally, I think Government would be wise to lockdown for 2/3 weeks in January, just to try to limit numbers going into Hospitals, while there will be reduced staffing levels.

No I don't think they are prepared enough. Yes they have existing contingency measures in place, but these tend to be designed to deal with a one off emergency such as a building being closed or heavy snow affecting an area for a period.

 

I very much doubt any existing contingency measures can effectively help with a pandemic situation, where Government are now going to accept that we continue to live as normal, with only limited measures such as face masks being required.

I now work in the public sector and yes there are continuity/contingency plans, but what this really means, is that those remaining on the frontline are faced with very difficult choices.  If you have 25% + staff missing, it is not just a case of cutting back on 25% of the work or arranging for some of this to be completed elsewhere. 

 

Implementing the plans takes time up as well. And if you have people in crisis, then choices have to be made as to which ones are more urgent.

 

This is why some NHS senior managers are asking Government to consider increasing Covid measures, to reduce some of the pressures being faced.

China may be lending money everywhere, but via the very mechanism of electronic IOU's presented by a totalitarian government

- and making 'money' from the interest on the 'loans' to those other counties

 

If those other countries were 'simply printing money' as you put it, then why would they need China?

but they dont seem to have even planned for what should have been expected.

 

Johnson simply waffling 'its all over throw your masks away and partaaayyy' - is not valid planning, or even valid incompetence

 

... let alone his 35 Billion pound private mega-profit test and trace running out of  LFTs and PCR slots when people test more as advised

Acting as if 'all is fine' among vaccinated populations is the very mechanism which will drive covid mutation to bypass that vaccination - more so than even mutation in the unvaccinated

Take greater care with the throat swap part of your lfts folks

 

It seems it could well be folk being a little bit less 'committed' with the throat swap part might be adding to Omicron infection identification 'delay' with self tests

Well yes but I didn't see that side of it and if you remember my daughter had Omicron very early so I did have an indication of how easily it spreads.  I knew how LFTs were not that useful for advance warning of infection, I knew how the alternative symptoms manifested themselves, I knew how quickly most otherwise healthy (and vaccinated) people recovered.  Not once did I think about how it would affect the running of public transport etc.

1. As long as positive people must isolate - a truism IMO without a visible  open policy of accepting spread and mutation, illness and death ... as the ERG seem to want

 

2. and as long as people are told wearing masks and other mitigation on transport/supermarkets/ pubs and clubs was a choice

 

3. - the people who work in those places are likely to get infected aren't they, even if those working people wear masks

- as masks protect others most

Once this mRNA is cleared from our bodies, the spike protein too is gone, having shortly existed as just one of tens of thousands of proteins in any given cell.

 

In short, we know exactly which substances are present in the vaccine formulations, and we possess a detailed and thorough understanding of their properties and safety profiles. We know that PEG can be a problem and anyone with a history of an allergic reaction to PEG or any other component is informed pre-jab. This is incidentally why you must remain under observation around fifteen minutes after vaccination: health care workers are looking for anaphylaxis, armed with EpiPens."

Seems hospital admissions primarily for covid (so NOT trivial, and not just tested positive at hospital) are running at 1,800 - 2,400 a day

If the Governments decision to let Omicron rip through the UK proves to be a bad decision, because the NHS could not cope with the numbers, then you wonder what the strategy is going forward.  What actions are then recommended to deal with the next variant of Covid ?

 

Compulsory vaccination requirement with few reasons for exemption provided ?

 

Would Government prefer compulsory vaccinations, rather than lock downs ?

Would Government prefer compulsory vaccinations, rather than lock downs ?

 

Experts keep pleading with HMG to do more than 'vaccine just' but I think they're banking on vaccinations to get rid of the problem. Are we back to the herd immunity strategy?

 

I was pretty angry about what Johnson said at the presser yesterday. 'We' will just have to get through it. But he isn't part of 'we' in the NHS, is he? I feel so sorry for NHS staff who are being asked to work overtime and during their holidays because the ERG won't let Johnson bring in other measures. This could send people into burnout and make more staff leave.

Agree that the way the Government are handling this at the moment is concerning.

 

I am not advocating Chinese level of controls over people, but UK Government could start to look at more restrictions/measures, which would make a difference.

Well, this is what France are doing and I believe Germay is looking to ratchet up pressure on non-vaccinated people too.

 

What Macron is saying doesn't sound tactful but the Guardian think it's a strategy that's been thought through. It could turn people against him but they think those people wouldn't vote for him anyway.

Agree with Macron, that those who are not vaccinated should be faced with how their decision affects their freedoms.

 

I am surprised by the number of health professionals I have come across who have not been vaccinated yet, because they believe on balance it is not the right choice for them at the moment.  Some are young women, who have concerns about fertility, similar to a post to this site recently.
