    • Hi, the vehicle went to Audi Chingford on Thursday 13th May. I did state beforehand that I only wanted a diagnostic. The technician out of courtesy opened the drain letting huge deposits of water escape the seals. Video evidence was provided via AUDI cam. The link for the audi cam has been forwarded to BMW and Motonovo. I spoke to branch manager explained the situation and he stated he would sent me an email outlining the issue. Audi state this is not really an issue and more of a design flaw. However, the seals still have water ingress. I purchased the vehicle with £0 deposit on a 60 months HP plan for £520.00. The vehicle total was £21000. I did not go for any extended warranty. I live almost 70 miles away from the aftersales centre in Peterborough. I have previously uploaded the document I forwarded to BMW however it was in word format. I have had to buy a new tyre almost three days after purchasing vehicle. BMW still have not compensated me for the v62 cost as they said they would. 
    • I would suggest that you stop trying to rely on legal theory – as you understand it. Firstly, because we are dealing with practical/pragmatic situations and at a low value level where these arguments tend not to work. Secondly, because you clearly have misunderstood the assessment of quantum where there are breaches of obligations. The formula that you have cited above is the method of loss calculation in torts. In contract it is entirely different. The law of obligations generally attempts to remedy the breach. This means that in tort, damages seek to put you into the position you would have been in had the breach not occurred. In other words it returns you to your starting position – point zero. Contract damages attend put you into the position that you would have been had the breach not occurred but this is not your starting position, contract damages assume that the agreement in dispute had actually been carried out. This puts you into your final position. You sold an item for £XXX. Your expectation was that you your item would be correctly delivered and that you would be the beneficiary of £XXX. Your expectation loss is the amount that you sold the item for and that is all you are entitled to recover. If you want, you can try to sue for the larger sum – and we will help you. But if they ask for evidence of the value of the item as it was sold then I can almost guarantee that either you will be obliged to settle for the lesser sum – or else a judge will give you judgement but for the lesser sum. This will put you to the position that you would have been had there been no breach of contract. I understand from you now that when you dispatch the item you declared the retail cost to you and not your expected benefit of £XXX. To claim for the retail value in the circumstances would offend the rules relating to betterment. If you want to do it then we will help you – but don't be surprised if you take a tumble.  
    • I was caught speeding 3 times in the same week, on the same road. All times were 8-12mph higher than the limit. I was offered the course for the first offense and I now need to accept the other 2 offenses. I just want to be ready for what might come. Will I get the £100 fine and 3 points for each of them or do I face something more severe?  These are my only offenses in 8 years of driving.
    • I'll get my letter drafted this evening. Its an item I sold, which I'm also concerned about, as whilst I don't have my original purchase receipt (the best I have is my credit card statement showing a purchase from Car Audio Centre), I do unfortunately have the eBay listing where I sold it for much less. But as I said before this is now a question of compensation: true compensation would seek to put me back into the position I was in before the loss ie: that title would remain with me until my buyer has accepted this, and so compensation should be that which would be needed to replace the lost item. But in the world of instant electronic payment, it could be argued that as I had already been paid, the title to the goods had already transferred, and I was required to refund the buyer after the loss. And so, despite my declared value being the retail price - that which is needed to return me to my pre-sales position, the compensatory value should be the value I sold it for, which being a second-hand item from a private seller is lower. I still believe that I should be claiming for the item's full value, rather than how much I sold it for, as this is the same for insurance: we don't insure the value we paid, but rather the value of the item to put us back into the position we would be in if we ever needed to claim. Its for the loss adjuster to argue the toss

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

When Vodafone 'ported over' my account to their new system (sept 15) they appear to have screwed it up, royally.

 

I have 3 phones on one account. (which seem to have been separated)

 

I have had nothing but misery and stress ever since,

I have lost count of the number of times they have restricted access,

leaving us all or one after another cut off,

in one case for weeks.

 

most spectacularly when I was 100 miles away from home in a hospital with my Father who had been rushed in with a heart problem, No way to call anyone brilliant!

I have spent hours both in store and on 191 trying to deal with it all apparently in vain.

 

Last week was the last straw,

I applied to borrow money against my property and to my horror was refused point blank,

I was advised by Barclays to check Equifax to see what was happening.

 

I had a gnawing in the pit of my stomach thinking ..o god its going to be Vodafone, sure enough it was.

 

My credit score is unblemished apart from them, who have my account as delinquent, credit rating rock bottom.

 

I phoned Equifax and explained I have been having problems with them for 18 months and they advised to contact them and that they, Equifax would put a note on my file and query it with Vodafone.

 

I phoned vodafone to be told sorry system is down I will ring you back, of course after going through hoops to establish its me!

 

I telephone later as I have no real expectation of her ringing me back because, well, they just don't,

 

Guy this time says your account is in arrears by 22.91 you must pay now so i did.

I asked him to remove the erroneous entry on Equifax which he apparently did not understand.

 

3 hours later lady calls back and says you are 12.00 , which I declined to pay when the member of staff on the phone could not explain how, when approximately 3 hours earlier I had been told I was 22.91 in debit and had paid it.

 

The following day whilst in store I was £45.82 in credit,

 

at the time i thought sadly laughable,

as the first member of staff appears not to be able to understand a credit on the account. ?

so my credit had now doubled.

 

o yes he also said he would add £5.00 credit 'for the hassle' which I had confirmation in a text message. needless to say it was not applied!

 

Checking my Experian account it shows £190 in debit and more than 6 months overdue.

Thus placing it in Delinquent status.

Which actually tallies with no other amount?

 

I think they pick amounts out of the air tbh.

I then receive a letter yesterday informing me they were suspending my account as I was in arrears of £65.30.

 

desperation yesterday I emailed the Member of staff in the store and copied in the CEO attaching the e mails I had sent to the previous CEO in oct 15 and jan 16 which received no response,

 

amazingly I got a reply e mail today saying they would look in to it but if it was urgent to call them, really Vodafone?? so I did.

 

Melanie assured me she has removed 52.80 which was hanging around on my 'Ghost' account since sept 15 and she will remove my status on Equifax.

 

I mentioned to her that not only would I want my credit file returned to its unblemished state before they had made the catastrophic cock up of my account I also thought I should be entitled to compensation for the amount of time and distress caused in the lat 18 months continually trying to sort their mess out,

 

not least the embarrassment and distress yet again of having to try and explain to the lady from Barclays and my husband that I really wasn't responsible. She of course completely ignored this part of the conversation

 

I asked her to send me an e mail outlining exactly what she was going to do, which she did all be it concise.

 

What are the things I should perhaps be doing/ recording to follow this up?

 

I cannot explain how utterly sick and tired I am,

how stressful and embarrassing this whole thing has been for such a long time,

this is not everything either.

 

I would really appreciate any input from anyone

I think i'd be ringing the ICO and making a serious complaint and seek compensation too.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Well its comforting to hear that VF are maintaining standards and trashing their customers credit files because of their own inefficiency ..I wish the public would spend time here before opting to join this outfit.

Vodafone. The most complained about, the most criticised, the most sanctioned UK mobile phone provider of them all.

 

Scarcely a week goes by without Vodafone being the subject of media attention either in the newspapers or on the radio – and almost always, the issue involves the wrecking of a number customers credit file because Vodafone and their employees are so incompetent. Of course, the real culprits are their management and executive directors who seem to be running around doing very little but no doubt picking up their salaries and huge bonuses.

 

I think at the end it all comes down to what you are prepared to do about it.

 

You can keep on trying to sorted out directly with Vodafone – good luck.

 

You can refer it to the communications ombudsman – it will take you long time, and unlikely chance of success, and of course because the way the system works, you won't really know what's happening because you won't be privy to the things that Vodafone are saying.

 

You can begin a County Court action which would take a commitment to paying the claim fees – but on the basis of what you say, with a very high chance of success – better than 90% – and also the likelihood of a reasonable sum in compensation for all the hassle you have suffered including the damage to your credit reputation and any other losses including increased cost of credit for lost mortgage opportunity.

 

The problem is that not enough people are prepared to go the County Court route – but it is the only way that Vodafone will really sit up and take notice. Once they receive the court papers, you will find that their attitude to you changes magically.

 

If you wanted to begin a small claim in the County Court, we would help you. It's fairly straightforward and frankly there is a high likelihood that Vodafone would put their hands up once you had begun the action.

 

Whatever you decide to do, you should be recording your calls. The contradictions that you have received on the telephone would have been extremely useful evidence to anyone of Vodafone's total incompetence and disorganisation – but unfortunately you have got no record of it.

 

Read our customer services guide and implement the advice there and then start having further phone calls with Vodafone in order to get evidence of as much disorganisation and contradiction and stupidity as possible.

 

It would probably be well worth sending Vodafone an SAR as well.

 

Even if even if it is eventually sorted out, it is worth challenging Vodafone in order to secure a proper payment in compensation – not the bonbons which they will try to get away with

I've had a similar issue thus far it's cost Vodafone £344 and change. I've also had an erroneous entry on my file.

 

Yesterday I got though to the idiots that deal with credit file entries and this is what they have said in an email...

 

'Thank you for your time on the phone today.

 

As we discussed, I can confirm that I have updated your credit file to show a zero balance.

 

Please allow up to 30 working days for this to reflect on your online credit report.

 

For clarification, the above account now reflects perfect payment history with Vodafone.

BF I myself are/have been in the same situation but to my credit I do have the recordings from my many calls. My issue would be that I've had some form of compensation from VF but not for trashing my credit file.

 

I can link someone to the recordings or if someone wants to assist in drawing up a complaint I will start a new thread if need be.

Yes, I forgot to comment on solutions through the ICO.

 

The Information Commissioner's brief is meant to be as a guardian of the human right of privacy. In fact the ICO has lost sight of this and they seem now to be more concerned with striking some kind of balance between businesses and data subjects – with the guiding principle that businesses need to do business and that if compromises are necessary then it may be acceptable.

 

Once again, complaint to the ICO are frustrating in that you have no particular idea what the other side is saying, and eventually the ICO seems to try and seek a solution which is fair to both sides rather than enforcing the human rights of data subjects.

Maybe you need a little specialised help., Vodafone doesnt really take ownership. Why not complain up the chain to the CEO?

It should help as the exec team can be really good.

 

May bring a quicker resolution...

I think I am prepared to take them to court actually. Surprisingly I have had yet another call today saying it has been sorted out and they have rectified my Equifax account (unfortunately I did not read this before and record it!)

 

I asked why this has been going on for 18 months and since I copied the CEO into the email on Wednesday at 1am it has apparently, although I will not hold my breath, been sorted, I asked why could they not have done this before? so 18 months of misery and in 2 days they can rectify it? I am more annoyed now!

 

The person that telephoned me earlier offered me £80 yes £80! I told him NO way divide that by 18 and what do you get? he replies £12 so I then say to him, so essentially £3 a week for all this, is that what you think is fair?

 

He again made the offer which I refused and then he asked me what I wanted, I told him I would have to think about that and anyway I have not decided whether I will be taking this further. He asked if he could call me back next week when I had had time to think about things. I agreed.

 

Checked my file.... still the same!

Andyorch, I have been with Vodafone for over 20 years, I cannot wait to leave now!

 

sorry should say Experian not Equifax not sure where that came from!

Morning.

My credit score on Experian has been rectified this morning.

 

I received an e mail with these words in it;

 

I can confirm that your credit file has been amended to report a perfect payment history – as you were not at fault for the marks.

 

Will this make it easier for me to take them to small claims court and increase my chances of a win?

 

Bank Fodder could I take you up on your offer of help?

Or, how should I respond to the follow up call next week and what is a 'reasonable' amount of compensation?
