Hi CAG,

 

I received an email this morning from Asset Collections & Investigations saying "Goodbye" and that i now needed to deal with TM Legal Services with regards to my outstanding CCJ.

 

 

this is news to me,

checked my credit file and no CCJ's are showing as of 5/1/17.

 

 

Quick check with TrustOnline and low and behold i have a CCJ registered for over £1700 on 04/01/17!

 

Now back in 2013 I had 3/4 recurring loans with Lending Stream

(plus several with MiniCredit, Wonga, Mr Lender, Payday UK, 1st Stop and The Money Shop...

i think thats it) which i was keeping up with payments, until it just became too much. I

 

 

stopped paying and offered payment plans to a number of the providers.

Mr Lender and Lending Stream were the only 2 to refuse my payment offer.

 

Now at this point i just cut off contact and heard nothing.

I've had a few emails from LS saying they sold my debt,

 

 

then a few days later another email saying actually that was a mistake and they hadn't

(last one i received was they sold it to 1st Stop Recoveries on 09/03/2016,

then another email saying they hadn't on the 17/03/2016).

 

 

Checking my emails i can see that Asset Collections emailed me back in October saying they intended to file for a court claim.

 

I'm at a total loss here as to what to do.

The debt in itself is £1700,

looking at my credit file the 3 LS loans totalled £525 at time of closure.

 

Do i have any leg to stand on with the court?

 

Any advice would be greatly appreciated!

you'll see that 1st stop and TM are related shall we say.

 

now this CCJ..

 

have you moved since you took this PDL loan out?

Possible default by sending claimform to old address, very naughty if you had given them your current one prior to claim.

but ofcourse you didn't tell your creditors?

so unless you can prove whom took you to court knew your current address a set aside is not on the cards

I appreciate this,

At the time of the move,

I didn't inform LS as i had not been in contact with them for over 2 years.

 

Back then I had buried my head in the sand about the PDL's.

 

One of my key concerns with the amount being claimed is its over 3x the default amount registered on my credit file,

 

are they able to apply interest that would have been due, but was stopped by the original creditor?

 

I say this as my credit file reflects £525 not £1700?

whats on your credit file is sadly largely academic

 

you didn't contest the claim

they could have put whatever figure they like down..

 

it was not looked at all

simply rubberstamped.

 

I cant see you being able to set this aside via the normal routes

 

what about starting an irresponsible lending complaint against the original creditor

if the whole thing is wiped out

then the CCJ might be overturned??

 

I can't see another route to get it removed...

I wasn't aware this may be an option, I'm just looking at it now.

 

Back in 2013 LS gave me 3 loans in the space of roughly 9 days all running concurrently, totalling roughly £1200.

 

It was shortly after this that i defaulted and couldn't keep up the payments (monthly payments jumped from £42 to £198).

 

This was at the same time running with Wonga (who have since written off my debt as un-affordable) and a couple of others.

I'm going to go back over all my old emails and agreements and try to put together a greater picture.

 

Would i need to inform the debt purchaser of my intentions?

(I've never had a CCJ before, still not 100% sure what the next steps should be)

Wont affect the current Judgment.....you either look into setting it a side or arrange payment of the judgment to TM Legal Services.

Would i need to get the information collected and file the claim with LS, then attempt to get it set a side? or wold this have no bearing with getting it set a side?

 

Sorry for all the questions, I'm struggling to piece it all together.

Has absolutely nothing to do with this claimant or setting a side this judgment.Any litigation you wish to proceed with against Lending Stream is a separate entity.

Just a quick note to thank you for the advice provided. I've ended up clearing the debt with the help from family.

 

I'll look into the affordable lending route with LS as a separate matter.
