    • Morning dx and thank you for your message.   With regards to your comment about them not needing to produce the deed, the additional directions ordered by the judge included 'a copy of any assignment o the debt or agreement relied upon'  so that is why I thought that point was relevant?
    • Sorry for the long post but I don't want to miss out any relevant information: My wife bought a car from Trade Centre UK and have been having nothing but trouble with it. Unfortunately we paid of the finance used to buy the car as we weren't expecting this much trouble with the car as we we though we would have protection as buying from a dealer. We are wondering if we can still reject the vehicle since the finance plan has been paid off. Timeline is as follows: 13/12/2023 -15/12/2023 Bought car from Trade Centre UK for £10548 £2000 deposit paid on credit card on 13/12/2023 £8548 on finance from Moneybarn (arranged through Trade Centre UK). picked up car on 15/12/2023 Also bought lifetime warranty for £50/month 25/12/2023 Engine Management Light comes on. The AA called out and diagnosed the following error codes: P0133 - Lambda sensor (bank 1, sensor 1) Oxygen Sensor. Error Message : Slow reaction. Error sporadic P0135 - Lambda sensor heat. circ.(bank1,sensor1) Oxygen Sensor. Error Message : Component defective Due to it being Christmas took a few days to get through to them but they booked me in for 28/12/2023 to run their own diagnostics. 28/12/2023 Took car in to Trade Centre so could check the car – They agreed it was the Oxygen Sensor and Booked me in for repair on 30/01/2024. I was told they had no earlier slots, and I would be fine to carry on driving car when I said I was afraid of problem worse. During diagnosing the problem, they reset the Engine Management Light. During drive home light comes back on. 29/12/2023 - 29/01/2024 I carry on driving the car but closer to the date, engine goes to reduced power every now and again – not being a mechanic I presumed that this was due to above fault. 20/01/2024 Not expecting any more problems paid off the finance on the car using personal loan from bank with lower interest rate. 30/01/2024 Trade Centre replace to O2 sensor (They also take it on a roughly 60mile road trip which seems a bit excessive to me – I can’t prove this as something prompted me take a picture of milage when I handed car in but I forgot take one on collection – only remembered next day.) 06/02/2024 Engine goes in reduced power mode again and engine management light comes on – Thinking the Trade centre’s 28 day warranty period was over I booked the car the into local garage for the next day to get problem fixed under the lifetime warranty package. Fault seems to clear after engine was switched off. 07/02/2024 In the Morning, I take it to local garage who say as the light gone off – the warranty company is unlikely to cover the cost of the repair or diagnostics and recommend I contact them when the light comes back on. In the evening the light comes back on and luckily I manage to get it back to the garage just before it shuts for the day. 08/02/2024 The Garage sends me a diagnostics video showing a lot error codes been picked up by their diagnostics machine including codes for Oxygen sensor and Nox Sensors, Accelerator pedal and several more. Video also shows EGR Hose not connected to the intake manifold properly, they believed this was confusing the onboard system as it is unlikely this many sensors would trigger at same the time but they couldn’t be certain until they repaired the hose. 13/02/2024 Finally get the car back as it took a while to get approval and payment for the repairs from the Warranty company. Garage told me to keep an eye the car as errors had cleared with the hose but couldn’t 100% certain that’s what caused the problem. 06/03/2024 Engine management light comes on again. Fed up I go into Trade Centre as I was just around the corner when it happened and asked them how to reject the car or have the problem fixed. They insist that as it’s over 28 days I need to get the car fixed under the warranty package I purchased and they could no longer fix the car as it was over 28 days. When I tried telling them it appeared to be the same or related problem they said they couldn’t help as I hadn’t contacted them earlier. I asked them if they were willing to connect the car to the diagnostics machine and tell me what the problem was, as a goodwill gesture, which he agreed to do and took the car to the back He came back around 30 minutes later and said they took a look at the sensor they replaced previously and there was nothing wrong with it and engine management light went off when they removed the sensor to check it. When I asked what the error code he couldn’t give me an exact fault but the said it one of the problems I told him earlier (Accelerator pedal). I have this visit audio recorded on my phone – I informed the reps I was recording several times. As the light wasn’t on, local garage couldn’t book me for a repair under warranty. 07/03/2024 Light came on so managed to book back into local garage for the 12/03/2024 Whilst waiting to take car into garage, I borrowed a OBD sensor and scanned for errors on the car. This showed the following errors: P11BE – Manufacturer specific code (Google showed this to be NOX sensor) P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow 12/03/2024 Took car to local garage and the confirmed the above errors. This leads me to believe that either Trade Centre UK reps lied and just reset the light or just didn’t check properly (Obviously I am unable to prove this) 22/03/2024 Finally got the car back as according to garage, the warranty company took a long to time to pay for the repairs 28/04/2024 Engine management Light has come back on. Using the borrowed OBD scanner I am getting the following codes: P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow P2138 - Accelerator Position Sensors (G79) / (G185): Implausible Correlation I have not yet booked into a garage as I wanted to see what my rights are in terms of rejecting the car as to me the faults seem related. I can’t keep using taxi or train to get to work every time the car goes into the garage as it is getting very expensive. Am I right in thinking that they have used up their chance to repair when they conducted the repair end of January or when they refused to repair it in February ? If I am still able to reject the vehicle could you point to any sample letters or emails I can use. Thankyou for your advice on my next steps.
    • Ok noted about the screenshot uploads. In terms of screwing up I had one previous ticket that defaulted and ended up in a CCJ from Southend airport because for some reason during COVID I didn't receive their claim form just a notice of default. This hospital ticket was the 2nd ticket that went to CCJ due to a lack of knowledge of the process. Maybe it's easier just to pay them in future I'm thinking though, I don't get them very often anyway

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How funny!!!!!! Very interesting and thought provoking. Comical as well. How long ago was it thought that if you went to the end of the world, you could fall off? How funny. How long ago was it that people thought it would be impossible that you could order everything you need right from your very own armchair? How funny. How long ago was it that people thought it would be impossible to have virtual friends and relationships? How funny. In the future people will ask "How long ago was it that people had Jobs, before full automation and robots? " How funny!!!!!!!!. A Basic Income would be a godsend to me at the moment. Not so funny

Old Towns within its cities contain medieval landmarks like capital Bern’s Zytglogge clock tower and Cathedral of Bern. The country is also a destination for its ski resorts and hiking trails. Banking and finance are key industries, and Swiss watches and chocolate are renowned.

Sure would be a nice place to visit.

Perhaps one of the good things to happen in my view,is how many people have now heard about Basic Income.

At one time today Basic Income was trending on Twitter.

Early days yet many people are only just beginning to think about Basic Income never mind how many people still have no idea such a thing existed.

I did not know myself a couple of months ago.

I am not saddened by this news as it was expected.

At the moment, if someone who is on means-tested Income Support or Job-Seeker’s Allowance enters employment, fairly soon their benefit is withdrawn pound for pound (apart from a small disregard), and, as their income rises, they lose Housing Benefit and Council Tax Benefit and they start to pay Income Tax and National Insurance Contributions.

Something similar happens to someone in low paid work who is receiving tax credits: as their earned income rises, tax credits fall, income tax is paid, National Insurance Contributions are paid, Housing Benefit is lost ….

Paying everyone a basic income won't make them lazy – fat cat salaries prove there's no link between work and pay

We don’t think a handsomely paid chief executive might be demotivated by their large income, but suggest £70 a week for every citizen would mean we’d take to our couches en masse

I started writing this thread about Basic Income.

Sometimes,well lately that is i look back in the Bear Garden,check out if others have written anything about things before.

As i do not really like to take that space if already been written about.

 

Now i did post on a thread a while ago.Someone was talking about the Green Party and it caught my attention because i had met a couple of Greens in Manchester in 2013.

 

Not really realising that the thread was about Universal Basic Income.

So i thought i would connect the thread so you can read what a member called Clear33 had written about.

Fair play,it was many weeks later that i started getting interested in Basic Income.

if footballers etc were not paid stupid money for what 90 mins of kicking a ball round it would help! How can anyone person be worth X amount of money? It amounts to buy someone, like slavery!

I know that in the global North we are relatively well off and there is little absolute poverty BUT there is a lot of relative poverty. As for slavery it goes against the UN declaration on Human Rights, it obviously goes against ECHR and the HRA but that gets people all twitched up

The last thing this country needs is to give free money to anybody. Imagine the tens of millions trying to get to our land in every possible way!

I welcome all thoughts for and against.All i ask is people really look hard at this idea.

And research a little if possible.

Your thoughts on attracting millions of economic migrants,not refugees fleeing hell is i suppose one that many perhaps have wondered.

When thinking of this idea for the first time.

 

Let us go back to Barcelona Spain in 2004.Well before the huge increases in migration that we have seen.

And cost many millions of jobs.

I dare not say tens of millions of jobs.

We need to debate Basic Income soon to prepare for the revolution.Before it is here in Great Britain.

A interesting question.

To tell you the truth i do not really know who i am,who i support, what i am,i feel lost.

 

Let down,do not feel i can trust anyone politically.So many times i see that politicians say one thing then do another thing when gaining a little power.Suppose it is just the way it is.

A sad situation but the truth.

 

In how i write i suppose people make a judgement

If anyone can tell me by the way i write what i am feel free.Or if you are wise what you feel i may be.

 

I just want fairness and justice and people to manage without stress,anxiety,and feeling persecuted by outdated,old fashioned ways.

Decide by people who it seems do not care.

Only about themselves and how much money is to be made.

So i wonder myself what am i.What does that make me.:?:

Sorry about that,i perhaps went a litle deep.

After a friendly question by Fletch 22 i wondered a few things.I have been thinking of things going back in time,

For a few hours and am glad i was asked a question.

 

Wondering yes what am i,and why.And why do you support this idea of Basic Income so strongly.

Perhaps a few people wonder who i support politically.

All i can say as before,i feel like i am waiting for something or someone,the chosen one or ones to arrive with ideas fit for the modern world we live in.

I do not like what i am seeing at the moment.

So many spout of about what they are going to do,but what they achieve usually can be written on the back of a stamp.

 

I think now i am just a Dreamer hoping.

That perhaps is what i am.

 

Try to keep this short it is the Bear Garden where we can relax a touch from the seriousness of peoples problems in the Forums.

I watch many threads and am amazed at the help given to people going through such difficult times.

And the Site Team who give so much time and effort themselves to help people.

I will be quite blunt here and say i just hope people do Donate from time to time to keep this site going,that has helped so many.

 

When i look back i realise i have not had many true friends in my life,perhaps one.Kept myself to myself,a bit of a loner.

When younger i left home 17 by myself and traveled around.£4.50 in my pocket.I was lucky is all i will say.

Been homeless three times,it is not very nice.

I was soft natured gentle i feel mentally and physically,and people took advantage.

Till finally for some reason i took up martial arts many years ago.Why i cannot explain.

Kung Fu and Taekwondo well before it became a Olympic sport.

Took a couple of belts but hated standing in front of people so just trained.

Just the way i am,belts to me personally did not prove anything.Some may disagree,fair enough.

 

Trained 7 days a week could not get any fitter so started running as well.

Not realising this would give you discipline

Learn to Find Focus and Stillness

Learn to Take Hits

Gain Self Confidence and Self Respect

Connect Their Mind and Body-off a article,could not think that out.

Learn Conflict Resolution,the idea that you will not use this to knock ten bells out of people but are able to if needed to take a little control.

 

I have seen in my life some terrible things as many perhaps have.Unable or scared to act.

Till the time comes where you have to.

Sometimes anyway to far away to do anything anyway.

Perhaps the best form of self defence is to run away from the situation you may find yourself in.

 

Massive fights,murder,where i saw the look of death in someones eyes.People being hurt

Women being bullied and hurt by men,when acted two times the following days i was told to mind my own business instead of police action.Despite being asked to help in the first place.I have even seen a man being treated the same way,it works both ways.

 

Paid to go in a ring with someone who had fought for the world championship in America.

Meant nothing to me,what was i trying to prove.

Why i did that i do not know really,not one of by better ideas.

Faced a group of bullies in no doubt i would have been murdered if there had been a different outcome.

I have written about this elsewhere in the forums.No need to repeat.

Usually more than one,only on one occasion one person.

 

So what does that make me why do i support in this idea of Basic Income.

As i look around,i have observed people in all sorts of situations with calmness.Close up.

Always i look in peoples eyes where i feel sometimes you can,i do not know how to explain this,perhaps the truth in what they are saying or which way they are going to act.

 

I see in my area,when observing people so much stress,relative poverty,problems.

People who are caring for others,want to care for others,people who would volunteer perhaps but are trapped.

Young people who perhaps would become champions of sport but have lost that chance due to pressures,usually money.

People who would be able to perhaps get businesses going if given a little time.

 

Remind me of a lad i met the other day who was trying to get business in the local community in his own way if i do not write about him soon.I realised what a Basic Income would mean to him.

And stopped and talked to him for a while.

Potential,writers,entrepreneurs,artists,gardeners,so many things if given the opportunity.

 

I am sorry for going on so long,i will return to Basic Income which i will support.

I feel i have psychoanalysed myself.

Remember if you do not know,most of my working life i stared at brick walls from 3 feet away,a metre in modern measurements..On my own,35 years or so.

Finally i had a illness that forced me away from this,and suddenly see the world in a different way.And wonder should life have been different.Just a bloke on a forum as said before.

 

Bring on Basic Income Debate.

I have many more videos,articles,really up to date on Basic Income.

But i have a little work to do.But will return soon.I hope that many out there will share their views on Basic Income.

Even On Wall Street the suits are beginning to lose their jobs or will,as automation,modern technology takes over.

Thanks for the response, I must say not all of it made sense to me but as you said, you have posted elsewhere on the forum and these posts I haven't read.

 

The reason for my question in the first place was my belief that marxism is so much more than a political or even a sociological point of view. I take it as being a system of fairness and equality where each person gets what they need and contributes what they can- contributions can be in many different forms. It is certainly a very long way from the liberal capitalist ideals that seem to be prevalent today which is all about individualism and if you want my opinion, who you can step over to get what you ca.

 

I think the idea of a basic national income is great although I think that with the rights to the income would come responsibilities to provide to society what you can. Most people have certain talents and skills that can be used for the benefit of all.

 

A society built on greed and money will, I believe ultimately fail . If capitalism is all about increasing profits by being more competative etc , there will come a time when economies and hence extra profits can no longer be made and the system will collapse

Any opinion I give is from personal experience .

I think that is the main problem though isn't it, Fletch ? There are some in our society who would just hold their hand out and say thank you very much - and then not contribute at all !
