Morning everyone!

 

Just to say that I received a letter from Barclays this morning, settling my claim but this does not include my AQ court fee or interest up to the point of settlement. So I will be sending them a letter stating that they pay the additional costs or to court we go.

 

It's not over yet!

 

Did you attend court yesterday.

Thanks very much for updating my other thread. I hope that you manage to get the AQ fee and interest that you want out of Barclays. Judging by what happened last week and some of the other threads on the Barclays forum (ie. the Southend cases), they seem ready to settle - particularly as they'll want to avoid full disclosure under the multi-track system at all costs.

 

Once this is settled, I'll be able to write to Cardiff County Court to try to get the stay removed (I'd prefer to avoid the £35 fee of the N244 application) and then start putting pressure on Abbey again - so I'll watch this space I guess!

 

Let's hope that this is settled soon and you (and hopefully then me) can start spending that money...

Hi to all!

 

Awaiting a reply from Barclays to my letter stating I want ALL my costs and interest paid otherwise I shall see them in court. I also added to the letter that I wouldn't accept any of their conditions.

It's all gone quiet at the moment.

 

Received a phone call from Mr McDonald on Friday at 16.30 wanting to go over my letter that landed on his doorstep that morning. I stated that I was not willing to discuss anything over the phone and that he had all the details in my letter ( they obviously can't read!). Now all I have to do is wait as the ball is in their court, literally :lol: .

 

Thought I might have heard something by today. Never mind.

i've just read your case and want to wish you good luck,although i dont think you are going to need it .it must be very frustrating and i hope when the time comes i will have the guts and resolve to hang in there like you.best wishes and well done

Hi!

 

Sorry I haven't been around. Been a bit busy so haven't caught up with everyone.

 

I haven't heard a thing from Barclays since the phone call from Mr McDonald back on the 7th. Looking back over the thread I see that Tobes posted that he may of left? Is that true and is old KJ back yet (holiday or sick?). Bang goes my letter I was waiting for. This means I'll have to write again to them and give them a deadline to reply. They like to drag things out don't they?:mad:

 

Anyway I'm not going anywhere (except away for a couple of days!). Hopefully a reply from the courts might spur them on. Apparently it can take 4 weeks to receive confirmation from them, then I have to wait for the date!

 

Oh well 8)

Good luck with everything. I have just sent off my data protection act to Barclays today. This thread will be amazingly useful. Puts your mind at reat knowing there are so many people out there supporting you!

Sent Data Protection Act letter 18th Sept.

Reply received 26th Sept. Statements will be posted later.

Statements received 29th Sept. Charges calculated to £655 (and growing!)

Enjoy your break Twinkle - you certainly deserve it.

 

Not sure whether you've seen the Mercantile Court sub-forum on General forum, but it looks like district judges around England are also adopting a similar practice ie. selecting one case as a test-case, transferring it to the Mercantile Court and staying all other cases which follow pending the outcome of the test case.

 

But we shall overcome....

Here's the good news!

 

Received a letter this morning from Mr KJ with my claim settled in full with no confidentiality clause (didn't agree to this when I wrote to them) :D

All I have to do now is sign and return the letter and wait for the money to be credited to my account. Result!!

That's fantastic news - it gives us all hope that we will ALL get there in the end. It also means (on a personal level) that the "test-case" in Cardiff is no more so there is no reason for my proceedings to be stayed.

 

You should be really proud of yourself for sticking with it (even when it got tough) - well done.
