  2. Yesterday I got the usual letter from Barclaycard - Sorry to hear of your complaint, blah, blah, blah. I was going to draft a swift response, when this morning I have an offer from Barclaycard. It basically is the difference between the OFT recommended fee of £12 & the 8 £20 charges incurred, £64 in total. Now I know with the bank, normally you'd send them a bogoff letter but what is the protocal here - would the court think I was being unfair in persuing the whole charge for refund in light of the OFT recommendation?

Hi Crispdust, I'm sure you'll have noticed that all cases transferred to the Mercantile Court have been settled out of court by Barclays - mine, File_wizard, lizhaji & twinkle who was at Cardiff. File_wizard's case management conference was due to be heard with several others - just like mine but Barclays being the sly foxes they are, settled with us prior to the hearing date. Goodluck Bankfodder on your quest, I sincerely hope someone slips throught the net - I'm desperately trying to persuade by lil ol' brother who has been stung rather badly by Barclays that I can get his money back. But little brothers don't tend to listen to big sisters now - do they?

  9. I wrote my letter to my MP, Derek Wyatt on 21st September & I have just received his reply today. Many thanks for your letter of 21 September regards this important issue. My apologies for the delay in responding but it arrived whilst I was at the Party Conference and, in the interim, I have been trying to secure an up-to-date profile for you regarding these charges. To that end, I have rung WHICH? - to establish whether progress is being made with their campaign, and with the matter in general. I am still waiting for the relevant person to call me back. Clearly, I share your concerns and those of the Consumer Action Group regarding bank and credit card charges. It is good to learn of Mr. Sawar MP's efforts, and I would be very happy if the CAG would like to know of my support. In the meantime, and because I was not fully up to speed with the current state of play, I asked our specialist Library for a briefing. I enclose a copy herewith, and trust it will be of assistance to you. I am taken aback to learn that the OFT failed to act on the relevant deadline. I have therefore tables a Parliamentary Question asking when the OFT recommendations will come into effect. As soon as I have the answer to hand, I will of course be in touch. He has attached Standard Note ref: SN/BT/3941 updated 26/6/2006 by Timothy Edmonds, Business & transport section. This document is 9 pages long, includes Bookworm's court bundle:D , BAG's legal argument & website, OFT announcement, Banks' response & Parliamentary activity. Also attached is Minister Presses 'Go' on Consumer Credit Act 2006 dated 25/5/2006 ref: P/2006/134.

  12. But surely if they offer you the full amount - how can you persue for a test case? I understand the reasons for wanting to force the issue - what other tricks do you have up your sleeve then

  14. Yes, when I sent this letter I got the £10 back. You need to keep on to them, either by the 'phone number or in branch
  15. Hi Laura, This is a standard letter, you can wait the 40 days for the statements to arrive or you can send another letter with the £10 requesting all information that they have. There is a template in the FAQS. No need to worry:D . Tigger26
  16. Hi Tobes, Wow, you're on the road now, suggest you ring the Court concerned, if not done so already & ask about submitting bundle, but is should be OK, they gave you short notice. Bet your bottom dollar, sorry, pound, that Mr J will be in contact - but at the last minute of course:lol:

  20. Just got confused, you've got 3 threads in Barclays all for the same thing . Best stick with one thread for now. Spend time reading FAQs section, MCOL is ok, personally I went to my local court to hand in my schedule of charges with a printed off copy of the N1. MCOL does limit the amount of words you can write in but you can download a pdf version & fill it in to take to court yourself if you want.

  22. I think if you hubby pays the CSA directly, then they would put the charge on, but that's a bit drastic for them. Not totally sure. You can fone land registry & find out what charges are on the property.
  23. Sarah, I got exactly the same informative:-o letter yesterday but they're going to charge me £11.50, is there something amiss here:?
  24. I put the £725 charges and the interest @ 8% upto issue date in the box Amount Claimed. As I went across to the local court I took a schedule of charges with me attached to the completed N1.
