I wanted the NHS to disclose to me any complaints that may of been made against a Doctor that worked at a particular hospital, as I had concerns about their performance etc.

 

 

I was told that releasing details of any complaints against any doctor is in breach of the Data Protection Act 1998 under, exemption s40 (personal information).

Any thoughts or other processes that may be of help?

I need to know if any complaints have been made against this Doctor as I am in the process of making a complaint for the Doctors negligence in treatment and advice which I should of received. In the Doctors response to the initial investigation, several statements made were untrue so there is a re-investigation taking place. I feel that knowing about the Doctors history e.g. complaints might be useful.

I came on here to ask a simple question, a yes or no would of sufficed. Why come across obnoxious saying "It's none of my business" and questioning me??

 

 

If you can't answer the question don't respond, maybe you have nothing else better to do :-)

Because there may be reasons that would make it acceptable to ask for this history. That why I'm asking the question.

 

You have no given enough detail.for a simple yes or no answer.

 

As a general rule, you have no entitlement and no business asking for a doctors complaint history.

 

And thank you but i have plenty to do, but I thought I would spare a moment to respond to your question. Evidently it doesn't sit well with your desired response so you have become agitated. No need to get nasty with me though.

 

If you are not able or prepared to supply a little more info then there is little else I can offer in the way of an answer.

All I am looking for is to know if it's possible to get a complaint history. From what you have said it sounds like it is, but you haven't said how. Anyway the incident is my business and I don't wish to share it in full detail on here. I have provided enough information.

 

 

If you don't wish to share how, then that's fine. I will hopefully get an answer elsewhere.

Generally no, its not possible if you just want to see what complaints he has. That would be personal and private.

 

There may be circumstances where you may be able to have them accessed, but I'm not going to start listing every option as it would be a waste of time as there are multiple circumstances.

Im not interested in your circumstances but without them I can't answer your question. You are on an anonymous forum so I'm not sure I understand why you cant give more info. At this time, you have mot provided ANY info, let alone enough.

I think this would probably be a similar situation to a criminal case where the person in the dock so to speak might have a previous criminal history, but, the Jury is not permitted to know this until after the current charge has been heard and judged on. It prevents bias

You were informed as to why the information is not available to you. I do not believe that there are any other thoughts or processes that may help you in gaining access to the complaint about you.

 

As you have concerns about the doctors performance then you could make a complaint against the doctor.

 

Looking at this thread, you seem to attack other people for asking questions and trying to help you. Maybe such attitude extends toward the doctor also. Doctors may ask you questions that seem irrelevant to you (same as this thread) yet they are relevant (same as this thread).
