Yes you can, but there are differences since some laws only apply to consumers not businesses. There is a separate letter in the bank templates library

 

Before you start please have a thorough read of the FAQs (there’s a Step by Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later.

 

Then look at other threads in your bank’s forum, so as you know what you can expect to happen

 

You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.

 

There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time

 

This is a self-help forum and you must be prepared to put in time and effort. It is your claim, your money and you cannot expect others to do all the work for you.

 

When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help

Natwest have been very accommodating but its the basic step account but at least it can be built on in time. better to have a small parachute than none;-)

Started claim on my business acc recently. Recieved letter from lloyds basically saying they are sorry i am unhappy about my charges . they referred to Unfair Contract Terms Act 1977 saying this does not apply to me as iam a business customer not a consumer.Any advice on what to do next ?

As a business you are unable to rely on consumer regulations for protection because they cover consumers. For businesses the process is slightly different but still 100% possible.

Bear in mind you can only claim for default charges and not business banking fees.

Hi, I am reclaiming bank charges from Lloyd's on my business account. I sent the first letter to which I had no reply, sent the second letter (both to my local branch). Both these letters obviously contained account number, company name, etc.

 

I have received a letter from Customer Services Recovery Centre in Andover saying they are unable to look at my account with the details I have provided and asking me to reply back in the pre-paid envelope with account details, sort codes and previous addresses.

 

Should I reply to this letter (I was going to send copies of both my original letters) or ignore it and carry on with the next step.

Normally I would say they are just stalling and issue your claim form.

 

But given the prospect of your claim being stayed (I realise the stay should not apply to business claims, but this does not seem to stop the court staying them anyway) I would reply to the letter with your account details just in case.

 

I put this on my preliminary letter and recommend that you do likewise on your letter, which I am sure they will ignore:

 

BUSINESS ACCOUNT – THE TEST CASE BETWEEN THE OFFICE OF FAIR TRADING v ABBEY NATIONAL PLC AND OTHERS, UNDER CLAIM No. 2007 FOLIO 1186 RELATES TO CONSUMER CLAIMS AND IS OF NO RELEVANCE TO BUSINESS CLAIMS.

We are chasing LLoyds for £1600 of penalty charges on Ltd Co account. We stopped using the account about 18 months ago and have reduced the overdraft to - guess how much? Strong bargaining position methinks;)

Nat West Bus Acct £1750 reclaim - WON

 

LTSB Bus Acct £1650 charges w/o against o/s balance - WON

 

Halifax Pers Acct £1650 charges taken from benefits - WON

 

Others

 

GE Money sec loan - £1900 in charges - settlement agreed

GE Money sec loan - ERC of £2.5K valid for 15 years - on standby

FirstPlus - missold PPI of £20K for friends - WON
