    • Thank-you @BankFodder, your statement is a correct understanding of my position and I agree, it is actually really what I was looking for in starting this thread, as I too believed that the maximum I could claim for is that which I sold it for, even though this was substantially below market value at the time. And so, this sold value is what I shall be claiming for + the other expenses. @dx100uk I get your point, but this is just not what I want to expose myself to. Unfortunately I was one of the unlucky ones to have my details stolen in the Peoples Energy hack, and in 2020 I discovered that those details had been used to take out car insurance, and that the insured was then involved in a collision and my details were dragged through the mud. Despite Aviva cancelling the claim and treating as though it never were, even though I have the letters from them to say that they have removed this claim from the insurance database, I still get refused insurance and credit products to this day until I send across the letter from Aviva which explains that I was a victim of fraud. So you'll forgive me for not jumping up and uploading my data to a server utility for which I have no control over its retention policy, or where the server is located globally, its legal jurisdiction, or its security protocols.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have previously asked Barclays for CCA They have sent me a copy of without a signature and said in the letter

 

In response to your recent request,

we are pleased to provide you with the copy of your credit agreement and a financial statement.

 

Section 77 and 78 of the consumer crediticon Act 1974(amended) do not require Barclays Bank

to provide you with a signed original form of the credit agreement and according with the Act

It is not the policy of Barclays Bank to provide this.

 

The date on the bottom of the unsigned agreement 2/8/2005

 

 

i have been making token payments via stepchange since 2009

 

 

i think also when going onto my noddle account today i can see that this loan is no longer at all showing on my credit file

and previously in december prior to the CCA request was showing as defaulted on the first page of my credit report

and then as satisfied in my closed accounts section so im a little confused ...

 

Any advise or suggestion for what i can do next,

I am still making payments via step change to this if it has dropped off my credit file

and they are unable to provide an agreement

 

 

what would be the best next step to take ,

 

 

would i need to make an SAR for them to provide the agreement

 

 

or put in a complaint as they would have failed to comply with the consumer credit act.

If it was pre April 2007 and you did sign the app, then they know very well that they need the original. Plpeople may advise different but this is sharkleys were talking about.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

has the debt ever shown a default date in the summary?

 

 

they are correct they don't 'need' to supply the signed agreement to comply

though the DCa will need itto do court mind!

 

 

I'd send an sar

prob got lots of PENALTY charges & PPI? to reclaim

hence they've sold it on?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi

the response from barclays does not give a default date

 

 

however "mentions £7538.82 being the balance owing on the account,

this figure represents the amount demanded of you on 3rd January 2009"

 

 

not sure if this is the default date

 

 

on my November 2014 credit file it shows as satisfied on 1/11/2010

but in the march 2015 credit report it is not showing at all,

 

 

i will be sending off for an SAR . THANKS

Can you say roughly what amount is owed now, after you've been making token pay'ts over the years.

 

The a/c won't be SB'd for years but the a/c should stop showing on your CRA files just after 6 years from when you stopped making the normal required payments.

thanks for the Much appreciated advise ,

 

 

the account shows a balance of £7538.32

my credit file shows the same debt as being satisfied in nov 2010 and

 

 

in another section on the same credit report defaulting in dec 2014.

 

 

i stopped making the normal payments back in 2008. and the present cra report shows no existence of the debt.

 

i have requested an SAR from barclays and will be seeing if they can provide an original agreement for this debt.
