    • It will be years before Banks would sell to a debt buyer.  Sometimes Banks will use external debt collectors to try to collect, but generally Banks don't take Court action.  So you could be looking at 3 to 6 years, before any dca owning debt looks to take any Court action. And it is not definite that this would happen. So no need to feel pressured at this stage. In the event you found yourself unemployed, you have time to engage with Banks to advise of your situation and ask for time to deal with the situation, find new employment. As long as you inform the Banks they will offer assistance they can. E.g offer payment holiday or accept reduced payment for period. What you should not do, is not contact the Banks and simply default on payments. 
    • I'd get back to them tomorrow, and explain the circumstances, that you have a wedding reception, and just appeal to their better nature. Hopefully they will be able to move sooner rather than later, especially if you go in in person and speak to them, and show them the issue.
    • The 3 pieces of mortar that fell on the same day, at the same time, were approx. 25-30cm long and weighed around ½-1 kilo each from a roof that is above the 2nd floor; they were by no means tiny pieces of mortar but large chunks falling from a rather great height. I believe the size and weight is enough to cause serious injury and if it falls on your head, I assume it could potentially be lethal if unlucky, but we don't wish to put that theory to test... We can't in good conscience let a contractor install a patio and a gazebo as it is in the exact spot where the mortar fell, nor do I think anyone would be willing to take the chance. Looking at the roof, there are multiple other remaining pieces from the same 'line' or 'row' of mortar that can potentially fall. The mortar is right underneath the slate tiles on the neighbour's roof and I don't know whether the tiles are also (becoming) lose due to the loss of the mortar. I was trying to upload a photo but it seems it's not allowed. The first contractor to work in our garden in preparation for the patio and gazebo is scheduled to start on 10th June, that leaves the neighbour 5 workdays to sort their roof which is unlikely, so it seems we will have to postpone our patio contractor without knowing when they can come back. We have already had extensive work done in the garden in preparation for the wedding reception and it will become very costly for us if we have to move the wedding reception to a venue (if we can even get one at this short notice) rather than have it at home which was our dream.

Letter Of Claim       Reference: Techzone Mobile Phones Samsung A71 Mobile Phone £140 Purchase date 29. 5. 24     I the claimant purchased a 2nd hand Samsung A71 mobile from Techzone Mobile Phone unit 10 of the indoor market at the Potteries shopping centre. Initially the phone worked well until I used the camera and found debris in the camera lens spoiling pictures making it not fit for purpose. I contacted the seller who offered a replacement which I initially accepted but later rejected and wanted a refund in full which the seller refused saying they Do Not give refund is unlawful and goes against the Consumer rights act 2015. Therefore I intend to issue proceedings against you in a county court without further notice unless you reimburse me the above amount in Full within 7 days from the date of this Letter     ------------------------------------------    I think its best if i hand him the letter as posting it might not get through so can claim expenses traveling up there ?   or would it be best to just post and get 'Signed for'  ?   Should i also put in the letter of claim interest added or leave that till the Particulars letter ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My son finished his degree (Acting BA Hons) on 20th June. We didnt realise he could claim JSA but found out and claimed last weekend. He was called in for an interview today and said he was treated like trash, spoken down to and told he must take any job doing anything regardless. He is far from workshy but considering he has just accrued thousands of pounds student loan etc debts he thought they would give him a few weeks to try to find something in his field of training. I seem to remember years ago they did this. In addition, he has to sign on every week. Is this the norm now? He has come home feeling like something the woman stood in and says he is thinking of cancelling his claim at least for the next few weeks so he can try to find something in his field or something associated so they dont force just anything on him. He has no intention at all of sitting on jsa but wants to be honest and not say he is looking for anything when he isnt really. I said he could cancel his claim temporarily and see how he goes and that the fact he wants to be honest about his job search would stand in his favour. Didnt they used to allow them some 'grace' time to look for work within their training and then start insisting they widen their search or has that long gone. And since when did people have to sign on every week. Also what gives anyone the right to speak so badly to someone else. He has already shown a 3 year commitment to bettering himself, paid a fortune for the privilege and is being treated like a waster!

The general rule is:

When you first sign on you can look for work in your usual occupation for up to 13 weeks - unless you are a school leaver; have never worked before or your trade no longer exists.

I thought this bit of lee-way also applied for graduates.

But as you say, it’s a cruel, heartless world, the world according to DWP.

Its not a case of being 'honest' if he signs for JSA its a contract which requires for him to look for a Job that's why its called JOB seekers allowance by all means he can try to apply for a job in his chosen field first but if those jobs are hard to come by then if he wants to accept public money he has to look for other jobs.

 

 

Sorry he is being treated like a waster after only 3 years commitment, but then I was treated the same after 43 years commitment to work.

 

 

I am afraid its called the real world and he is welcome to it

I also have a friend in his 60's who I would give a job to like a shot if I was an employer. He was made redundant over a year ago and has tried so hard to find a job, gone on the trials, workshops etc but because of his age they are not interested. I actually know of a lady (call her that loosely) who is taking on jobseekers for work trials, no intention of employing them at all and actually said to one that she finds it hilarious she can get free labour.

My son hasnt just done 3 years commitment to bettering himself, I was referring just to his degree time and the thousands he has to pay back. His student debt alone is in the 10's of thousands at 21 yrs old. He obviously went through school, college etc aswell and worked part time until the demands of his degree and the hours he was keeping meant he couldnt keep the job up. He wasnt one of the people who only went in 2 days a week or something. Their course often finished at 10 at night after a 8.30 start and had so much coursework on top. People seem to think an acting degree is a breeze but I can assure you they are mistaken and the number of dropouts was high once they realised the true extent of the workload. He has worked so hard but graduates next Thursday so thats good. Like I said, he has no intention of milking the system, he has a good work ethic or indeed conning them. People have suggested to him that he 'plays the game' and make it look like he is applying out of his training but he doesnt feel right doing that. My initial question was literally about initial time to look within his field and the fact that although he is a motivated and honest young man, he was treated like s**t. I am a teacher of yr 11's and I hear first hand how some of them are 'just gonna claim dole cos its free money'

I feel for him.

 

The system is so warped and unfit for purpose its unbelievable. Job centers should be renamed "Enforcement Centers" as that's what they are in reality.

 

I was lucky. I got a decent adviser that even though did not help much at least she was not making my life any harder.

On my own back I am about to begin a new career at 34 yrs old. I too went to university etc. I spent 11 years with a single employer and fought a discrimination claim that resulted in me leaving the company. It made me ill. I did "win" though.

 

My issue is that I now have a start date in August in writing and also confirmed my acceptance. I now have to waste employers time by applying for jobs to to keep JSA when in reality I have no intention of carrying through with those applications. I'm wasting company's time, deforesting a small wood every sign on and taking up valuable time of an adviser that COULD be helping people that need it. As I trained in Human Resource Management seeing this just strikes me as a tragic waste of resources and undermines the credibility of the job center.

 

What my adviser DID do for me though was prevent me being referred to the work program. She saw little point as I would be there for a couple of weeks and then gone.

 

In meantime as my career change requires lots of examinations and training (All paid by the new company) I have spent my time buying books and swatting up for the exams before I have even begun my training :D )

 

Best advice for your son.

 

Find some voluntary work related to the field he wants to work in. Declare any expenses to JC+ This provides proof that he is being active and may shelter him from some of the ****. Even getting a part time job in a pub and declaring the income will help. Yes it will reduce his jsa and other benefits a bit but it keeps his CV moving, Keeps him active and keeps him talking to people. And actually working in a pub can be good fun especially if you just left uni. A part time job also shelters him from some of the **** the JC gave.
