    • Hi I assume the Loft Conversion with the eaves and crawl space was there when you initially purchased the property. Even in done after purchasing the property and the correct permissions were in place i.e. Local Authority, Land Registry, Freeholder which is Southern Land which would be required as a Leasehold property. The difficulty is if the Loft Conversion was there when you purchased the property and there is no evidence in your documents of the eaves and crawl space due to where the Red Lines stop in the plans or even after purchase it was added this is the reason you are having issues with selling due to those missing Red Lines in the Plans and any other Buyers competent Solicitor would flag this up. I can understand the reasons the Buyer wishes a Deed of Variation probably there Solicitor requesting this to ensure those missing red lines are covered before the Sale as they Flagged this as an issue as Red Lines missing on Plans and want buyer protected. As for the £8000 costs Together and cohort Southern Land are trying to charge have you thought of contacting a few Property Solicitors yourself to get a few quotes. (only mention this because when I research this possible costs can range from £500 - £2000 depending on the Deed of Variation work required and nothing to stop you doing this then approaching Together and cohorts with it) Also ask Together/Southern Land for a breakdown of the £8000 costs for the Deed of Variation. Yup do send both Together and Southern Land a Subject Access Request (SAR) requesting 'ALL DATA' that simple phrase covers whatever format they hold that data in whether it be emails, written, recorded calls etc. They then have 30 Calendar Days to respond and that time limit only starts once they acknowledge receipt of your SAR Request. When you purchased the property some 17yrs ago are the Solicitors that you went through at that time still operating?     • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi.

 

Getting a bit peed off with them at the moment so decided to call here and see if I can scare them a little with some legal stuff, lol.

 

Right may I just add we have bought from Ideal World a few times and no problems, having said that we havnt had to return anything.

 

On the 1st March we purchased 2 (two) apple ipad 1 at a cost of £339.98

we decided to pay for the items on flexi pay over 4 payments,

the 1st on the day of order £91.03 and then a further 3 payment over the next 3 month of £84.98.

 

Feeling excited like a child getting a new toy I looked up some reviews online and realised that they did not have back facing camera.

This was on the 4th march

 

I rang them to cancel the order and was informed they cant cancel because they are ready for dispatch,

I was advised to refuse delivery of items and when they got them back I would have a full refund,

GREAT.. well that's what I thought.

 

After a couple of days 6th march I looked on my account to see if they had ben dispatched

and they hadn't they didn't get dispatched until the 10th,

items arrived on the 14th I think no paper work for it so not sure, anyway I refused the order.

 

The next day I went onto hermes website to see if my order was being track with the same tracking number

and there it was in black and white " DELIVERY REFUSED BY CUSTOMER ".

 

Ideal Homes got it back on the 16th March,

and to there word a refund on 20th of £42.52 (postage discounted)

and then we got a new bill through the door dated 21st march stating the refund

and amended flexipay payment schedule for 1 item.

 

I rang them again,

explained the situation and they said they only received one back,

I explained I sent both back and they said they were going to look into it,

 

3-4 days later I rang again they said they would ring me back but didn't.

 

I sent a email stating I was going to go to trading standards and

I think I jeed them up a bit because they rang me the day after

I think this would have been around the 27th thought I was getting some where,

 

I had to email with a threat stating this is ther last chance because a payment for a product

I don't have was due to come of my credit card on the 1st April,

I also said that it was making my wife very ill and they replied with.

It is now the 8th April, no letters, no email and no phone call, and most of all no refund.

 

They have admitted they have received the parcel back because of the refund for 1 but not for the pair,

when they were delivered there was in 2 parcels and I refused both.

 

Any advise would be gratefully received I would just like some ammunition to throw at them to get them on the case, and my money back.

under DSR rules

you can cancel for a complete refund.

 

if they didn't receive one

 

that's their issue between them & hermes.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

That's what my argument was with them, I use the word was because just today I have received my refund, cant believe after posting on here it gets sorted within 24hr, lol, wrote all this for nothing. Thanks anyway.
