When responding to the court claim does it need to be in spefic terms ? Or laid out in a certain format? Or is it just a case of putting down in writing how I have expained it on CAG?

    • Afternoon all Looking for advice before I defend claim for car tax payment that the DVLA claim I owe £68 from an idemity claimback from my bank and unpaid tax  brief outline. Purchased car Jan 30th ,garage paid the tax for me after I gave them my card details  first payment £68 out in Feb 24  followed by payment of £31 from March due to end Jan 24 Checked one of my vehicle apps and about 7-10 days later car showing as untaxed? No reason why but it looks like DVLA cancelled it , this could be because I did not have the V5 and the gargae paid on my behalf but not sure did not receive a letter to say car was untaxed.  Fair enough I set up the tax again staight away in Feb 24  and first payment out Mar 31st , and each payment since has come out each month for £31 , this will end Feb/Mar 2025, slightly longer than the original tax set up, all good. I then claimed the £68 back from my bank as an indemity refund as obviously I had paid but DVLA had cancelled therefore it was a payment for nothing?  Last week recieved a SJP form dated 29th May stating that DVLA were claiming for unpaid tax and a false indemity claimback which of course is the £68. It also stated that I had received two previous letters offering me the oppotunity to pay that £68 but as I had not responded it was now a court claim that I must admit guilt for or defend. My post is held for weeks at a time from Royal Mail ( keepsafe) due to me receiving hospital tretament at weeks at a time that said I did not receive any previous letters from DVLA. I am happy to defend this and go to court but wondering what CAG members think? In summary I paid an initial amount of £68 and then a DD of £31 , tax cancelled  I set up a new DD at £31 a month all in the month of Feb 2024, I claimed the £68 back from my bank. DD has been coming out each month without issue and I have paperwork to show the breakdown for both DD setup's plus bank statements showing the payments coming out . The second DD set up has extended payments up to Feb/Mar 2025. DVLA claiming the £68 was ilegally claimed back despite the fact they cancelled the original DD for reasons unknown. Is this defendable ? I will post up documents including the original DD conformations

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

New to this but hoped someone could help me. I lost my job in August and went on contribution based jsa which ended in February, since then I have had no payments at all for various reasons none of which are my fault. Firstly I had the letter saying it was coming to an end, I told my advisor and asked what I should do ...he said don't worry you will automatically switch over to income based...I didn't! I was then told I needed to fill out a form...I did...then they said because I have a mortgage and received payment protection I needed to fill out another form...I did...no word or money from them for 3 weeks ...I phoned jc+ was told they were waiting for the mi12 form back from my insurance company...I phoned insurance company...they never got it...phoned js+ back was told different story altogether! I should have had this mi12 form and filled part out and send rest to my lender (not insurer) I went to jc and asked for the form only to realise that it is an application form for mortgage interest direct scheme where government pay your interest! I don't need this as I have insurance...I just want income based jsa! I phoned js+ back and explained this and the fact I have had no money for 5 weeks now...was told someone from mortgage department would call back in 3 hours...they didn't but I got a text 4 hours later saying we cannot process your claim until we have the mi12 form!, Does anyone know why they need an application form for something I'm not applying for before they can pay me jsa...it makes no sense and I have no money to live on...I had to go to a food bank today as I haven't eaten in 4 days. And from what I have read it looks like I'm still months away from this been sorted. I just feel like ending it all.

Someone up here said she got post office coupons from the council to convert it to cash to buy food and pay the bills because there were delays in the processing of her benefits.

 

Ask them what evidence they need to be able to help. Up to date bank statement shows last JSA payment dates. Plus some JSA letters.

 

From what I saw on the internet, food bank can only be used 3 times in a year so you need to get other help started as well. Benefit advance you can apply for when there is a delay in the processing of the claim: ask for the form and for info about it.

 

Adviser Discretionary Payment: your JCP adviser can grant it. With JCP you can ask for an on-the-day payment, rather than the normal three working day clearing process. You call your BDC from the free phone at the JCP and say why it is urgent.

 

Like when you sign on on Fridays, the money appears in your bank account the next Wednesday. With an on the day payment it was in my account within a few hours of calling Stratford [London BDC for my area]. It was outstanding after a suspension so they were willing to speed up the payment.

 

The council will want to see that you have exhausted all other options before they are willing / able to help you. So put in a claim for the above DWP wonders and keep a copy to show the council if they want evidence.

 

Check what the Adviser Discretionary Fund is for before you say what you need it for. Eg say you need it to buy new clothes for job interview if it is given for that reason. It won't be for buying food.

 

Please tell us how you get on with the above so that forum readers will know available options.

Under no circumstances whatsoever should anyone abuse or defraud the ADF. It's not available for general living costs and you are advising the poster to commit benefit fraud. Don't do this.

I need a more permanent solution than that anyway. I just want to know why they would want me to fill out a form for something I don't want or need before they will pay me jsa. They have all the details they need regarding my income and mortgage ...I just feel like they have made a mistake but I can never get to speak to anyone about it

If you aren't getting callbacks, ask for the matter to be escalated to a supervisor. He or she should ensure that you get one as a matter of urgency.

 

I suspect the problem is that mortgage protection might be seen as income, even if you're not claiming MI payments. There's a specialist team at the DWP which deals with mortgage issues, and that's who you need to speak to.

Flexible Support Fund and Adviser Discretionary Fund does not give cash anyway. They have a list of contractors they have to contact to supply what the customer needs. Eg Argos, Primark will supply the item to the value listed: smart suit for £120, shirt for £20, tie for £10. And then we have to show the receipt to JCP. Customer won't have to pay upfront but given a voucher or similar. It is for removing barriers to work so my implementation was no food is a barrier to work. Then googled ADF / FSF and it shows you will get a bicycle / laptop / childcare / travel costs but no living expenses.

I know what the ADF/FSF is, thanks. It's just totally irrelevant to the OP's situation. There is absolutely no legitimate way the OP could use the ADF to help with his or her particular issue.
