Worked four years same place the post was senior care assistant private care home. employed as senior care assistant. Applied for new job' had interview all fine so far. new employer ask me when I can start! . I said I would give the months notice as per contract all fine so far. new employer ask them for ref. they have sent her an email saying 'It is our company policy not to give a full reference .

 

Any help please. new employer to me in email Says she don't understand what they mean.by Its our company policy not to give a full reference .

Many large employers will only confirm job title and dates of employment and will not comment on whether you were a good employee. This is probably what they mean.

Does my employer have to give me a reference?

 

Usually, you don't have a right to a reference from your employer. But your employer does have to give you a reference in some situations, for example:

 

  • if your contract says they have to give you a reference
  • where the reference is needed by a regulatory body. This might be a body like the Financial Conduct Authority so they can make sure people employed to give financial advice are qualified to do this.

Regulated financial institutions such as banks and other regulated institutions, such as law firms, will almost always only give a reference confirming job title and dates of employment. I work in a regulated industry where I have to be licensed and it is certainly my firm's policy only to confirm job title and dates together with confirmation that the reference is given in accordance with their reference policy.

 

I don't think the extract from the CAB website is talking about references to potential employers. It says "where the reference is needed by a regulatory body". I think this is more to do with interaction between the regulated entity and the regulator. For example, the Financial Conduct Authority can request information about bank employees from banks, and likewise for the Solicitors Regulation Authority from law firms. I don't think this covers references to potential employers.

 

There might be some confusion about the meaning of "new reference". I suggest asking the former employer to provide the standard form reference which they usually provide.

Care work is not a regulated industry in this respect and there is no legal obligation on the old employer to provide a full reference. Where the new employer does have a regulatory obligation is to perform the required DBS checks alongside any information provided by the old employer.

 

Have you actually had a conversation with your old employer to see what they would be willing to provide? Is there a manager there or a senior colleague that would provide a supplementary reference to go with the employer's basic reference?

 

I understand the dilemma, but feel that your new employer is being a little over-enthusiastic

Thanks sidewinder. This cannot be right. Yes they sent her the standard ref new employer to me in email Says she don't understand what they mean.by Its our company policy not to give a full reference . Yes senior colleague provided a supplementary reference to go with the employer's basic reference.

I think you need to check what the new employer actually means by 'full reference'. It is not clear to me what they actually want.Its a bit odd that your new employer is surprised by all of this. It is now very common for employers, including in heavily regulated sectors, to have a policy where they only confirm dates and job title.

Telephone your old employer and speak to them about the issue.

 

I started with NHS but had problems because I had two spells of employment with the same employer and they only gave a reference for the 2nd spell.

 

After telephoning them I resolved the issue satisfactorily and got them to send a second reference.

Employer will provide the standard form reference that's ok new employer will not accept this she says she needs full ref as Its a care home.

Well I went into work today' luckily I had a chance to speak to the manager asked if I could withdraw my notice he said yes he will accept my withdrawing notice and to work on as normal. vary awkward feeling about this !
