    • Can someone please advise on how to upload picture.  I’ve taken a photo of the first page of claim form and converted to pdf but it saying file too big. It’s only one page
    • pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time.     • Hi, I have an old outstanding debt from 1994 due to MBNA for £20,000. The debt has been passed to various DCAs and is currently with PRA Group.  I sent them a CCA letter in January 2024. They acknowledged this letter and stated they would come back when they had more information, however the information did not arrive within the 12 working day scenario.. I have just received a copy of the agreement which goes back to 1994 from them. In their response letter they have stated " Please find enclosed documentation received to date: we are waiting further documents in order to complete your request. We have currently deemed this debt as unenforceable which means we are not able to take court or further action against you to recover the outstanding balance". They then go on to state "we are still legally entitled to:  1.Contact you to ask and repay what you owe 2.Pass your details onto a third party collection agency 3. Continue to report your account with the credit reference bureaux (as appropriate)". I'm at a loss as to what I should do next and would appreciate any guidance on this matter. I am currently paying £5.00 pcm. TIA

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Lowell/tocatto chasing car insurance 'debt'

Last month a company called Tocatto contacted me regarding a small debt (cancellation fee) from Budget Car insurance,

 

I arranged to make x4 monthly payments of £34.75 and paid first instalment 20/11/13.

 

About a week after this a company called Lowell contacted me by email asking me to phone them and quote a reference number,

 

I did phone them and it was about this debt,

 

they said no payments had been received,

 

I sent them the CCA letter demanding a Statement of Account which I received today,

and no mention of monies already paid.

 

I phoned them up and they told me they have now received the initial payment from Tocatto.

 

They said Tocatto is a company that does work for them so I am fine with that.

 

However they now want the payments set up directly with them and not Tocatto,

I refused to do this until I had written confirmation from Tocatto that the debt was now in the hands of Lowell

and they were fine with that also as this would avoid double payments being sent out.

 

This is my problem now that I have explained the above;

 

Lowell brought up an old debt that I had with T-Mobile for £72.00,

I paid this debt to T-Mobile in May 2013 and it is marked as settled on my credit file.

Is it not a breach of the Data Protection Act 74 for Lowell to be still processing my personal information

regarding an old settled debt????

 

the woman I spoke to from Lowell had all the details right down to how long my phone contract was,

the total amount I had paid since 2006 and how the debt of £72.00 came about.

 

Appreciate any help here please.

they are taking you for a MUG.

 

they are NOT BAILIFFS

thay have NO SUCH LEGAL POWERS.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Has the phone company sold the account to Lowells ? If so, you should have received from either one of them, a notice of assignment.

If the debt has been sold and you still owe money, then the debt is still live and they can continue updating for the remainder of 6 years.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I am not sure, I have never had a letter from Lowells before, but even if I had, can they still process data on the T-Mobile debt even though it was settled in May 2013?

Yes. It only says settled because lowell bought the debt. WHen they update the record, it will show the previous info again.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Sorry, I am a little confused.. if the Mobile phone debt is paid up, why are Lowells contacting you at all ?

 

 

There seems to be 2 debts involved.. are they connected in any way ?

Exactly what I am trying to say, Initial debt to T-Mobile £72.00 was paid in May 2013 directly to T-Mobile. The reason Lowell have become involved is for Budget insurance debt. These 2 debts are not connected in any way at all. But when I phoned Lowell to discuss Budget debt they put me on hold and then came back on to say I have an outstanding debt with T-Mobile, which I dont, as it was paid in May.
