Hi folks hope you can help me here, something got highlighted on my wife's bank statement as we were checking through all direct debit payments, there was a payment for £49.00 to AXA, we didnt know what this was so we phoned them to find out it was for home insurance cover! The story goes, August 2011 we took out home insurance over the internet, my email at the time was a sky.com one as we had sky broadband, in October 2011 we changed broadband provider to BT so the sky email address was now obsolete. August 2012 Axa said they sent an email for auto renewal and as we didnt reply (cause we didnt get email) they renewed our policy, they done the same again in August 2013. At no stage at all did we receive any notification regarding the renewals of this policy and had in fact took insurance out in 2012 with Tesco, 2013 Churchill. So, Axa have taken payments totalling £730.00 from my wife's account (I know she should have checked, but she didnt). Axa have told us we cannot get this money back because we should have notified them about the change of our email, I have no recollection of me being advised that this was down to me to do and as I said since 2011 they have not phoned us or sent any letters to us about the renewal and are refusing us point blank a refund of the money they took. What do you think I should do? :mad2:
  2. having a fight with Capital One, trying to reclaim my PPI that I paid for 6 years, they are refusing to pay it to me. I am arguing that I was self employed and they knew this so policy should not have been sold to me. i sent them CCA letter 12+2 days I received a reply showing a photocopy of my original signed credit agreement. Yes I did tick the box for PPI, but I also ticked the box about my employment to say I was self employed. Who wins this one then?
  3. Exactly what I am trying to say, Initial debt to T-Mobile £72.00 was paid in May 2013 directly to T-Mobile. The reason Lowell have become involved is for Budget insurance debt. These 2 debts are not connected in any way at all. But when I phoned Lowell to discuss Budget debt they put me on hold and then came back on to say I have an outstanding debt with T-Mobile, which I dont, as it was paid in May.
  4. I am not sure, I have never had a letter from Lowells before, but even if I had, can they still process data on the T-Mobile debt even though it was settled in May 2013?
  5. But the debt was settled in May 2013, data should not still be processed, surely?

Last month a company called Tocatto contacted me regarding a small debt (cancellation fee) from Budget Car insurance, I arranged to make x4 monthly payments of £34.75 and paid first instalment 20/11/13. About a week after this a company called Lowell contacted me by email asking me to phone them and quote a reference number, I did phone them and it was about this debt, they said no payments had been received, I sent them the CCA letter demanding a Statement of Account which I received today, and no mention of monies already paid. I phoned them up and they told me they have now received the initial payment from Tocatto. They said Tocatto is a company that does work for them so I am fine with that. However they now want the payments set up directly with them and not Tocatto, I refused to do this until I had written confirmation from Tocatto that the debt was now in the hands of Lowell and they were fine with that also as this would avoid double payments being sent out. This is my problem now that I have explained the above; Lowell brought up an old debt that I had with T-Mobile for £72.00, I paid this debt to T-Mobile in May 2013 and it is marked as settled on my credit file. Is it not a breach of the Data Protection Act 74 for Lowell to be still processing my personal information regarding an old settled debt???? the woman I spoke to from Lowell had all the details right down to how long my phone contract was, the total amount I had paid since 2006 and how the debt of £72.00 came about. Appreciate any help here please.
