help i've been sanctioned HB + JSA stopped

i had my housing benefit and jsa stopped from last week until january next year 2014.

as a result i have now been served an eviction notice and proceedings are being taken against me now to get me out of my little flat.

 

This is all because i went to work for one day on a hot dog stall, and declared it.

the whole point of being a job seeker is to find work, and now they have flipped it on me saying that i should of told them on the day.

i had no phone and was at work how could i?

 

now i have lost weight and not eaten a meal in days, and am going to be in fear and destitute from now through christmas for what?

 

prisons are now going to fill up , suicide will rise, and crime is going to explode.

 

i will now do what ever i have to in order to survive.

 

if this is how David Cameron thinks Britain will become better off then he is clearly on crack.

 

i hate him and his smug greedy ways and the people who work for this benefit agency are no better.

 

everyman for himself now. and i will get money how ever i can now.

You need to get a nil income form from your council and get it filled in. That'll get your housing benefit going again till your sanction ends. You should also complain to your MP about this, and contact the manager of the job centre to make a formal complaint. Tell them you're complaining to your MP too. You might try telling your local paper as well if you don't mind the publicity. This nonsense will go on until there's public outcry about it and that won't happen until it's exposed. .

I renegotiated my Job Seekers agreement to 60 minutes travel each way on health and age grounds. I knew I just did not have the stamina even for that plus 40 hours. I know this because I was self-employed working 60 hours a week until I was 51 and then I had to cut down the hours because of exhaustion with too many mistakes.

 

If you are over 55 and signing on for JSA it is worth thinking about.

 

However, I would likely to apply for a job that far away knowing full well that the employer would be likely to reject me.

 

I expect my Advisor is collecting evidence for the Sanctions and Appeal right now.

 

Do sanctions mean the loss of Housing Benefit? I am sure the rotten Council want to evict me. They have made enough demands about their cruddy flat and mandates which I ignored. I did not sign the new Tenancy Agreement".

Yes, this. Contact the council on Monday and explain that you have zero income - loss of JSA through sanction does not mean you also lose entitlement to HB. Then find out if your JSA claim has been sanctioned or if it has been stopped because they believe you are working. What you do next in terms of your JSA depends on the answer to this.

 

No JSA claim should be closed or sanctioned because you declared a single day's work, and you do not have to declare it on the day - a "reasonable time" is all that's required, and 28 days usually covers that.

 

Sort out your benefits first, then consider making a complaint.

Surely they can't serve an eviction notice if your HB was just stopped last week ?

 

And surely they don't sanction peopel for working a day? Were you supposed to attend an appointment with the DWP or a WP provider on the day you worked on the hot dog stall.? And they've rasied a sanction because you didn't call to cancel it or something?

@ Antone thanks ill get onto that monday.

^ i was already in rent arrears and couldn't afford to miss another payment, the benefits office were aware of this. Now i have missed another payment the landlords have taken legal proceedings against me. i declared the days work at my last signing on day in writing, and i have now been told i didnt explain to them my reason to them. Also in my 1st post i didnt mention that on the day of work that i did, i should of gone to a pinnacle people meeting but i notified them too they said they only notify the job center that i didnt attend, but they dont notify them that i called to explain my absence .

If this is the case, you need to appeal. If you only worked one day and declared it at the next appointment you shouldn't have been sanctioned.

In the meantime stay put at your property. If you leave now, the council will deem you intentionally homeless, and may wash their hands of you.

 

Also make sure to claim Hardship Allowance at the Job Centre. Unless you're ill, or pregnant, you have to wait 2 weeks for the first payment. It's about £40 per week btw.

They shouldn't treat u like this in FACT they should let u off for just a day's work?!

 

One thing i have learnt when it comes to the Jobcentre - NEVER tell them the truth, they stuff u up in the end and ur left to pick up the pieces. Hope u get good news. Let us know mate. :/

I hope you're not advising people that they should work without declaring it. That would be fraud.

 

Yes, best own up to doing work...but...i've had times where i've gone up to London for the day and not looked for work, didn't tell them, not worth the hassle!

 

The whole system is messed up, i'm dreading signing on again nest monday, i haven't looked for work on 24th, 25th and 26th December or 31st and 1st January...i've enjoyed myself over the festive period with my family...and that's how it should be, we shouldn't be looking for work during that time!
