    • I'm not quite out of the woods yet. The email they sent me also said that I have £290 of arrears and it has been passed onto their collections department. If anything my account should be £10 in credit.  They haven't taken into account the trainers that were returned back in October. The other items have been credited to my account so it looks like I've still got work to do.  They are not very quick to reply to emails, although I've only sent one trying to find more information, and I have no idea what happens next. Half of me want's to get it sorted properly the other half just wants it over with, if that means a default then so be it. 
    • No. It's a public (council maintained) road with some houses in it.   Some other houses back onto it too and those owners have right of way down the road to access the back of their properties.  Theres a few garages with private osp - so one drives out the garage, over the osp, and onto the public side road and then out on to the public main road.  Irrespective of whether the garages are used - the local businesses parking their cars on the private osp are ostensibly preventing cars from accessing the public roads.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bailiffs cannot be instructed until after a court judgement has been made.

 

If the LL takes court action the court will inform you.

The new process, called Commercial Rent Arrears Recovery (CRAR), will only be available in 'pure' rent arrears cases and will replace the common law right to 'distress for rent'. Distress allows a certified bailiff to enter leased commercial premises, occupied by a defaulting tenant, and remove and sell goods owned by that tenant up to the value of the rent arrears without initiating legal proceedings.

 

 

I think you will find that where Commercial Rent is concerned the above information is correct.

Thank you for getting back to me, i thought they couldn't do it without first going to court, if she has already gone to court and they are in the process of sending me the papers can this stop me from going bankrupt or is there anything she can do to block me your views are much appreciated

There is some more advice on the link above - from what I am reading, once you have filed for BR then creditors have to stop any actions they might be planning against you.

thank you and I will take a look at the link, was just worried as land lord wanted to see me tomorrow and has already asked for the arrears to be paid in full without delay, but I have not mentioned that I was thinking of bankruptcy, just wanted to go and do it without them knowing.

I was going to suggest you ring Business debt line first thing in the morning, but they are only open Monday - Friday.

 

National Debtline is open from 9.30 am they might be able to advise what you could do, however I guess it all depends what time you are meeting with your Landlord.

 

I really don't know what else to suggest - all caggers are volunteers and don't have set times when they are on the forum. I would certainly hope that someone is able to respond before tomorrow though.

The "new" scheme does not come into effect until 6 April 2014 so unfortunately you are still at the behest of the Distress for Rent Rules whereby the LL can just instruct a Certificated Bailiff to enter the premises and seize goods. At a rough guess this adds approx £1k to the debt. I would suggest if you are thinking of going BR and have the money to do so get it done ASAP. Even if they do enter the premises it can be added to your BR anyway but it may be better to remove anything of value in the meantime.
