    • Yes you should take this view, but this is nothing to worry about you will be fine. you have a very well edited WX im sure although I haven't actually looked at it because I can't seem to work out which one is the new one anymore, although I do remember something previously. however if i remember it right its just a lost parcel via packlink and no insurance which frankly is pretty straightforward and should be a copy of farooq v evri.     • well in every other thread advocate or not evri always send a cpr27.9 because they never turn up. I don't think we've seen a thread here without one. Maybe @BankFodder can tell me if i've missed one, but all of the ones I can remember there has been a cpr 27.9 notice even when an advocate has attended and from my own knowledge also I've always had CPR 27.9 advocate or not. I dont think there is a single thread on this forum where evri have shown up themselves and similarly I don't think there is a single thread where they dont send notice (aside from this)

    • Thanks FTMDave.  VCS's WS was from Jake Burgess.  I will draft my WS and share with copies of court order, and VCS's exhibits asap.  I'm away tomorrow so more likely Friday.  Thanks again for the advice   
    • Thanks. Time to move on this. 1.  You need to tweak the magnificent WS that dx suggested.  Adapt it to your case.  It should take you about half an hour (I recently wrote a WS from scratch during a train journey which wasn't optimum 😂 with lots of cross referencing and it took me an hour an half, you have one already cooked thanks to dx). 2.  We will add bits to ridicule VCS's WS - it's rich that they moan about your defence being standard when their Particulars of Claim are too and also include the rubbish about keeper/driver that has been criticised numerous times by the courts. 3.  Who wrote their WS?  Was it Mohammed Wali or Ambreen Arshad or have they got someone new? 4.  We need to see a good chunk of VCS's exhibits.  I don't get why we have to keep asking you for things rather than them being volunteered.  Isn't it obvious that we can't help you compile a decent WS if we can't see what the other side is arguing?  All their silly signs aren't needed, but any contract with the landowner is important as are all the photos of your vehicle. 5.  You've never shown us the court order which fixes the hearing date.  It should be obvious we need to see what the court has ordered.  This is the second time we've asked. 6.  VCS were using Elms Legal.  Are Elms Legal still involved?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

IIf a DWP staffer wants to sanction you they'll have to tell you about it. In the meantime, look for work when you can and stop fretting about sanctions. You'll be OK.

 

On that point, I solidly concur - DWP staff have strict guidelines that they should follow and can not go dishing out sanctions on a whim. I'd also recommend going to bed earlier, cutting back on coffee & tea in the evening, and perhaps getting in to the routine of using a computer for just a few hours each day.

 

Oh, and go out and find at least one thing each day that makes you smile - For me, it was the silver tabby that lives a few doors down that came in wanting a fuss made of her.

i know i keep going on about stupid things but i'm kinda worried about what happens when i signed on today

 

 

well the guy i saw looked at my job search diary and i asked if there were any restrictions preventing me from doing a full job search, i said no there isn't and he started telling me details of how to fill out my job search form if an application was made/not made or something, then he wrote on my job search diary no restrictions and i'm worried this means i'm going to get sanctioned :/

then went the meeting was over he said have a good forenight, you may get lucky.

 

 

am i worrying over nothing or because i do most of my job search online as i suffer from anxiety not count as a full job search? i can prove i have applied for all the jobs on my form.

The No Restrictions issue is baloneous....in the sense that you can only reasonably be expected to apply for those jobs for which you are skilled, qualified and competent to do, and for which the barriers to entering a specific job are not excessive.

 

Provided that you apply for a reasonable number of jobs each week (I apply for a reasonable number of jobs each day), which include job goals in the Job Seekers Agreement, anyone in Job Centre Plus who is not a Jobsworth with Obsessive Compulsive Behaviour with the intent of raising a sanction doubt for even a minor indiscretion is unlikely to raise a Sanction Doubt simply because you identify job leads from the internet.

I'm assuming it records EVERYTHING you do; when you've logged in, what pages you've looked at, etc...and that's the dangerous thing.

It's manager by Monster USA. I doubt they will refer Terabytes of cookies activity to the DWP.

Kinda like the North Korean football team in the last World Cup.

 

i never knew they had a football team, it'll also be like the movie scrooge in the scene where he looks into the future and see's everyone dancing singing and having a party because he's died. i bet even David Cameron would find it hard to look upset as i've heard he hates IDS as much as everyone else does :)

We simply indulge and tolerate a pleb of the calibre of George Iain Duncan Smith, a pathetic individual who, after being kicked out of the army in 1981, was unemployed for 6 months (ie sleeping all day, playing video console games, living off Betsy), and later, could only gain kudos by lying on his CV.

 

Hopefully, before the next election, David Cameron will have sidelined the pleb into a less demanding role.

Also, they were one of the beaten quarter finalists in 1966, a year that is either glorious or infamous depending on which side of Hadrian's Wall you were born. Who knew? But in the last WC, it was supposed that all of their fans were actually Chinese folks paid to cheer for them, although they didn't do much actual cheering. Mainly they looked bored and tortured by vuvuzelas. Can't say I blame them - the football was dire and the vuvuzelas sounded like a paint can full of angry wasps. But I digress.
