    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!! 
    • Northmonk forget what I said about your Notice to Hirer being the best I have seen . Though it  still may be  it is not good enough to comply with PoFA. Before looking at the NTH, we can look at the original Notice to Keeper. That is not compliant. First the period of parking as sated on their PCN is not actually the period of parking but a misstatement  since it is only the arrival and departure times of your vehicle. The parking period  is exactly that -ie the time youwere actually parked in a parking spot.  If you have to drive around to find a place to park the act of driving means that you couldn't have been parked at the same time. Likewise when you left the parking place and drove to the exit that could not be describes as parking either. So the first fail is  failing to specify the parking period. Section9 [2][a] In S9[2][f] the Act states  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; Your PCN fails to mention the words in parentheses despite Section 9 [2]starting by saying "The notice must—..." As the Notice to Keeper fails to comply with the Act,  it follows that the Notice to Hirer cannot be pursued as they couldn't get the NTH compliant. Even if the the NTH was adjudged  as not  being affected by the non compliance of the NTK, the Notice to Hirer is itself not compliant with the Act. Once again the PCN fails to get the parking period correct. That alone is enough to have the claim dismissed as the PCN fails to comply with PoFA. Second S14 [5] states " (5)The notice to Hirer must— (a)inform the hirer that by virtue of this paragraph any unpaid parking charges (being parking charges specified in the notice to keeper) may be recovered from the hirer; ON their NTH , NPE claim "The driver of the above vehicle is liable ........" when the driver is not liable at all, only the hirer is liable. The driver and the hirer may be different people, but with a NTH, only the hirer is liable so to demand the driver pay the charge  fails to comply with PoFA and so the NPE claim must fail. I seem to remember that you have confirmed you received a copy of the original PCN sent to  the Hire company plus copies of the contract you have with the Hire company and the agreement that you are responsible for breaches of the Law etc. If not then you can add those fails too.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I finally started to break the payday loan cycle. Opened a new account and changed details with work, tax credits etc. problem is my manager has just told me that she was too late to change my bank details for my pay dispite giving her them 2weeks before payday. So now I'm in a mess. I'm due to have 2 loans come out on Tuesday which will take all of my wages. Rent council tax elec will not get paid. Bank has told me they can't cancel a CPA. Even if they could its a bank holiday on Monday so it's not a working day. Please help. I've no idea what I'm going to do. Changed my phone number for online banking and now I can't transfer money from my account to the new account for 5 days so i can't even transfer it early morning. And I've registered for telephone banking but they say i need a security number to do that which will be sent in the post and I won't get it Until around next Thursday. My pay goes in on Tuesday.

When does your rent, council tax and electric come out, can't you pay in funds at the Branch on Tuesday.

Regarding the Bank telling you they can't cancel a CPA, this is not the case..............

In short i have no money. Mays tax credits are gone to food and childminder. Just had a near hour long argument with bank and they are having none of it. Also saying if i say my card is lost they can still take the money.

The only thing I could suggest would be to get in touch with all those you are not going to be able to pay and explain you cannot make any payments at the moment.

Good news. i phoned the bank again and explained my situation only to be transfered to a very helpful chap who immediately said that he can cancel both cpas on the account. he explained that not all staff had been trained on it yet.Done it while I was on the phone, and has put a note on my account. Sent emails off to both companies that I withdraw the authorisation to take money out of my account. Bank says that if they do take money it will be refunded after midnight the day they take the money as they will watch the account now. Don't quite understand how they allow them to take the money in the first place if its cancelled though. Took his name for reference but he did assure me that they were definitely cancelled. Only problem is what if they keep trying to take it.? Will transfer it as soon as online banking phone number up and running. If my money doesn't get refunded then i will scream blue murder. I await the outcome on Tuesday.

Nothing else will be paid into this account from next month and I will only pay by standing order , once it is all paid i will close that account. Bank of scotland dont allow payments to be taken if it takes you into an unauthorised overdraft. They just decline the payment which is what's happened today, wonga have sent me a email saying they have been unable to collect full amount, so the bank definitely are not going to give them it. Renegade I have asked for it in writing but the guy asked me 3 questions or said 3 statements regarding credit ref and I still owe the debt etc. so I'm hoping it will all be fine. Despite sending messages to both companies i have had 4 phone calls and 2 emails. I have requested that they contact me only by email or letter so I've got a paper trail. All my money has been taken out of the bank this morning so will leave it a few hours before i phone bos regarding refund. If its cancelled it should be cancelled. What a stupid way to do things. They said they will automatically refund the money but I will just keep an eye on it. Is there anything else i should be doing right now or should I just keep sending the same emails to each company. They are quick enough to offer a new loan but are not acknowledging the emails I've sent.

They havent cancelled it. WHat they have done is placed a marker on it, so if it gets taken, it will be investigated and refunded. They are breaking the law.

Can I ask how long it took to set up a repayment plan with QQ and how do you make payments?

 

I haven't set them up yet as they are still ignoring me. But I'm not budging, I know what I can afford and that's what they're getting. Wonga have cleared my account so I'm waiting on my bank to refund the money. Then il clear my bank account and they will have to play ball. Will let know how I get on though. I take it your in a similar boat as me?

Yes Im in the same boat as you. I cancelled my card and CPA with the bank and all PDL companies. I told them if they take payment I will make a complaint. I have set up repayment plan with Wonga and made the first payment last week. I received an email stating they have received it and they informed me how many more payments I have to make. I have set up a repayment plan with 4 of the 9 companies. It was ridiculous as I was taking more loans out just to cover roll over fees. It comes to the point when you just cant do it anymore. I expect QQ with go to a debt collection agency as they say they have no bank account.

Do you pay wonga by standing order? I've pretty much done the same as you rolling over but I'm fed up paying all the interest. Still no replies from wonga or quick quid. Will probably hear when I get the money refunded though. If quick quid have no bank account then how do they run. Seems like a way to try to get your bank details from you.

So I called the bank today and they're saying that my request to cancels all CPA's is in a queue with card disputes, and because I phoned them on a bank holiday weekend the CPA's that have been taken will not be refunded. I was told on Sunday that my cancellation date was Sunday and all payments would be refunded immediately. Then she said that i had to phone both companies and request that they fax a letter to the bank telling them i could have the money back? I said I wouldn't phone them as they can say anything and they want their money regardless to which she replied, what were the circumstances that you took out these loans! You can't benefit from a loan and then expect the bank to sort out your problems. Bank are now saying it will take 2-8 days for the payment to show on my account and even then it's unlikely I'll get any where. What now.?

Name and shame your bank. They are completely wrong. The regulation/law is VERY clear.

I paid Wonga last week straight into their bank account. As for QQ they also told me that they did not have a bank account. However I found a post where someone had said they paid it into a QQ bank account. The details are:

Cash Euronet Uk

sort code: 20-19-90

Acc no: 03759830

 

I have emailed them asking as to whether this is their bank account. I am waiting for confirmation. I have kept the email just in case they don't get back to me. If they add any charges at least I can say that I made every effort to pay them back. I have not heard from them today. They sent me a repayment plan over 2 months. I said no I could not afford that. let me know if you hear from them.

No need to wait for them to reply mindy. Just send 1-2p and see if it gets taken off the debt.

Do you think it's worth putting a formal complaint into bank of scotland. I'm up for a long and lengthy fight with them.
