Actually they haven't offered the full amount, the full amount is £494.00 not £450.00. I know its only a £44 difference but they said thats all my claim was worth. My bank statements definately show £494.00, I have just spent ages re-checking them all.

If they haven't offered an amount you're happy with then definitely keep pushing them! That's all that matters at the end of the day, that you are happy with the end result.

i rang the bank after sending my second letter with my spread sheet and she told me she had 5 days to acknowledge my letter then 80 days to sort it out , is this right ?

I take it you sent the Letter Before Action? In it you state 14 days for them to pay you, if they do not pay you then you file in court, or by MCOL. Stick to your time scale, this is your claim not theirs.

I have been reading through a few of the threads and now find myself in the position that I am freaking out a bit! What generally happens after the N1 has been filed? I know the bank have to acknowledge and generally they say they will defend and then don't and pay back the money, but what happens if they don't? I don't need this stress, I'm trying to sort this, and a wedding and a financial settlement from my ex that he has defaulted on! Can someone explain and put this worried mind at rest before I need botox to get rid of stress lines!!!!!!!!!!!

I have filed and they ignored it. No acknowledgement no call no nowt.

 

I went back to court after 14 days of filing and filed for judgement against them 2 days ago.

 

Now waiting for court to contact me or Halifax to pay.

Calm down hun:) there is nothing to worry about, you will win. I hope you stick around after Halifax pay up - because you will look back and laugh at how thier silly games were just that.

 

My Halifax didn't make it as far as court, but of the ones that have, there are no losses whatsoever!

 

Do me a favour, take the stress off and put it on our shoulders. You have constant support here. Any probs you'll get all the answers you need.

 

I think you have made all the right decisions and you will, very shortly, be reunited with your dosh.

Judgement only happens if Halifax don't acknowledge your claim - I doubt it will get to that. When you file your N1 the Halifax will have 5 days for it to have it served to them, 14 to acknowledge the claim and a further 14 days to defend.You need do nothing during this time and I reckon they will pay before you reach the end of that process.

 

Nothing is set in stone, but I reckon that will be the way of it.

 

If not, for some strange reason, we'll guide you;)

Thanks guys, I'm trying not to stress, trust me, but it's easy to get worked up when you read about writs, warrants and bailiffs. I have every intention of sticking around and I daresay it will seem quite funny, eventally.

I really wasn't sure what to do today, specially after the bank offer but now I definately am going to file on Monday. Sometimes you just need someone to say yes go for it!

I've been there! If it was for the support I might have given up! I now know better, the more you read, the more you'll realise its the banks on the ropes (of course they try every trick in the book to frighten you off... HA!)

I have just had this nice chappie on the phone offering to help me re-coup any lost bank charges over the last 6 years, for a fee of course!!

No I got lucky and managed to get them from Ticketmaster when they released the second lot of dates. So not only did I get tickets but I got good seats near the front!

I got my court paperwork on Saturday, it was served on the 28th Feb and they have until the 16th March to reply. If they don't acknowledge within the 14 days I take it I can then file for default judgement? Do the court let you know if they have filed a defence or do I have to chase it up myself? Does the 14 days still include weekends? I think thats all the questions I have for now lol

The 14 days does include weekends, everything to do with this process is calendar days. The court will send you an acknowledgement but give it a few days past the deadline for post (they will let you know about defence too).

 

If you should find yourself in the situation where you can file for default, look into further on here, its not always as simple as it seems and can be a pain in the grass dealing with the courts and baliffs!

 

I don't think you'll have this problem with Halifax:)

I am asking for your help again!

I filed my N1 and the Halifax has until the 16th March to reply. I know I need to enter a judgement for default if they do not reply by the 19th March at the latest but how do I find out if they have replied? What are the implications of doing this? Could I write to the Halifax and state that I have issued my court proceedings which they have not yet acknowledged and ask if they are intending to defend my case?

I have been trying to find threads for other people who have been at the same stage I am but most of the threads seem to be from new people starting out.

No, just sit back and wait for the Court to write to you - they will keep you fully up to speed, if you have not heard anything by say the 19th you can phone the Court and inquire.

 

Don't bother writing to Halifax, waste of a stamp LOL!! they know your suing them and I'm sure they will shortly submit acknowledgement.

 

My guess is this will be over before 4 weeks from now, the Halifax do cave in easy IMO.

Well haven't heard anything from either Halifax or the court. They have until tomorrow to let them know if they intend to put in a defence. I'll probably ring the court on Monday and then file in my judgement for default if they have no acknowledgement.

Still nothing from the court today so I'll call them on Monday and if they have nothing then I'll have to file for the judgement by default. The thing is I'm not really sure of the process after I have done that as the Halifax now seem to be settling before it gets to the N1 stage so if anyone has gotten as far as judgements and beyond can give me some idea of what to expect then that would be great.

I had to wait almost 2 weeks, but the money just turned up in my account.

Filing judgement is a good thing. They have to pay then.

Thanks Seaside, I'm just getting worried about stuff that hasn't happened yet as normal. I have the judgement form so I'll fill it in and hand it back into the court on Monday. It seems from the threads I have read that the Halifax are quick to acknowledge Mccol and not so swift on the mark on the N1's. There shouldn't be a problem as I'm not claiming for anything over the 6 year mark and I'm only claiming judicial and not contractual interest.

Hopefully this will all be over soon and I can concentrate on getting the wedding organised. Shame they don't have a wedding stress thread on here lol!
