  2. Filed for judgement by default today as no acknowledgment made by Halifax.
  3. Congrats Nailz! Halifax had until today to acknowledge the court claim but they haven't. Am having to ask for a judgement by default so hopefully won't be long now.
  4. Thanks Seaside, I'm just getting worried about stuff that hasn't happened yet as normal. I have the judgement form so I'll fill it in and hand it back into the court on Monday. It seems from the threads I have read that the Halifax are quick to acknowledge Mccol and not so swift on the mark on the N1's. There shouldn't be a problem as I'm not claiming for anything over the 6 year mark and I'm only claiming judicial and not contractual interest. Hopefully this will all be over soon and I can concentrate on getting the wedding organised. Shame they don't have a wedding stress thread on here lol!

  6. Still nothing from the court today so I'll call them on Monday and if they have nothing then I'll have to file for the judgement by default. The thing is I'm not really sure of the process after I have done that as the Halifax now seem to be settling before it gets to the N1 stage so if anyone has gotten as far as judgements and beyond can give me some idea of what to expect then that would be great.
  7. Well haven't heard anything from either Halifax or the court. They have until tomorrow to let them know if they intend to put in a defence. I'll probably ring the court on Monday and then file in my judgement for default if they have no acknowledgement.
  8. Good Luck! Halifax refused to pay my claim in full so I am at the court stage but don't take anything less than the full amount!
  9. Hi, from what I understand you can only apply interest if you get to the court stage. You can enclose it on the schedule of charges you send with the LBA as i understand that this is a kind of warning of what they would have to pay if you go to court. If they have offered you the full amount of the charges less interest then you really should accept that as I understand the court take a dim view if you have refused to the full amount back just because they haven't added the interest. If they have not offered the full amount then by all means proceed to court. I think thats right, you may have to check with someone else!
  10. I am asking for your help again! I filed my N1 and the Halifax has until the 16th March to reply. I know I need to enter a judgement for default if they do not reply by the 19th March at the latest but how do I find out if they have replied? What are the implications of doing this? Could I write to the Halifax and state that I have issued my court proceedings which they have not yet acknowledged and ask if they are intending to defend my case? I have been trying to find threads for other people who have been at the same stage I am but most of the threads seem to be from new people starting out.

  12. I got my court paperwork on Saturday, it was served on the 28th Feb and they have until the 16th March to reply. If they don't acknowledge within the 14 days I take it I can then file for default judgement? Do the court let you know if they have filed a defence or do I have to chase it up myself? Does the 14 days still include weekends? I think thats all the questions I have for now lol Maria
  13. Hi Atmos, I think I spoke to a chap called Simon, yeah it was Simon Nicol. He offered me £450 of my £494 claim as he said I had only asked for £450 back. I refused and then he sent me a letter saying I had turned down his offer of £469.00? Strange they would offer me £469 when according to them my schedule of charges is less? I filed on Monday am just waiting on court papers but good luck and make sure you clarify the amounts if you deal with this chappie. Maria
  14. No I got lucky and managed to get them from Ticketmaster when they released the second lot of dates. So not only did I get tickets but I got good seats near the front! I can see a Tom Jones scenario in their with the knicker throwing, poor Mark Owen!!!
