Minicredit Accusing Me Of Fraud

I had a payday loan with Minicredit due out on the 1st of this month.

I contacted Minicredit via email on 2 seperate occasions a few days after my repayment date stating that I would need to setup a repayment plan...I recieved NO response to the 2 emails I sent to two different email addresses I found for them online including their own internal email address on their website.

 

They then removed £50 from my account around a week later which I requested be reversed by my bank to which they agreed and credited the funds taken.

 

After finding another email address for them online I requested yet again that I setup a repayment plan to which I recieved this response

 

Dear XXX

 

A MiniCredit Claims Department member has replied to your claim, # with the following response:

 

 

The following response is being sent to You according to the Formal Complaints Procedure.

 

 

 

Microcredit Ltd (trading name MiniCredit) has received a chargeback regarding the payments debited from Your debit card.

 

 

 

We would like to remind You that by signing the Loan Agreement You have authorized Microcredit Ltd to debit payments from Your Bank Account using the debit card details registered with us.

 

 

 

It is considered fraudulent behaviour to file in a chargeback when You have registered and received the service regarding which the payment has been taken. We have no alternative but to forward the information regarding Your fraudulent chargeback to our Legal department and also report Your illegitimate actions to the National Chargeback Register. The National Chargeback Register will provide information to other Companies and will severely reduce Your ability to receive credit or other services in the future.

 

 

 

We advise You to immediately contact Your Bank and withdraw the chargeback claim to avoid further Legal proceedings.

Hmm, no I don't think they can accuse you of fraud. However, I am sure there will be others more experienced with PDLs who will be able to advise.

 

I see you have asked to set up a repayment plan, therefore I would say they are not behaving very correctly.

I have the saved emails that I have sent attempting to arrange a repayment plan and this is the first time I have recieved a reply but in the reply it mentions nothing regarding my mention of setting up a repayment plan.

 

I believe they took 3 seperate amounts which added up to £50 on a date well after the agreed debit date

Had you spoken to your bank about stopping the Debit ? If so and the monies were taken after that, then bank are responsible for refunding.

I called the bank after I realised they had debited my account around a week after my due date for my loan had past...I called the bank and told them that I have been trying to setup a repayment plan with them and they should have taken that money on that date...The bank then credited the money pending enquiry

Get that letter straight to the OFT and trading standards. That letter breaks every rule in the book and is designed purely to intimidate and scare you into meeting their demands. Don't put it off until tomorrow. Do it now.

I will get it printed off and sent off tomorrow as I have a printer in work I can use.

Should I contact them further in the meantime or stay silent until I recieve contact from the OFT?

Tell them that due to them accusing you of fraud, you are now taking legal advice and will also make a full report to the OFT with a comment on their fitness to hold a credit licence. Due to this, you will no longer be communicating with them until advised otherwise for a period of 7-14 days. In a week or two, we can send them a carefully worded letter that will get them off your back.

OP have you got an update relating to your progress with Minicredit? I am in a very similar position and have also been accused of fraud. I actually applied for the loan a few months ago and its only recently that my bank has reversed the funds hence the angry letter from Minicredit.

 

Does anybody have a contact e-mail for Minicredit other than the standard ones which give template responses. Someone has mentioned an e-mail address for a specific Minicredit employee (I think head of collections), for the life of me I can't remember where I saw it!

You MUST complain to the OFT if they are accusing you of fraud. Technically they have overstepped the boundary into illegal activities now. People say to get a complaint through minicredit, but thats just to cover your back, as they are very well known to completely ignore you.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I have now recieved this despite multiple attempts at setting up a repayment plan

 

The original debt totalled £185 and now stands at £518 apparently

I have replied to Oposlimited whoever they are and to mini credit with the following

I am absolutley sick of being ignored

 

I am emailing again for the 3rd time in a final attempt to setup a repayment plan with yourselves (Minicredit)

 

Minicredit have constantly ignored my offers of setting up a repayment plan and if this email leads to yet another failure of communication I will consider the debt written off.

 

I request you remove ANY interest or charges on my account and reset the amount owed to £185

 

I have attempted to make arrangements in order to pay this debt but as per usual you are putting obstacles in my way.

 

I am offering £25 per month via standing order starting 1st June

 

Please email back accpeting this offer and confirming all interest/charges will be frozen and removed providing the repayment plan is met

On a side note I have a outstanding debt with 247 moneybox but they havent even emailed me to tell me the loan is due they have just pilled charges on

Ignore them. Opos are minicredit. They just use a different name.
