    • You will probably get a couple more reminders followed by further demands fro unregulated debt collectors with even increasing amounts to pay. They are all designed to scare you into paying.  Don't. It's a scam site and they do not know who was driving and they know the keeper is not liable to pay the PCN. Also the shop was closed so they have no legitimate interest in keeping the car park clear. So to charge £100 is a penalty as there is no legitimate interest which means that the case would be thrown out if it went to Court.  Keep your money in your wallet and be prepared to ignore all their letters and threats. Doubtful they would go to Court since a lot more people would not pay when they heard  MET lost in Court. However they may just send you a Letter of Claim to test your resolve.  If yoy get one of those, come back to us and we will advise a snotty letter to send them.  You probably already have, but take a look through some of our past Met PCNs to see how they are doing.
    • Hello, been a while since I posted on here, really hoping for the same support an advice I received last time :-) Long, long story for us, but basically through bad choices, bad luck and bad advice ended up in an IVA in 2016. The accounts involved all defaulted, to be expected. In 2018, I got contacted by an 'independent advisor' advising me that I shouldn't be in an IVA, that it wasn't the solution for our circumstances and that they would guide us through the process of leaving the IVA and finding a better solution. I feel very stupid for taking this persons advice, and feel they prey on vulnerable people for their own financial gain (it ended with us paying our IVA monthly contribution to them)-long and short of it our IVA failed in 2018. At the same time the IVA failed we also had our shared ownership property voluntarily repossessed (to say this was an incredibly stressful time would be an understatement!) When we moved to our new (rented) property in August 2018, I was aware that creditors would start contacting us from the IVA failure. I got advice from another help website and started sending off SARs and CCAs request letters. I was advised not to bury my head and update our address etc and tackle each company as they came along. Initially there was quite a lot of correspondence, and I still get a daily missed call from PRA group (and the occasional letter from them), but not much else. However, yesterday i had a letter through from Lowell (and one from Capital One) advising that they had bought my debt and would like to speak with me regarding the account. There will be several.of these through our door i suspect, as we did have several accounts with Capital One. Capital One have written to us with regular statements over the last 5 years, and my last communication with them was to advise of of our new address (June 2019), I also note that all of these accounts received a small payment in Jan2019 (i'm assuming the funds from the failed IVA pot). Really sorry for the long long post, but just thought id give (some of) the background for context.... I guess my question at the moment is.....how do I respond to Lowell...do I wait for the inevitable other letters to arrive then deal with them all together or individually...? Do I send them a CCA?  Many thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i think my main point is why are dwp asking for more info. when they already told me it was going to tribunal? they do confuse me so much

 

Sometimes, during the appeals process, a senior decision maker will go through a load of cases waiting for Tribunal to see if the decision can be changed - they're under pressure to reduce the number of Tribunal cases. Sounds like yours is a contender - which is a good thing.

We've not long held our son's funeral - he had 2 Care Coordinators in the past 12 months and neither of them did ANYTHING that we could honestly agree helped him in ANY way!!

 

He endured Mental Health issues for several years and was NEVER offered a treatment/therapy that HE wanted or that was shown to be EFFECTIVE!

 

Lots of chat about 'support' (the invisible kind that does nothing for your situation) and lots of Acts being quoted in long letters pretending to be 'polite', but sadly nothing that actually helps your loved one get better!

 

If I can presume to offer anyone ANY advice on the subject, it would be this - Whatever you do, make sure you express your concerns/worries/doubts/needs IN WRITING as often as you feel the need and then if you do NOT get any sense out of them (and it is doubtful you will), then escalate the matter through their complaints procedures and keep at them!

 

They will ALL have a legal team behind them, so you may need to enlist specialist help and advice, but do NOT give up!

 

If you are the person in need, GET HELP and if you are the friend/carer/family of the person in need - GET HELP - we have found out too late that being nice, or reasonable or patient DOES NOT WORK - be a pain, be as awkward as you know how, be persistent and be committed to getting the best care you can!

can anyone please explain to me what is in the "remit" of a care coordinator"?

i tried to get intouch with mine today... as i felt very depressed and got drunk.... for the first time in months... due to this pressure of waiting on a tribunal...

are they there to care at all?

i have had no word from her and wont have now its nearly evening

I have never known a job title that was so inappropriate to the duties that were actually performed by those involved!

 

I had long ago renamed her the "lack of care uncoordinator' - with good reason!

If you want a good cry (it's way too serious to be laughing about), try looking through a document named "refocussing the Care Programme Approach 2008".....

 

My only caution would be, that's the THEORY, it doesn't work like that in reality - maybe they haven't been required to read it and still work the 'old way'????

I'm a care coordinator for the elderly mental health team. I can assure you my job involves an awful lot more than ticking boxes.

 

If anyone has an issue with their CCO then they need to discuss it with the team leader or their consultant psychiatrist.

If only life was so simple....

 

It was the Team Manager that was the problem and the manager above wasn't any better - the whole system doesn't work, or at least, that's our experience of it and we had plenty of other professionals who agreed with us!

 

The reputation of the CMHT in our area is very poor indeed, as is the whole Trust - appearing regularly in the lower quartile of all performance metrics tables - if you didn't have it before, you'd probably be suffering from depression after dealing with them!

 

No personal offence intended here, perhaps the individuals are all wonderfully loyal and committed folks, but how can they stick it day in day when they clearly are achieving so little????

 

Perhaps Kitten1 can attest that her JD matches up with the reality of her working day and she is able to deliver visible and measurable results to her 'service users' ?

 

Interested to know how many she has at any one time - 30 or more????

This is of course the root of the problem - too many clients, not enough staff or money. I have no doubt that the vast majority of people working in the mental health sector are there because they want to do the best they can for their clients. Unfortunately their best is often restricted by their total inability to make more hours in the day or more days in the week - many with whom I have come into contact would love to be able to drop everything and spend as much time with each client as they need. Regrettably they very rarely can, if ever.

Thank you for your honesty, it is appreciated...

 

However, this then means (ipso facto) that it is the 'service user' - or, as we used to know them, the HUMAN BEINGS, who suffer here the most.

 

The very people the system and staff who populate it, intended to provide help and support for and yet, for the very reasons you state, it isn't happening and YES, we ALL know about cuts and resources, BUT there are ARMIES of highly paid MANAGERS (another misused word) in this system that haven't got a clue and rather than make a business case for change (more staff/better working practices) they simply take the money and keep their mouths shut!

 

The regulatory system is also virtually useless, how many people really believe that Police investigating Police is ever a good idea and it's the SAME in the NHS - if you have any doubts, read all about the CQC - the ones who certified Bristol for operating on babies and thought Staffordshire was just wonderful, until a tidal wave of public opinion and outcry revealed the rotten, disgusting mess that had festered for too long......it's a national disgrace and our Mental Health Services are in the vanguard of this crime!

 

Tell me about the shining examples of good practice and humanity winning against the odds, but please don't lets pretend these routine failures are only the rare exceptions - they aren't and if we had genuine 'transparency' into the workings of what over a MILLION employees of the NHS are doing every day, we would all be rioting......

Ok, lets look at it from another angle. In an ideal world, what would you get from a care coordinator? Try & temper it with realism. We are humans. We care or we wouldn't be doing the job. While I'm at work, supervising and coordinating multiple people's care, I am also supervising students - both nurses & junior doctors - so there is somebody to take over when we retire. I'm dealing with ridiculous bureaucracy within social services & I don't even work for them.

 

I'm attending urgent cases to try & avoid admissions. I'm trying desperately to get somebody who is really ill to even engage with services in the first place. So forgive me if we have to prioritise our caseload.

 

I love my job. I love my colleagues & I have a wonderful team leader who has just been offered redundancy. So who gets the pleasure of leading the team? Somebody on less pay with potentially less experience & knowledge.

 

Oh and by the way, I can get more money in the private sector.

Kitten1, I am not having a go at the individuals within the system, there are many excellent ones. It is the failings of the government and their constant misleading of the general public about the resources available which makes me so mad.

You should receive written notification from the Tribunal which might specify which group you are to be placed in. If not, the DWP will make the decision.
