    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx  
    • There are a number of reasons why you may not have been issued a notice in the post within 14 days. If you were stopped by the police it may have been given verbally.     • all DYL's are subject to a TRO. looking at this newish, ever increasing as old ind units have gotten removed, estate, there are only lines on one side, on the other there is a parking lane with traffic calming through which you mention. i seriously doubt your mate has any clue what he is talking about.!! its not a private housing assoc estate. so its a public council owned road. no construction co can just decide to draw their graffiti on a road. the DYLs are certainly there pre 2016 even before his home was built. now ive had a quick look to see if the main access to royal park road has signs. there is no royle park road even on your map but there is a royal barn road which leads to where you are parked royal road has a restriction sign on the pole by the fence of the electric substation jnc with gipsy lane there does not appear to be one leading in from the other end - tesco petrol station

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been looking through a £1646.75 debt i have with meritforce/mckenzie hall

 

the original creditor being black horse,

 

since signing up to Experian i have noticed the debt to be £400 lower on my credit file?

 

i have spoken to Meritforce who said it was an error by Experian,

Experian are saying the debt they have on file is correct..

 

..Where do i go from here?

 

any advice welcome.

My experience with dealing with a relatives debts, is that most DCA's appear to make up the debt amounts or they make a lot of mistakes.

 

What is the history of the Black Horse loan debt ? When taken out ? Last date of payment and to whom ?

 

Why are you contacting a DCA by phone ? Not a good idea.

 

What do you want to do with this debt ? Is this the only debt that you have ? What are your circumstances ? employed/home owner ?

We could do with some help from you.

The debt is from car finance a few year ago when I was younger I have been paying a small amount each month to merit force but want to get my credit rating improved so paying double the amount now to get it gone quicker! I signed up to experian hence the mistake has been spotted! How would I get it resolved? Obviously merit force arnt going to admit it being there mistake! I rang the company to try and get it resolved.

I'm paying £70 p/m that's all I can afford. Merit force are ok with the arrangements n I've paid a regular amount each month never missed a payment etc the only problem is the £400 difference in amounts

I'll bet Mertifarce are happy with an arrangemetn of £70pm! If you've paying that a year or more you're not far off paying the whole amount off You should have received an annualt statement from Meritfarce showing how much you've paid and how much is outstanding. You would know how much you've paid and you have the original amount so you can work out whose right or not. Send Meritforce's cretins a short, to the point note asking for all such statements to be sent to you pronto. In the meantime send Blackhorse a CCA request for the original documents.

I think you will have to write to ask Meritforce for a breakdown calculation of the current outstanding amount, as well as a statement of account. They have obviously added an additional £400, since the debt was put on your credit record. They need to account for this and you can raise a complaint with the FOS, if they don't provide information, which you are happy with.
