    • Lowell has recently bought over one of my old debts and in chasing me for payment have sent details of the debt to my ex-wife via email. Let me first start by saying i do owe the debt and I don't dispute it; whether it is unenforceable I don't know and this post/thread isn't to find that out. Lowell bought this debt earlier in the year for an account I ran between 2021 and this year before falling behind with payments and the debt eventually being sold off despite my attempts to deal with the original creditor. Lowell have sent me ONE letter in respect of the debt before reaching out via email to my ex-wife, giving information about the original creditor and the amount owed. I'm very concerned that Lowell have adopted this approach as I thought contacting a friend or relative about a debt was outlawed by FCA, but to find they have done this has left me shocked and a little embarrassed. I'm also concerned that they have potentially breached GDPR by sharing details with a third party without my consent. While there's little personal data given aside from the creditor and amount, I am mentioned by first initial and surname in the email sent to my ex-wife. I've never used this email account, have never had access to it and it has no connection to the original creditor so I have no idea why Lowell would use it to try to reach me. I've made a complaint to Lowell both about the communication being sent to a third party and potential GDPR breach, but should I be doing anything else?

    • Thank you again. I'm hoping it will come out in the wash and will endeavour to check my online account. I'm a bit unsettled by not hearing from Booking.com but the host is sounding helpful at the moment. HB
    • I've just remembered that a friend of mine had bookings cancelled on Booking.com about a month ago - and the good news is that all worked out in the wash. I'm at work now but will scribble properly in a couple of hours with the full tale.
    • Thank you Dave. I've had nothing from Booking.com, just a message via the site from the host. I know I need to check my bank account, just trying to resolve some technical issues. HB

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Last month i sold some sports equipment on ebay for £200. i have just gone to buy something only to find out that paypal have refunded the buyer his money. i have a tracking receipt and know it was delivered and signed for by him. Coincidentally on the same day that he put in a dispute saying he hadnt received his goods. hmmmm.

as my paypal account is old the email address on their in redundant so i didnt receive the emails saying what was happening so i couldnt give them the postage details. when i asked them about this they pretty much said tough u should of checked your emails (which is true i suppose).

however i am still £200 out of pocket and the buyer is sat on a full refund and has the goods ive posted. I have tried to contact him but to no reply. What has annoyed me the most is that the tracking times says it was delivered virtually the same time as he placed the dispute, almost to the minute which has got me suspicious.

if i dont hear back from the guy, do i have any recourse? would a court claim be worth it?

show ebay the delivery proof signiture?

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Wel..no doubt Paypal/Ebay did contact you and they cant really be blamed if youve havnt updated the email address, in fact that is rather foolish.

Ordinarily you would of been asked to provide poostage tracking ,etc and you may of been successful, It may be too late now.

Who would you make a court claim against, ?. It would appear Ebay/PP have done nothing wrong and complied with their T&C, its unclear how a claim against the buyer would work, after all..it was ebay/paypal that refunded him, although clearly there is some sort of fraud/crime, have you tried contacting the Police, no doubt they may not be interested, but it may be that he has done this a lot to others.

Unfortunately the eBay and PayPal terms of service are skewed significantly in favour of the buyer. You really have to be proactive about disputes and not being contactable makes this impossible.

I would forward a copy of the delivery receipt to eBay with a full explanation of the circumstances and hope that they reopen the dispute. I would mention that you need confirmation from the seller that the signature on the receipt is not theirs (or a member of their household) so that you can raise a dispute with the courier. It may also help if you let eBay know that the buyer has refused to cooperate.

Assuming you sent the package insured, which at £200 I would have hoped so, contacting the courier is a good idea as they may be able to get further with eBay.

Failing that I would report the buyer to the police and go through the process all over again with a crime reference number to hand. They police may not actually help, but the CRN provides some leverage.

It's also worth looking at the profile of the buyer to see if you can find anything to suggest this happened to other sellers.

would the fact that i have proof that the buyer has received the goods (address and a copy of his signature) and the dubious timings of the dispute not be enough for me to apply to the county courts against him for my money back?

I dunno..its a bit confusing..you sold goods and he paid for them, the confusion arises in that he then fraudulantly said he hadnt got them and ebay/refunded him using your money, it prob is possible but needs some clear thinking to get your head around and more importantly explain it clearly to a Judge. Thats why (as suggested) contacting the Police may be a good idea.

Did PP take money from your account or is it now minus £200 ?

hi andydd. paypal have put my account into minus 195.00 but it now means that i cannot use that account because it is now a minus balance. ive sent him several emails and so have paypal when i complained but so far he has failed to reply to any of them, so its obvious he has no intention of returning the money.

We had exactly the same and even though the buyer gave us positive feedback he put in a 'non received' dispute and PP refunded him. It became a massive hassle and we ended up dropping Ebay. (was £60)

Its well known that ebay/PP rareley/if ever pursue customers through the courts, (and it would appear you have a defence/counterclaim) you will though be pestered by DCA's and your account will be unusable, in theory you cant open a new account although it is possible in practise.

Just an update on this situation. i heard from the buyer finally last night. it appears that he assumed that paypal would close the case even though he didnt inform them he'd received the goods. he also says he put the dispute in 3 days before delivery, which i know is untrue. apparently he is going to return the refund friday. i have to say im sceptical that this will actually happen though. we will see.

yeah via email. he asked if i wanted my goods back (which were new but he's now used them) or my payment again. i asked for my money.

Am i right in thinking that now i have a personal email from him stating that he does owe me the money and he will return it that i have a stronger case should i need to take any action against him?

if no payment, have you tried speaking to Paypal customer services on the phone. Give them a call and if someone with an Irish accent answers you stand a chance of getting somewhere. You may ahve to try the court route but name Paypal as a co-defendant -but they may very well make a no fault payment to you and deal with your buyer some other way

hi, ive spoken to payapl as they phoned to try and get me to clear my negative balance. i told them that as far as i was concerned i didnt owe them a penny so would be making any payment.

so far still no payment but another email to say he will pay today (tues) as he has to put the money in his bank, so obviously he's spent it even though he knew it should have been returned. Im not banking on getting it back to be honest. ill give him this week and see where i stand.
