Hi all,

 

I had a payday loan with Payday UK last year. When I lost my job late last year I came to an arrangement with them to repay £250.00 back at a rate of £40.00 per month by standing order (this was the capital plus one months interest). I have had a very hectic year (new baby born in June) and to be honest, just forgot about the standing order leaving my account each month :| I (finally) realised that the money was still going out in August and cancelled the payment for September.. at this point I had paid back £400.00 in total. I contacted PDU and asked for a cheque to be issued for the overpayment and they contacted me back to say they only had a record that I had overpaid £40.00 not the £150.00 I have actually overpaid and they asked for my bank details to send the £40.00 back to me. I have not given them my bank details but instead sent them a list of all the payments I have made to date and repeated request for them to issue a cheque for balance... it's been two weeks now and despite chasing them, there has been no response.

 

What (if anything) can I do?

Bank chargeback? but if it is a standing order you set up and control'd really not sure there is much hope from a banks prospective, I may be wrong always worth trying firstly

Issue a letter of complaint by recorded delivery (if you haven't already) giving 7 days notice and stating you intend to bring a court claim as a last resort, although this will cost initally and before considering this option you may want to be doubly sure that you have the facts right over what was owed? surprising as this lender used to confirm repayment plans in writing with a table of the payments required

 

A cheque from a corporate company also can take 4 weeks and longer to process/receive - also worth bearing in mind

 

How have you been communicating with them up till now? did you get the plan in writing?

Hi,

 

Thanks for your reply, all correspondence with them has been via email so far but I have kept all of it in a folder so I have the original acceptance of the payment arrangement and all the back and forth emails regarding the overpayment etc. I also have copies of all my bank statements showing the payments going out and not being returned so can prove that the £400.00 has definately been received at their end.

 

Am I wrong in asking for the payment back via cheque due to the timeframe? I don't want to be awkward, just reluctant to give out my new bank details to a PDL company again :(

 

Will try with the bank first and see if they can help, if not, will send a formal complaint letter.
