Hi guys.

 

I am on IB but feel I am ready to start work again I have put in a new claim online for JSA does anyone know what will happen if I will still be paid IB till the JSA is sorted or will they stop my benefits till the JSA is ready?

Also I get housing benefit but don't want to put in a new claim till my JSA has been granted but do I need to tell council or wait till I am on JSA.

 

Of course I don't want to be left out of pocket but I understand I may loss some money in the waiting period, my housing benefit is the most important or I will not be able to pay my rent.

Hi I suffer with anxiety and panic attacks.

 

I was meant to go to a Atos assessment last week but on the way I had a massive panic attack and was taken ill so I was unable to attend two days later I got a bf223 form witch I filled out honestly and have sent back.

 

However if the DWP do not accept my reason for not attending can I appeal? And if I do what will happen to my IB.

A decision that you've failed to attend an Atos assessment without good cause is appealable but there's no employment and support allowance assessment rate or incapacity benefit payable pending the outcome of the appeal.

 

From the decision maker's guide, consideration of good cause includes;

 

'the claimant's state of health at the relevant time and

the nature of any disability the claimant has'

 

Should the decision maker not accept your initial response to the BF223, can you get any supporting evidence for the panic attack, for example, a statement from someone who was taking you to the assessment?

 

Returning to your initial query;

 

A new claim for jobseekers will automatically be rejected while you have a live claim for incapacity benefit. You would need to close your claim for incapacity and immediately (the next day) claim jobseekers. No gap between the claims means no waiting days and, apart from notifying a change of circs to your local authority, no glitch with housing benefit.

 

Alternatively, if the decision maker accepts good cause, unless your health's improved significantly there's no reason why you can't jobhunt while claiming incapacity benefit.
