    • Which Court have you received the claim from ? Northampton  Name of the Claimant ? Overdales solicitors  How many defendant's  joint or self ?  Self Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to.  13 may 2024 What is the claim for – the reason they have issued the claim? the claim is for the sum of £6163.61due by the defendant under an agreement regulated by the consumer credit act 1974 for hsbc uk bank plc. Account 4546384809766042. The defendant faild to maintain contractual payments required by the agreement and a default notice was served under s 87(1)  of the consumer credit act 1974 which as not been compiled with. The dbt was legally assigned to the Claimant on 23/08/23, notice on which as been given to the defendant.  The claim includes statutory interest under S.69 of the county courts act 1984 at a rate of 8% per annum from the date of assignment to the date of issue of these proceedings in the sum of £117.53 the Claimant claims the sum of £6281.14. Have you received prior notice of a claim being issued pursuant to paragraph 3 of the PAPDC (Pre Action Protocol) ?   Not to my knowledge. Have you changed your address since the time at which the debt referred to in the claim was allegedly incurred?  No Do you recall how you entered into the agreement...On line /In branch/By post ?  Online but it was for a smaller amount they kept on increasing this with me asking Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim.  It was assigned to a debt collection agency  Were you aware the account had been assigned – did you receive a Notice of Assignment? yes  Did you receive a Default Notice from the original creditor?  Yes I also made offers to pay original creditor a smaller amount but was not replied to Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ?  No Why did you cease payments? I was made redundant and got a less paid job I also spent some time on furlough during covid and spent some 3 months on ssp off work. What was the date of your last payment?  May 2021 Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes at the time I communicated with all my creditor's that I was running out of funds to pay the original agreements once my redundancy money ran out that was when my accounts defaulted. I then wrote to all my creditor's with pro rata offers of payments but debt collectors took over the accounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Omg lol are you me ?????? I check mine online several times a day it is an obsession but if like me you aren't loaded with spare cash u can account for every penny. Just read another thread on here where companies have set back up direct debits - will be extra vigilant as i only just thought of that possibility. I meant to ask how u know they do receive incoming emails x

haha this is uncanny that its so alike.

 

Its like an obsession for me also checking online banking but its cos i live virtually hand to mouth lately to try get myself back on my feet that i have to account for

and keep an eye on every penny.

 

Thats why i was able to flag this up immediately when my account went into a negative balance.

 

What i cant understand also with santander is that they let any payments go out.

 

I know that if i tried to use my debit card with no funds in my account there is no way it ever would let me yet these people were able to access it with no funds in.

 

Santander say your debit card allows you to go overdrawn. Mine never ever has.

 

In relation to the incoming emails they receive them because when they were writing to me last week this james patterson man in particular

 

(though all their emails come from [email protected]) was telling me how they would send the baliffs round and get an attachment to earnings order against me etc etc

 

i responded saying get your information correct as baliffs do not now operate in northern ireland nor have they done in years

and advised that he couldnt take an attachment of earnings order against me as this could only be done if judgement was made and i didnt keep to that.

 

They then replied to that email ccing it to richard howlett telling them to put forward for litigation.

 

Im furious with myself though cos as that point i just couldnt be bothered with the hassle and decided to call them and set up a direct debit.

 

They said this was fine and could i make a token payment i said yes i will make one for £1 they asked can we make it £1.42 i said thats fine just take this,

set the direct debit up and be done with it.

 

As far as i was concerned that was it that i would pay every month and all would be ok until this happened.

Dont kick urself over it lovely we were just a bit silly being victim of scare tactics ...

I phoned them and offered an initial payment of 10.00 they asked for 12.00 so thats what i paid, and as u set up direct debit for future payments.

 

As u said i would happily welcome them to take me to court in fact with all what they have been up to i hope they do :-)

 

i have offered repayment via a payment book or card so i can pay with cash and get receipts but something tells me they dont work like that.

 

I have had no response to the email yesterday but will post copy monday ...

 

. This has taught me a huge lesson i will never ever give my card details over the phone again !!

I have never had any reference to richard howlett made to me i only discovered his name whilst researching lasker and then spottin the connection - i dun think he is a nasty piece of work though i think he is a pen pushing bully would be interesting to see if he is even a legally qualified solicitor as stated x

I have seen different threads before talking about him and that he seems quite nasty by all accounts.

 

He is the head man as far as i can see in relation to payments etc from ccm and apparently people have said his job title is largely fabricated though how true that is i do not know.

 

I do know that there was a thread about ccm on money saving expert and someone was having trouble with him also.

I actually just read that thread he has had no luck and in fact he has been taken to court

although he doesnt seem to have had the same problems as us in fact he just asked for proof of debt and didnt agree any payment options.

 

It would be onteresting to see if they will take us to court with the chance of a counterclaim and criminal charges.

 

As i have said if i owe i will pay but in a way i can not by handing them full use of by bank account

 

- the other thing i wonder is if ccm are denying taking our money they clearly had no intention of taking it off the supposed debt

Lasker seem to have been dissolved as a company in 2010 - has anybody had any RECENT communication in the name of Lasker?

I have never had anything from Lasker at all.

 

I didnt even know they existed to be honest until the bank told me thats who had taken the payments.

 

It is now showing on my account as Lasker Collections.

Have you started chargeback proceedings? Your bank can chargeback first and investigate second. Dont let them tell you any different.

Been digging with DX

Lasker seem to have been dissolved as a company in 2010 - has anybody had any RECENT communication in the name of Lasker?

 

Lasker Limited has been dissolved on 17/08/2010, strangely enough ther is a website http://www.lasker.co.uk/ for a "private investigator" that calls itself Lasker Investigations and claims to be a division of Lasker Limited

Registered in England Company Number 04686395, which is the one that was dissolved in 2010.

 

The address given at the website is 30 Borough High Street, London, SE1 1XU

 

A quick search for that address reveals that it is the exact address where Microcredit Limited with trading names Minicashloans.Co.Uk and MiniCredit.co.uk are based, they are according to this source http://www.bbc.co.uk/news/mobile/business-17127951 the most complaied about PDL in 2011.

 

Last year MiniCredit issued more than 100,000 loans, however the Financial Ombudsman Service received more complaints about MiniCredit than any other payday lender in 2011.

 

The trade body, the Consumer Credit Trade Association (CCTA), of which MiniCredit is a member, has told the BBC they have also received complaints about the company.

 

The CCTA says it has warned MiniCredit that unless the company stuck to the OFT guidelines, it would risk getting in trouble with the regulator.

 

The debt advice charity National Debtline has also expressed concerns about the company.

 

There is also a Company called Lasker Collections Limited reg 07079294 that was dissolved 08/11/2011, that has however a different address given at companies house 47 CHANCERY LANE LONDON WC2A 1RH.

 

Strangely there is a current credit license number 0633170 for Lasker Collections Limited at the first address where the investigator and microcredit are, yet in the public register for credit licenses the company reg is 07079294, which would be the Lasker dissolved in 2011 from a different address.

So what do you assume that all the above means its actually hurting my brain now

 

its a bit hard to draw conclusions about Lasker as there isn't much official info due to them not officially existing.

Have you checked to see if he isnt skirting the thin line of the law by using tasker as a trading name or similar? Many very shady business owners do this from time to time. It's not illegal but it is hard to track down certain companies.

Just made a profile to say that this exact thing has happened to me.

 

"Lasker" or whoever the **** have taken £185 from my account over 8 payments.

 

I called Lasker today and was told that it was CCM who have taken this money,

 

I haven't been able to reach CCM but based on other people's replies,

it would seem that they are not going to admit liability or take any sort of responsibility.

 

I've quoted the FSA to the bank but the woman still said that the bank won't dispute the charge.

 

Bank is held with Barclays. I'm a DAS employee and will be discussing this with one of the solicitors tomorrow.

Please let us know what the solicitor says. I cant see how the bank can pay these people who have acted fraudulantly as the company who have taken it has said they havent therefore the bank is paying nobody who r authorised
