    • Hi everyone, I have an update on my case that I’d like to share with you all.  so after submitting 371 pages in my bundle, a witness statement and skeleton argument for my court case due to take place in Manchester on June 21st I got an email from my litigator stating that hmrc have pulled out and the case is now closed!    this is the body of the letter….. This letter, which is copied to the Appellant, pursuant to Rule 17 of the Tribunal Procedure (First-tier Tribunal) (Tax Chamber) Rules 2009, the Respondents gives notice to the Tribunal of their intention to not defend the above appeal.   The Respondents respectfully invite the Tribunal to allow the appeal and close its file. In lieu of the above the Respondents would respectfully ask the Tribunal to vacate the hearing scheduled for Friday 21 June 2024. We would accordingly invite the Tribunal to close its file. Obviously this is extremely good news which hasn’t sunk in that after 3 years of fighting it is over.    I do have a further fight on my hands in that the Group Action I had joined with Independent Tax that had been disbanded in November last year and I chose not to continue with them. They are trying to bill me over 5k for the work they did under that Group Action which is ludicrous bearing in mind the whole point in joining was that it would keep the cost to a minimum as it would be shared between us all. They had asked if I wanted to continue to have them represent me on an individual level which I declined, if I hadn’t, goodness knows what they would have been trying to charge me now.

Oh I am the British PM lets just leave early I have better things to do and as he is called out on disrespecting all those veterans that served our country for the freedoms we have today he gives a groveling apology to little to late. He knew about this event for a long time and also knew that this is probably the last D Day Commemoration due to the age of those Veterans who gave so much for there countries freedom. Even on the day of the D Day Commemoration he still could have changed his plans As PM and stayed but choose not to showing such DISRESPECT to those Veterans, those that lost there lives and Families for the Freedoms we have today Being a Veteran myself I have never known a PM to show such disrespect what the hell was he thinking SHAME ON YOU PM SUNAK

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right. Confirmation from NatWest this mornin that I def hav an account set up. Bingo!!

 

My original letter saying I would get my statements was from Ian Shepherd, Centre Manager from Coventry...should I address my prelim letter to him?!

Hi Em,

 

Time to send your LBA (letter before action) look in the templates section if you need any help in wording etc, although there are plenty of examples in the threads also.

Send that off (recorded of course) and wait another 14 days !!

 

Patience is required in large size for this game, but you WILL get you money back if you persevere !!

Thanks for that Steve. I was gettin myself all panicked for no reason lol.

 

I have written my LBA, and hav written a paragraph about how they owe me an extra £75 since the original letter, meanin they now owe me £371. excellent!

 

Off to PO now!!

I'm in a bit of a pickle. I never managed to get my LBA to the post office last Monday because I was in a bad car accident on the way. Rubbish!

 

I managed to get it sent recorded delivery last Thursday, which already meant I was behind schedule. However, this has not yet been received!

 

The 14 days given in my LBA finishes next Monday (18th Dec).

 

So what do I do?!

 

Write them another letter giving them an extra 14 days, or write to them telling them have 14 days from a back date?!

 

oh god Im so pickled!!

Hi Em,

"panic not . . . fair maiden" !!

 

If your LBA 14 day deadline finishes next Monday the next setp is to issue your MCOL (claim through the court) this will incur a cost to you, it varies dependent on the value of your claim up to a max of £120.

You add this sum to your total claim (so u get it back) you also need to calculate and add interest at the rate of 8%

There is lots of help in teh FAQ and Library sections in here and there is a excel spreadsheet that will help with the calculations

 

If you get stuck, come back and we'll see if we can help (someone will)

I actually drove into a skip that had no lights on it (it was dark lol) so this isnt my only claim atm!! lol. Im just bruised and whiplashed! :rolleyes:

Umm, sorry, I thought you had issued your LBA, no don't issue the MCOL yet, there is a risk the court could argue you have not acted reasonibly, you need to issue your LBA this and give 14 days . . .

 

Sorry, you have it seems lost a few days, but no matter you'll soon be back on track !!

I would say you need to send again recorded delivery obviously !!! as far as the 14 days . . . it looks like you may have to start the clock again - which is a pity !!

looks like its jus me and u steve lol.

 

i will resend it and re-give the 14 days (but explain to them that I have done so so they think im being nice lol)

 

after all, I could do withthe 14 days ending after xmas anyway, with the mcol being £100 or so!!!

Letter was finally received by HSBC yesterday. so roll on 4th Jan!!

 

hope I dont have to exclude bank holidays from my 2 weeks!!

It's all there, I have actually concluded my claim, literally this week :D

 

Had a letter on Mon offering a full settlement, accepted and money in the bank (not HSBC) yesterday !!! - Yippee

 

I may actually enjoy xmas this year !!!

 

As far as BH's I know the courts close for public hols, I think you may have to, or it could be argued that your being unreasonible (if it ever got to court) !!!

HSBC do take a long time to reply unfortunately, so it's just a case of waiting.

I think matters are made worse because it's unfortunately (depending on your point of view) Xmas - hols, staff away etc

God, I'm confused. I think HSBC are trying to pull some delaying tactics with me....

 

Received the following in the post this morning from a different person that I received my original letter from!:

 

"Dear Sexy_Em

 

Thank you for your letter dated 16th November 2006 concerning your request for a refund of bank charges. I apologise for not yet having fully completed my investigation.

 

I will contact you again by 15th January 2007 and expect to be able to provide you with a full response at that time.

 

In the meantime, I would like to thank you for your patience and enclose a copy of our leaflet which explains how these matters are dealt with. If you need to contact us, please quote the above reference number.

Now my prelim was sent 16th Nov, received on 20th, and so this reply should have come thru before 4th Dec - but is dated 27th dec.

 

LBA sent of 4th Nov, but never received and so re sent on 15th dec and received on 22nd. These were both sent to Ian Shepherd - who sent me the original letter with my statements.

 

should I send this colin bloke a letter explaining that I have already sent 2 letters, and that I require a response by 4th Jan? (well, 7th Jan allowing 3 days for BH's?!)

I think yes. the more people I can get involved, investigating, and annoyed (lol) the better.
