its a new tactic by them

and the FOS/FSA dont actually state that you must provide such evidence

as you've time on your hands

i'd write back and ask them where in the FOS or FSA ruling or guidelines for PPI reclaims does it state that the claimant must provide

proof the debt was paid off?

lets see what they say.

it a stalling tactic for sure & one i think is rather OTT

as i know they are using it to buff off claimants that are trying to reclaim.

pers i dont think they have a leg to stand on

it would be interesting what the FOS saysabout this too.

worth a quick phonecall too?

no other bank has that i have ever seen asked for this other than HFC

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

hi DX,

just got off the phone with the FOS.

they advised me that i should provide as much information as i can and am asked for.

However the onus for supplying records is generally with the business.

If i am unable to provide the info and the claim is rejected on this basis and i were to complain to the fos then they

may view this as an unfair reason.

So essentially i should give them whatever they ask for (if i can ) and see what hfc come back with.

Looks like i'll be going through old records this weekend.

Thanks for the quick reply on this.

it really annoys me that HFC made £1M's out of fleecing 100'000's of customers

out of compulsory PPI and insurances

yet the FOS time and time again

let them GET AWAY with blue murder!!

they are VERY VERY fed up with them.

they were told and FINED £1.8M a few years back for nis-selling

they need to be FINED again for CONTINUALLY frastrating & being OBSTRUCTIVE to claimants of PPI mis-sale.

  • 4 weeks later...

Wow,

just got a letter from HFC that they are upholding the complaint and repaying the full amount that i claimed for.

This is the claim from a loan from 2002.

As it turned out, I couldn't find any statements with what they wanted on it so i guess it wasn't that important.

Partner has said that there is a donation on the way as soon as the payment is in her account

and would like to thank everyone, and especially DX100UK, for their invaluable help and advice.

Got fingers crossed now that it will be this simple for all the other reclaims.

Many thanks to all.

it would be useful

as things are going on behind the scenes with HFC

for the letters to be scanned up

and the calcs if they give them

good evening DX,

they're basically giving back all payments that were made along with 8% interest on each payment.

the total amount is about £10 shy of the figure which the statins spreadsheet gave us.

Is what is happening behind the scenes likely to negatively or positively impact future hfc claims?

got to admit you've got me intrigued now.

Well if whats going on at HFC is true then why such secrecy dx :?:

I thought that was the idea of these forums to exploit these companies for what they really are, surely they cannot sue you if what you know is correct and in the public interest:???:
