  1. no rollover on this one. it was a relatively small standalone one have added it in though, on other claim where appropriate.
  2. good evening DX, they're basically giving back all payments that were made along with 8% interest on each payment. the total amount is about £10 shy of the figure which the statins spreadsheet gave us. Is what is happening behind the scenes likely to negatively or positively impact future hfc claims? got to admit you've got me intrigued now.
  3. Wow, just got a letter from HFC that they are upholding the complaint and repaying the full amount that i claimed for. This is the claim from a loan from 2002. As it turned out, I couldn't find any statements with what they wanted on it so i guess it wasn't that important. Partner has said that there is a donation on the way as soon as the payment is in her account and would like to thank everyone, and especially DX100UK, for their invaluable help and advice. Got fingers crossed now that it will be this simple for all the other reclaims. Many thanks to all.
  4. the person i spoke to at fos did give an inadvertant sigh when i said it was hfc. i imagine that they are getting sick of hearing about them.
  5. hi DX, just got off the phone with the FOS. they advised me that i should provide as much information as i can and am asked for. However the onus for supplying records is generally with the business. If i am unable to provide the info and the claim is rejected on this basis and i were to complain to the fos then they may view this as an unfair reason. So essentially i should give them whatever they ask for (if i can ) and see what hfc come back with. Looks like i'll be going through old records this weekend. Thanks for the quick reply on this.
  6. evening all, i've received a letter from hfc today regarding the earliest claim we've made for a loan dating from 2002. although i provided them with a copy of the agreement they say that they need copies of bank statements showing that the payments were made to them. should i send them edited copies or is there a standard answer i should give them?
  7. thats a good one. i'm still waiting for the sar, when i get it and am able to make a reclaim should i write them something similar and give them a chance to correct their error or, as they say, take it directly to fos, even though they haven't actually received a complaint from me? also if they continue to show their incompetence would this stand me in good stead if i were to take it through the courts rather than fos?

  10. hi all. an update on the above. have sent the failure to comply and haven't heard anything yet. Still waiting for the SAR but they are still within the time limit. Also sent a letter cancelling the ppi. Meanwhile my partner received her monthly statement and called them to query why her payment has gone up whilst the balance is going down. to which they replied that there was a problem with the way her interest was calculated and they would investigate and write to her. whilst on the phone she also queried whether the ppi had been cancelled as per her letter, the person replied that they would do that and asked if she was making a claim to which my partner said "it's already in hand" or words to that effect. but did not say categorically that she was. today she received a lengthy letter saying that marbles would not be upholding her complaint ( she hasn't complained about a refund yet - we're still waiting for a sar) because although it was so long ago they don't have a copy of her online application and agreement, they know that she (apparently) asked for the cover and when sent the agreement she didn't change the ppi option to "no" in the ppi section therefore she did ask for it. they go on to say that the policy is still in force on the account and do not understand why they haven't been contacted sooner to have it cancelled. ( yes they have ) they then end the letter with this is our final response and if not happy please take it to FOS. seems a bit pre-emptive to me- refusing reclaims before an actual complaint is made. where would this leave us when we do make a complaint?
  11. haven't sent the failure to comply letter yet, wanted to check advice. she wants to pay back what she owes on the card, however i believe that the ppi reclaim will clear a significant amount, if not all of it. won't know for sure tho until the sar arrives. when working this one out i use the cisheet don't i? not the statint.
  12. yep thats the one. do i follow up the failed cca request with anything or just leave it as they haven't got it? where would that leave the ppi reclaim if they were to say that she requested it but can't prove it without the agreement. she's adamant that she never asked for it and only realised that she didn't have to have it when we looked into a hfc reclaim.

  16. hi all, whilst claiming ppi back for my partner from hfc, we have found she has been paying a large amount per month in ppi on her marbles card. As she is quite vague on the details of this account we cca'd and sar'd them. still waiting for the sar., but the cca came back with a print out of just terms and conditions and a signed statement of account. they state in the letter that the original signed agreement has been requested from the relevant dept. and will follow shortly. they are now past the time limit so should i wait or is there anything i should do regarding this. need all the info on this account as i can get, which is why i sent these requests, as i think it could amount to a substantial reclaim. regards, ps. the account has been running for at least 6 years and is no longer being used. just monthly payments to clear the amount owed.
  17. thanks, just a few more questions - do i need to complete a fos questionnaire for each individual claim ( where there isn't any rollover)? for the 2002 loan, i didn't get any info in the sar regarding it so am i okay to claim for each payment that is listed on the agreement and continue that forward for the duration of the loan? ( although with a five year term that should have taken it to 2007 so shouldn't there have been something in the sar?). when i send it all off can it all go in the one package? I think thats it for the moment, although every now and then a different question occurs to me. regards,

  19. Hi dx100uk. Am going through it now and will probably have a few more questions but for the moment i'm looking at the transaction history for what was a card issued by household bank and was wondering if you could advise on something i've found. the ppi, monthly payment and finance charges are being taken by direct debit every month for the first 9 months and then on month 10 and every month onwards there are 2 Billed Finance Charges and 2 ppi payments of differing amounts, all on the same date. billed finance charges are transaction code 150 and ppi is code 102. Would there be 2 separate charges each month because my partner has some balance transfer cheques listed as debits i.e. charges for cheques used and charges for normal purchases. if this is something you haven't seen before would you advise querying this in writing or by phone to resolve quickly? many thanks

  21. well i've got the reply to the sar and hfc are requesting proof of i.d. as my partner is now at a new address, this shouldn't be a problem. However they state in their letter that information older than 6 years may not be in existence anymore, does this mean that the ppi i referred to in post 6 will not be able to be claimed back as she only has the agreements - not any proof that the repayments were made or for how long until the loan was repaid? Also when we send the proof of i.d. should we send the original sar request or should we amend it to include anything new? many thanks.
  22. the payments that she arranged have been made every month since they invoiced her for the work that needed to be done after they collected the car. all payments were up to date and showed as 0 owing the month that the agreement ended. then the month later and continuing onwards payments have showed as reducing the outstanding amount, although marked as 1 month late on her cra. i assume that this is because it it took a month for them to get the vehicle status costed and invoiced and then contact her regarding this. then after 6 monthly payments the outstanding balance on the credit record (cra) shows as £565 having decreased accordingly month 7 then goes to £494 as it should have then on month 7 is flagged as a default and the balance goes up to £565 again before dropping to £353 on month 8. all entries from month 7 are marked as default. there is also an unknown item on the status report and invoice. all typed except for "abort " and a date which is handwritten along with £225. the total is crossed out and a new total with the 225 added on is handwritten also. the only thing i can think of is that they are charging her for an attempted collection when she wasn't there however when they picked the car up was the first time she had arranged for them to. also the collection sheet was signed by her mother as my partner was at work at the time.

Hi, hoping someone can help with this. i've been going through partners finances to claim back ppi and when she checked her credit file found that she has a default marked on her file for the last 3 months. when the end of her hp agreement for her car came up after three years she chose to return the vehicle and pay no more. however after it was inspected she was charged for several faults and immediate payment requested. she made an arrangement over the phone to make monthly payments with the finance company to repay the debt over a year. it now looks like after making these payments for 6 mths they have defaulted her. she has continued making the payments unaware of this as she has not received any sort of warning about a default. when she contacted the company to find out what was going on and was moved from dept. to dept. until she spoke to someone from the litigation dept. and was told that they normally default someone after 6 months if debt not cleared. at no point was she informed of this when the payment arrangement was made. they're attitude seems to be only 2 payments left so why is she getting upset about it? it is the only bad thing on her cra and has already started to cause problems with getting credit. however they just wanted her to write a letter if she's that upset about it. is there any way this can be removed, as i understand it she has to have had notice of the default and the chance to remedy it, however when she contacted them to make the arrangement they seemed happy with it. and she has never had a notice of default. should i sar them to get information first or complain first or do both together. or can anyone else offer any other advice. many thanks
  24. yep, a marbles card, not linked to the loans. have also found several loans from clydesdale but will tackle them once i'm well underway with hfc.
