    • Under the consumer rights act 2015, if a defect manifests itself within 30 days and you have a right to return the vehicle for a full refund. If any defect manifests itself within the first six months of ownership then you have a right to return the vehicle for a full refund subject to the retailers right to carry out a repair. If the retailer declines to repair or if the repair fails then you have the right to return. The problem here is that you have to assert their right. It's a bit ridiculous – but you have to do let them know preferably in writing that you are asserting your rights under the consumer rights act either the 30 day right or the six month right. I suppose that you haven't done this – which would be quite understandable because most people don't know that these rights exist and that they are subject to these conditions – the condition that the right must be inserted. It is frankly ridiculous. The dealers know it and we have lots of instances of this company delaying appointments et cetera and our strong suspicion is that they are simply trying to run their customers out of time. On the basis that you haven't asserted your rights, we now have to look to ordinary contract law. You are entitled to purchase a vehicle which is of satisfactory condition and which remains that way for a reasonable period of time. Clearly it is in satisfactory. They are blaming you. Has your independent inspection identified the reason for the defect? This will be important because as you have seen BMW are already saying it is down to your driving and you are going to have to produce evidence that it wasn't down to your driving and the you drove it absolutely reasonably and it was simply the condition of the car. Have you been without the car for any period of time. Is it driveable now? If the car was off the road for a substantial amount of time and was still off the road then you would be able to argue that this is a fundamental breach of contract and that you have been deprived of substantially the whole benefit of the contract and therefore you will be entitled to treat the contract as breached by Big Motoring World and insist on cancelling the contract. It may be that you will eventually be obliged to keep the car but have the repairs paid for. Have you had any quotations for the work that needs doing? I asked you questions about the MOT – but you haven't responded.

    • According to Parkopedia parking is limited to two hours.  I don't know how accurate this is though. What were you doing there for four hours?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

LOL i know i'm soooo excited but still mindfull of the fact that my shedule and lba got a little cocked up so if they dont push too hard i could accept a 170 off my claim but at the mo im head strong on fighting all the way for my interest as thats a lot of money for me on its own, I wont book the flights to america yet....

i filed with mcol on 23rd sept, was acknowledged on 25th &they submitted their intention to defend on the same day.

 

got a letter from DG asking for breakdown on 5th oct and sent it back late last week. got another letter from DG this morning saying "we look forward to hearing from you in response to our letter of 5th october" so they must have crossed in the post (but will ring to double check today!)

 

i am looking forward to their response to this matter far more than they look forward to mine, i am sure lol.

 

so should have my offer through shortly :D

 

my husband is from minnesota so we are gonna go there for 2 weeks and stay with his family then go straight to disney and fly home from there. cant wait!!!

PLEASE PLEASE help i'm really scared now cause ive cocked my spreadsheet up and the amount at the end when i looked at it just before filing my MCOL was different somehow to the amount on my LBA. I dont know if one of the kids has messed about with it? so when i filed the MCOL i did it for the amount on the lba but now i've got to redo the spreadsheet and hope it all adds up:sad: If for some reason I'm not getting the same amounts is this likely to rubbish my whole claim??

 

 

MINE WAS THE SAME ITS SOMETHING TO DO WITH THE NUMBER OF DAYS WHEN CALCULATING. ITS MORE DAYS SINCE I FILLED OUT THE MCOL FORM THAN THE SPREADSHEET WHICH IVE JUST DONE SO I WENT BACK TO THE CLAIM FORM AND CHANGED THE AMOUNTS TO MATCH THE SPREADSHEET MINE HAS JUST GONE OFF SO FINGERS CROSSED I MAY GET A NICE LITTLE PAYOUT FROM THE HALIFAX

Hi, I had a friend who did the same and it didnt seem to matter and got a full refund through MCOL. I also have a friend who asked for 12% interest back and got it! I recon ever bank is different. Dont worry to much. :)

got another offer letter today i have written the rejection letter back but had to amend it as i have already issued MCOL. Can someone have a look over and just comment please. Also I was going to send back to colin langdale and also email do deborah at DG solicitors as obviously theres no correspondence and neither knows what the other is doing (service quality didnt know that it had gone to court so presumably DG dont know that colins made an offer) might kick start DG into action anyway. Wanna get down post office before 5 so any comments really appreciated!

Thank you for your letters dated 12th & 17th October 2006

I respectfully decline your offer of settlement totalling £2450 and request, once again, that you return to me all charges and costs imposed on this account.

 

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim.

 

My letter before action sent previously indicated that you had until 4/10/2006 to respond before Court action commences. i have now filed court action

on against you and there are now court charges and s69 interest to pay. Total today is £4233.98 which includes interest daily of £.90p since the claim was issued on 4/10/2006.

 

I trust this clarifies my position.

I would ignore any correspondence with HSBC now and just deal with D G until they instruct the bank a conclusion has been reached and it is time to pay out. There is still a timetable the courts have and they have to respond to the full claim to the courts anyway. Maybe wrong but Im sure someone will point it out to me if I am.

You have to communicate with the defendant to try and resolve the issue, so the letter was totally relevant. The court is the 3rd party IMO that would decide who is right should it get as far as your court date.

 

A court may see it that you are indeed ignoring the HSBC's attempts to negoitiate!

thanks for the replies. I sent it to colin Langdale. Figured i couldn't really go wrong with that as he was the one who sent it. I also emailed it to dg including the statement i have copied to yourself and colin Langdale as it is unclear as to who is dealing with this claim. just hope it gives one of them a kick up the backside!!!

I still wouldn't ignore the HSBC, IMHO - just to be on the safe side. I may be missing the point but you are suing the HSBC and they pay DG wages. In the unlikely event this should reach court I would hate for HSBC to claim you ignored them.

 

It could be the standard as far as I know, but it concerns me to hear a solicitor saying 'Ignore our employers'

Thanks i really pray its not relevant! lol i had my acknowledgement on 9th october so Presumably they have till 6th nov to send me an allocation questionaire? is this right. Also I am so nervous as most people have had some sort of letter from DG by now whats wrong with me???

stop all this worrying - it can't be healthy - even tho it is normal!

i bet less than half received anything before the acknowledgment. just to clarify something for you - the court sends you stuff and dg sends you stuff. the next thing you will get will probably be a request from dg asking for a breakdown of charges and that came about 2 weeks after my acknowledgment. i think you will hear from dg shortly. the aq will come from the court along with a change to your local court and a copy of the bank's defence and this will be after the bank decides to defend, which they probably won't do until the last minute of the 28 days they have after the acknow. if, by chance, they don't defend, you can press the judgment button 28 days after they were served - that date is on your correspondence from the court. then, you win anyway - so......just keep updating and be a little patient.

Ditto, there's nothing wrong with you - I was exactly the same!(and still can be) think of it this way hun:

 

* YOU are in control - it is you who is sorting them, not the other way around.

 

* Any carp they come out with, post it here and someone will translate the childish text into what it basically boils down to.

 

* Visualise the victory that is coming your way ( and imagine how you'll feel next time you get charged!!) errr if you do!

 

* Try to imagine how much more worried your bank is than you, and thoroughly ignore thier tactics - THEY'RE DESPERATE AND ON THE ROPES!!!

ok, did you fax the breakdown to hsbc or to dg. as long as you already know they intend to defend - you should now be dealing with dg solicitors. so if you faxed them to the bank, you should probably now fax them to dg. and if you faxed them to dg, wait another couple of days and if you want to do something - call dg "just to check they received your fax". can't hurt, might help - it's a bit like a "bump" on here - just brings you to the top of the pile. good luck - you are nearly there!
