      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

after nearly 20 years of smoking the time has come to give it up-7 days now:|

 

not had too many effects eating to make up for no smoking,moods kicked in so decided to get a electric cigarette but put off by the cost,not knowing if they are good or not.

 

brought a disposable one from supermarket cant say i enjoy it too much but seems ok so will do the jump to a refillable one.

 

have anyone of you good people used these electric fags do they work on the long term?

 

have the will power as have to give up due to heath issues :sad:

 

which ones if any are any good

Yeah, true,the best thing to do anything what you want is will power. I remember the day when my grandpa was having habit of smoking and it was almost impossible for him to leave smoking, my family and he him self tried to leave but failed, don't know how but one day he just thought and quit it on the spot. Amazing that day!!

smoking stinks costs a fortune and now food tastes lovely,just had to put a few obstacles in the way

 

it has been relatively easy despite the nagging by the old woman:razz:

 

have been using a electric cigarette brought from supermarket they do a disposable one to try first and now have refillable one

 

they take a bit of getting use to,i don't use it much till the evening

 

have managed a month or so now not counting the days at all now and chest feeling so much better :whoo:

 

best thing i have done in the past few years and much richer as was spending around £200 per month:doh:

 

best of luck with it ,it`s easy just keep putting barriers up family,money,smell whatever works

I found personally weening off of a fine balance between nicroteete gum (the lowest dose, 2mg) and pure chew-power got me out of it. The NHS thankfully helped me with a niquitin spray that was in one sense great, in another sense, a whole different barrel of fish.

 

 

The sum was great for keeping the urge away (and using regular wrigley, my favourite, spearmint) kept me spacing doses. I used a Niquitin Mist spray (many thanks to the NHS for helping with that), that was the initial 2 weeks I needed help with.

 

 

From being a stopped smoker (3 months on 4 Oct! 2012) I have is:

 

1) Chew as much gum as you can

2) Look at 1 NOT the nicotine gums, but space em more and more with other gums... I gets addictive so get a piece of paper in your pocket to throw the gum away

 

If things get REAL bad

 

4) Use the mist spray from NiQuitin to avoid needing a fag at that bad moment. 2 small puffs = 1 ballsy cigarette :)

 

I found I got the hiccups which made my mates laugh at gym so hey, all the better

 

I got a full help thing through the NHS, they subside the cost of the horrid alternatives BUT they aren't there as a 'CUT DOWN' service.

 

I had 2 people, talk to me, initially a nice guy form London somewhere and then a girl younger than me who had the drive to show me (weirdly she's never smoked)

 

IN short, ask the NHS, they have qualified people (even the non smoker as she knew the ins and outs of t6he various devices & NRT's)

i`m still off them:whoo: have been using the E cig £45.00 for the kit in supermarket both batteries gave up have another kit another £45.00 one battery gave up yesterday

 

all together cost me £90.00 for around 3 months smoke free:sad: having said that cheaper than a packet a day

am possibly getting hooked on the E cig wont be long till it stops working!

will give nhs a ring just in case

i hate the smell of smoking, cant stand it even in the street

nothing worse than a x smoker :razz:

The e-cig kits in supermarkets are overpriced and far from the best. There are some great specialist retailers who can give great advice before you part with any cash. There are some great e-cig forums with lists of good suppliers and discount codes. If anyone wants to try the e-cig route I'd honestly suggest they find those forums first.

i am still off them

 

the e cig seams to do the trick but avoid the ones from the supermarket as advised above there is better around, i made that mistake and brought two kits as they give up:mad2:

 

keep finding reasons for how bad it is the smell, cost whatever works

early days for me but feel much better and food tastes so good now!!

I'm using an e-cigarette, now into my third month. What I'd like to say is this: although all smokers know the benefits of not smoking, it's only when you stop that you actually do experience these benefits. I have never felt better - no more coughing/sore throat in the mornings/no smell/teeth and mouth so much cleaner. I would never go back to smoking tobacco. I've alway had good senses of smell and taste - so can't comment on these being improved.

 

Next step is cutting down on the time I use the e-cig...............which I will eventually - but I'm not putting a timescale on anything - I will wean myself off the nicotine addiction - but in the meantime I'm well pleased with myself.

I found the very action of 'smoking' was the thing I needed to keep for longest so weaned myself off nicotine first by gradually reducing the strength of juice I vaped. I also found I moved away from tobacco flavoured liquid very quickly so it was less and less like smoking but still kept the hand to mouth habit. I did vape almost continually at the start but having given up the tobacco taste and cut out the nicotine I could continue to enjoy the 'vape' without feeling guilty. Usage does tail off of its own accord, at least it did with me.

Hi all

I have gone cold turkey, i had, had enough of smoking.I felt like my lungs were 3/4 full & was noticing i was starting to get out of breath doing very easy things, this scared me as i was a good sportsman in my younger days. It just stopped, i can`t explain it myself, given up a few times but i had a nagging thought about my health in years to come & tired of being a slave to cigs. One thing that helped me .... i saw a picture of a guy with cancer & it was very graphic , every time i got a graving , the picture came to mind & it really did help. I did`t go down the e-gig route as i still think of it as smoking & i knew i had to stop the habit completely or i would be just kidding myself. Good luck to you all, it really is a nice feeling when someone recently offered me a cigarette & you can say " no thanks, i don`t smoke" with conviction.

still off the fags miss it at times in a funny way but wont go back like my food tasting good and money in my pocket:-)
