    • Morning dx and thank you for your message.   With regards to your comment about them not needing to produce the deed, the additional directions ordered by the judge included 'a copy of any assignment o the debt or agreement relied upon'  so that is why I thought that point was relevant?
    • Sorry for the long post but I don't want to miss out any relevant information: My wife bought a car from Trade Centre UK and have been having nothing but trouble with it. Unfortunately we paid of the finance used to buy the car as we weren't expecting this much trouble with the car as we we though we would have protection as buying from a dealer. We are wondering if we can still reject the vehicle since the finance plan has been paid off. Timeline is as follows: 13/12/2023 -15/12/2023 Bought car from Trade Centre UK for £10548 £2000 deposit paid on credit card on 13/12/2023 £8548 on finance from Moneybarn (arranged through Trade Centre UK). picked up car on 15/12/2023 Also bought lifetime warranty for £50/month 25/12/2023 Engine Management Light comes on. The AA called out and diagnosed the following error codes: P0133 - Lambda sensor (bank 1, sensor 1) Oxygen Sensor. Error Message : Slow reaction. Error sporadic P0135 - Lambda sensor heat. circ.(bank1,sensor1) Oxygen Sensor. Error Message : Component defective Due to it being Christmas took a few days to get through to them but they booked me in for 28/12/2023 to run their own diagnostics. 28/12/2023 Took car in to Trade Centre so could check the car – They agreed it was the Oxygen Sensor and Booked me in for repair on 30/01/2024. I was told they had no earlier slots, and I would be fine to carry on driving car when I said I was afraid of problem worse. During diagnosing the problem, they reset the Engine Management Light. During drive home light comes back on. 29/12/2023 - 29/01/2024 I carry on driving the car but closer to the date, engine goes to reduced power every now and again – not being a mechanic I presumed that this was due to above fault. 20/01/2024 Not expecting any more problems paid off the finance on the car using personal loan from bank with lower interest rate. 30/01/2024 Trade Centre replace to O2 sensor (They also take it on a roughly 60mile road trip which seems a bit excessive to me – I can’t prove this as something prompted me take a picture of milage when I handed car in but I forgot take one on collection – only remembered next day.) 06/02/2024 Engine goes in reduced power mode again and engine management light comes on – Thinking the Trade centre’s 28 day warranty period was over I booked the car the into local garage for the next day to get problem fixed under the lifetime warranty package. Fault seems to clear after engine was switched off. 07/02/2024 In the Morning, I take it to local garage who say as the light gone off – the warranty company is unlikely to cover the cost of the repair or diagnostics and recommend I contact them when the light comes back on. In the evening the light comes back on and luckily I manage to get it back to the garage just before it shuts for the day. 08/02/2024 The Garage sends me a diagnostics video showing a lot error codes been picked up by their diagnostics machine including codes for Oxygen sensor and Nox Sensors, Accelerator pedal and several more. Video also shows EGR Hose not connected to the intake manifold properly, they believed this was confusing the onboard system as it is unlikely this many sensors would trigger at same the time but they couldn’t be certain until they repaired the hose. 13/02/2024 Finally get the car back as it took a while to get approval and payment for the repairs from the Warranty company. Garage told me to keep an eye the car as errors had cleared with the hose but couldn’t 100% certain that’s what caused the problem. 06/03/2024 Engine management light comes on again. Fed up I go into Trade Centre as I was just around the corner when it happened and asked them how to reject the car or have the problem fixed. They insist that as it’s over 28 days I need to get the car fixed under the warranty package I purchased and they could no longer fix the car as it was over 28 days. When I tried telling them it appeared to be the same or related problem they said they couldn’t help as I hadn’t contacted them earlier. I asked them if they were willing to connect the car to the diagnostics machine and tell me what the problem was, as a goodwill gesture, which he agreed to do and took the car to the back He came back around 30 minutes later and said they took a look at the sensor they replaced previously and there was nothing wrong with it and engine management light went off when they removed the sensor to check it. When I asked what the error code he couldn’t give me an exact fault but the said it one of the problems I told him earlier (Accelerator pedal). I have this visit audio recorded on my phone – I informed the reps I was recording several times. As the light wasn’t on, local garage couldn’t book me for a repair under warranty. 07/03/2024 Light came on so managed to book back into local garage for the 12/03/2024 Whilst waiting to take car into garage, I borrowed a OBD sensor and scanned for errors on the car. This showed the following errors: P11BE – Manufacturer specific code (Google showed this to be NOX sensor) P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow 12/03/2024 Took car to local garage and the confirmed the above errors. This leads me to believe that either Trade Centre UK reps lied and just reset the light or just didn’t check properly (Obviously I am unable to prove this) 22/03/2024 Finally got the car back as according to garage, the warranty company took a long to time to pay for the repairs 28/04/2024 Engine management Light has come back on. Using the borrowed OBD scanner I am getting the following codes: P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow P2138 - Accelerator Position Sensors (G79) / (G185): Implausible Correlation I have not yet booked into a garage as I wanted to see what my rights are in terms of rejecting the car as to me the faults seem related. I can’t keep using taxi or train to get to work every time the car goes into the garage as it is getting very expensive. Am I right in thinking that they have used up their chance to repair when they conducted the repair end of January or when they refused to repair it in February ? If I am still able to reject the vehicle could you point to any sample letters or emails I can use. Thankyou for your advice on my next steps.
    • Ok noted about the screenshot uploads. In terms of screwing up I had one previous ticket that defaulted and ended up in a CCJ from Southend airport because for some reason during COVID I didn't receive their claim form just a notice of default. This hospital ticket was the 2nd ticket that went to CCJ due to a lack of knowledge of the process. Maybe it's easier just to pay them in future I'm thinking though, I don't get them very often anyway

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am trying to track down a pension for a relative. They worked in the motor industry. I know the pension was run by MAA Pensions Ltd based in Leighton Buzzard. They seem to have become Motor Industry Pensions Ltd based at the same address, but a letter was returned addressee unknown and the telephone number is never answered.

 

I can find Motor Industry Pensions Plan Trustees Ltd, but this seems to be a private limited company.

 

Any information gratefully received.

Thank you for that. My relative seems to recall contacting them some years back and reaching a dead end. I might try again. I'm hoping that there are other people out there who also worked for the motor industry back in the late eighties and were in the same scheme. Keeping my fingers crossed for them that the fund has been taken over by another company and that the money paid in is not 'lost.'

Hello Sali did you manage to find out anything about the MOTOR INDUSTRY PENSION LIMITED group.

I am also trying to find out for my dad he also had his pension with them from 1982 to 1995.

 

I have contacted almost all the people who deal with lost pensions and had no luck. A

 

s you say the numbers etc are all not recognised and companies house show that they have dissolved in 1998.

If you have any info on there services could you please let me know if not i will keep looking thank you for any help.

Thanks i have tried the pension tracing service they only got records of the motor industry pensions plan. They have about 60 companies on there list but non of them are where he used to work.

I only ask because my OH has some dealings with pension matters and says that often he's told that a scheme has disappeared and finds it in a few minutes on the interweb.

I had an MAA Pension Plan from 1980 to 1985.

 

I put this out of my mind until September 1996 when I contacted the MAA Pension Admistrators who were based at 10 Church Street Leighton Buzzard.

 

They then confirmed by letter that they had my details and indicated that the administration of the pension scheme was being handled by one of the large insurance companies.

Foolishly I have misplaced this letter and spent the whole of last week end looking for it.

 

Prior to being at 10 Church Street they were at 17 Market Square Leighton Buzzard.

The registered number was 1281183.

Manging Director: P.A.E.Herring Directors: K Dowson, J.R.Boast, B.W.H.Nurse , J.D.W. Gwent and the Company Secretary was N.B. Lowry.

 

I'll keep looking and let you know if I find out anything,

Sorry, I haven't been back here in a while.

I knew there would be others out there in a similar position to my relative.

 

Back in September I did alot of googling and did find people who were directors of MAA and now are directors of other funds and companies.

I didn't contact them, as I just thought it would be a waste of time.

I also wrote to the pension tracing service again, but they could not help.

 

It does seem so wrong.

Successive governments have encouraged everyone to pay into pensions, but certainly there seems to be very little help for those who have lost money in various schemes.

 

Even recently was it Equitable or Standard Life that failed its contributors?

By the time the politicians got round to doing anything about it, people had died waiting or suffered extreme hardship...and even then they did not get fully recompensed.

 

Maybe this is a question for Radio 4's Moneybox.

This is turning into a bit of a saga and I feel the need to rant.

 

As I previously said the Pension Tracing Service contacted twice could not help on this matter. However, during a trawl of the web I stumbled across the Pension Protection Fund which listed the company I was looking for having transferred to them in 2010.

 

Would it be too much to ask for the Pension Tracing Service to look at this site or at least let people know of its existence if their enquiry draws a blank. They are all in the same business - pensions - after all.

 

Anyway, PPF Darlington after being provided with all the details - name of company, name of pension scheme, dob, ni number - were unable to help. Their response was puzzling as the company was listed on their own website. PPF Darlington suggested I contact PPF Croydon, their stakeholder team. They sent the exact same letter twice. However, why they could not send the enquiry from their office in Darlington to Croydon remains unexplained. So I sent PPF Croydon a copy of PPF Darlington's letter and repeated all the information, company name etc, in a covering letter.

 

PPF Croydon have confirmed that the company had been transferred to the Pension Protection Fund in 2010 and suggested I contact PPF Darlington with DOB, NI etc - information they already had in duplicate!

 

The PPF seems to be funded by government, aka the taxpayer.

 

I am not expecting their employees to have a First from Oxford, just an ability to read, a smidgen of commonsense and a 'phone or email link between their offices.

 

I am not surprised that millions of pounds go unclaimed in old pension schemes.

 

Well, I've written back to PPF Croydon. I await their response.

 

The moral of this tale is to not end your search with the Pension Tracing Service and don't take the word of Pension Protection Fund. Thank god for the web.

Hi Sali,

Firstly, I input a reply several days ago but it did not log I have now found its by using the smiley faces so I will now start again. Several weeks ago I came across you thread whilst searching the web for the type of information you were looking for.

I was advise by the Citizens Advise Bureau that under Law the company which NOW hold the Pension Plan must contact you near the time of your retirement. This is correct but In my case I found that they sent my information to my original address from 30 years ago when the policy was started by a previous employer who has now creased trading.

To assist you & anyone looking for the MAA NATIONAL MOTOR INDUSTRY PENSION PLAN I have compiled MY JOURNEY which give's as much information as I can without using my contacts names & where possible I have supplied contact information which are correct to the best of my knowledge.

May I clearly state that it is important to tack if you come up against what appears to be a brick wall as a new direction in your search may well pay off as in my case.

 

 

MY JOURNEY

The (MAA) Motor Agents Association now trades as (RMIF) The Retail Motor Industry Federation Ltd.

All MAA Pension Plans started MAA NATIONAL MOTOR INDUSTRY PENSION PLAN & when / A N OTHER MOTOR DEALER or DEAL GROUP, this is because the MAA offered their dealer members a pension service which was tailored to their needs which was underwritten by several insurance companies.

 

 

Contacted the Pension Tracing Service Team via email after completing online form Tel: 0845 600 2537 received 4 days later reply that I should contact Prudential, Reading,RG1 3AA Tel: 0845 300 2634 , wrote to them with full supporting information to receive reply 16 days to advise me that they did not cover by ex employers pension plans until after April 1995.

 

 

(B2S) Back to start - Contacted (PPF) Pension Protection Fund Tel: 0845 600 2541 sent email enquiry to receive a will reply in 5 days Auto-acknowledgment received telephone call from Croydon telling me that 24 days advising me that the PPF HOLD NO RECORDS of my policy which they confirmed by email.

 

 

B2S - I started searching the WEB again by inputting Motor Industry Pension Plan Trustees Ltd which came up on the DueDil company search site which listed the trustees as having a parent group which was RMIF also the Finance Director was the same for both companies.

 

 

Sent email to RMIF, 201 Great Portland Street, LONDON . W1W 5AB TO RECEIVE A PROMPT REPLY 4 days informing me that the pension Administrator was now with Aon Hewitt consulting Retirement Practice, Birmingham,B3 2QD Tel: 0121 262 5083 & that they had forwarded my enquiry to them.

 

 

Aon Hewitt responded next day to advise me that they would investigate my pension benefit & reply within the next week. I emailed them again after 10 days to which they replied that MY pension plan was now with PHOENIX LIFE, GLASGOW, G2 6HR Tel No: 0845 938 0523 who they had contacted on my behalf & Phoenix confirmed they had my policy & had sent my notification to my old address several weeks ago.

 

 

The GOOD NEWS is my policy is all sorted & will start paying out shortly.

 

 

Finally, sorry for being so long winded but its the only way to get the inform across, remember its your money they got & my opinion is that the Pension Industry needs a good overall as the Companies are on a WINNER every time & we policy holds loss out again & again.

That's interesting TimoSapp. I'm very glad you found your policy. My journey to discover the long lost pension was very similar. I feel like I have been thwarted at every turn by incompetence and/or inertia. After months of waiting for a response from the PPF I was so fed up that I emailed the CEO and finally was pointed in the direction of Aon Hewitt. They too were slack, so I emailed their CEO and was pointed to Legal and General. Success! Months and months of perseverance, but it's paid off.

 

Honestly, it does seem rather like a conspiracy by these companies to keep people away from their hard-earned money.

I am happy that you have now been able to track down your policy & resolve the pension issue for your relative.

I share your concern regarding the Pension Industry & their pass parcel approach with our policies, it makes me feel that someone is making a small fortune moving paperwork around which will most likely be at our expense.

 

Whilst I am lucky I have a working knowledge of computers to enable me to track down both companies & information, there are many people out there now reaching retirement age who do not have the skills to be able to get what is rightfully theirs.

 

I as many was unaware that I had to input a claim for my state pension which I have been able to do online & that to can be a long winded process.

 

It has taken me three months to resolve all my pension issues in advance of my retirement & have had to experience numerous delays & conflicting information from call centre staff who do not understand their own companies products & procedures.

That's me done, I am off to fight yet another battle.

Yes TimoSapp, life does seem rather like a battle sometimes and one which those who do not have access to the powerful and empowring web are less likely to win. The longer I live the more I realise just how dreadfully we are served by the our inefficient and rickety Establishment.

Absolutely agree.

My late father paid into his scheme for 33 years before he was placed in the position of either waiting an shortish but unspecified time for redundancy, or leave.

 

Joining the company (Motor Industries Exports Ltd, later Nuffield Exports Ltd, the export division of Morris Motors) in Oxford in 1934, his job was moved to Birmingham in 1967 and he was given the big elbow out of the door.

 

We emigrated to NZ in July 1967.

Before he left he asked about his pension and was told in very stern terms that as he was going to the other side of the planet he should expect anything as it would be impossible to contact him. Haha!!

There was pigeon post even in those days.

 

Ironically, it was British Leyland (NZ) Ltd who employed him when we got here.

 

After 14 years here in NZ my father passed away aged 61 (an ex-serviceman. 6 years with the RAF during WWII).

All the while here he religiously kept "them" informed of any change of address.

He never once received a reply.......... from anyone.

 

To this day 37 years since he passed away we have never been able to trace where his pension disappeared to and the online Pension Tracing Service is a waste of time as I am told much of the info on there is either out of date or incorrect.

 

Aon Hewitt who it told me are the administrators the Nuffield Organisation Staff Pension Fund (BMW (UK) Operations Pension Fund) tell me they have no record of him.......... because their fund only started in 1975 and since he left before that in '67, as far as they're concerned he never worked for the company.

 

We (that's myself and my father's now very elderly (90) wife, have tried and tried since 1981 to find what happened and still we are no further forward.

 

Yes, it's like a big set up to ensure people and their money are well and truly parted.
