    • The Private Parking Code of Parking has been postponed as the poor dears are frightened that thew will all go out of business once it becomes Law. We all wish but nothing could be further from the truth so doubtless most of them will have to change their ways if they don't want to be removed as approved parking companies. Thank you for still retaining and producing the original PCN which, no surprise, fails to comply with the Protection of Freedoms Act 2012 Schedule 4. [It even states the vehicle "breeched" the terms  when it was the driver that allegedly breached the terms}. It fails to specify the Parking Period and whilst it does show the arrival and departure ANPR times on the photographs [that I cannot read] they do not include how long you actually parked nor was it specified on the Notice  [photos don't count]. So that means that you spent even less time parked though it would help had you not blocked out the dates and times, so good if you could please include them on your next  post. Pofa  asks the driver to pay the charge S( [2][b] which your PCN doesn't though they do ask the keeper to pay.and they have missed out theses words in parentheses S9[2][f] ii)  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; All of those errors mean that the cannot transfer the charge from the driver to the keeper. Only the driver is now responsible . What a rubbish Claim Form -doesn't even give the date of the event which it should.  
    • it doesn't matter what you are being charged or if you missed the discount period. you ain't paying anyway..... if this ever gets before a judge. then the ins and out of POFA2012 or any IPC/BPA guidelines might come into play. until then i go get on with your life. you are spending far too much time on a speculative invoice scan scheme  its almost as if you believe these are fines and enforceable in a criminal court and you could have bailiffs at your door any minute.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

Please can somebody urgently help me.

 

My partner has a couple of payday loans, and these are now on repayment plans.

 

We have just received a call from some far eastern man, claiming to be from UKCASHADVANCE, and saying that she owes them £490 immediately on a defaulted loan.

 

He said that if she does not pay now, he will file court papers tonight and send police with them to her work.

 

He also said she would go to jail.

 

We have never heard of this company and do not have any loan with them.

 

He said they are a parent company of another payday loan but would not say which one. He said he had access to her credit report and could see she has payday loans and some are on repayment plans, and if she does not pay now he will send the police for fraud.

 

What on earth do we do? Is this a [problem]? Please help...

Ignore it. He is bullying and harassing you. He cannot do ANYTHING. Especially sending the police.

 

Get a complaint into the OFT about this lender immediatly, and also NEVER talk to them on the phone. Ever.

 

As for going to jail, thats a flat out lie. You cant be arrested and prosecuted under criminal law for a consumer debt unless you fraudulently obtained it.

 

In short, ignore it. If ANYTHIGN was going to be taken to court, they are required by law to send you multiple letters to try and negotiate repayment, then you would have to default, then you would get another letter saying they are taking you to court, then another from the court asking you to defend etc.

 

Get my point? Ignore them COMPLETELY. IF anyone turns up at your house, phone the police immediately and tell them you are scared for your life. Also, try and get the phone number using 1471 of the caller and get to your local police immediatley.

Theres no need to be distressed at all. Youre playing right into his hands. Ignore it. He cant do ANY of those things and can also be prosecuted for abuse and harassment as well as threatening behaviour.

 

Take a deep breath and just think of it as if you never recieved the call. We hear about lenders doing things like this all the time. Nothing ever comes of it, and if they tried ANYTHING, they would be immediately arrested and most likely have their business closed down.

 

 

As i mentioned above. From now on, if you get a phone call trying to talk about any debt, simply say " Please only communicate with me from this moment on in writing. Any phone calls will be ignore or treated as harassment. Then hang up. Even if you have to overtalk them, make sure you say it. It is YOUR phone line.

 

Only deal with them if you get a letter. And when you do, post it here so we can advise you further,

 

 

But for now, calm down, relax and take comfort in the knowledge that NOTHING can happen as he said.

Well if there is an application and it was made by fraud he needs reminding that in this country you are innocent until proven guilty. Do you have any contact details for this guy. If so then I would pre empt him and report HIM to the police. It is him that is being deceptive.

The other thing would be to write to him saying you know nothing of this debt and prove it.

 

All in all I am sure it is a fishing call, a chancer , whatever you want to call it but it seems I can not call it what you and I both suspect it is

 

Under no circumstances give him any financial information.

 

To be honest, i wouldnt do any of that. The only thing i would do is get the telephone number, take it to the local police and say there as been threatening, harassing and abusive calls from this number, then contact ofcom with the crime number. After that, sit back, relax, and let the law deal with it.

 

I wouldnt even write to them or give them a second thought. The only problem is that there is no evidence that they have said anything. Thats why they use phonecalls, so nothing can be traced. Even then, let the police and ofcom deal with them, and ignore any further attempt at communication through the phone.

Some PDL's have multiple sub companies set up, but trade under their main name which has a credit license. They use the sub companies to launder and send money to.

im sure this one popped up way last year. Its a [problem]..... they have his details, and he dont owe money too them. they are merely trying to steal his money.

The number they asked her to call was 02035191179.

 

When you call it, there is no ring tone but after a while somebody picks up.

0203 is used for some London numbers now.... http://www.area-codes.org.uk/london-0203-numbers.shtml

 

It usually ends up in a call centre somewhere, it isn't normally issued to a private person.

 

This guy needs to be reported. The PDL companies love to shout FRUAD but it is not fraud when you take out a loan and are unable to repay it immediately, particularly if your financial circumstances are very difficult.

 

Remember most PDL people are paid on high commission only, they don't have a regular salary or job security and are not licenced nor regulated, they probably are not paying tax either.

A quick update on this.

 

They are now ringing leaving the same awful voicemail on her work phone number.

 

How can we stop this? I tried calling on her behalf they hang up!

 

The message they leave says that it is time sensitive and if she doesn't answer they wouldn't want to be her and they wish her good luck

Believe it or not, this is good - you have a recording. Go immediately down to your local police station, let them hear, explain how anxious you feel about this and let them deal with it. You have been seriously threatened here and without wishing to cause you worry, who knows what "they wouldn't want to be her" means. I think that given the severity of this threat, the police may call or trace the number themselves. Also make sure that you keep this recording and make sure you get a crime number. The police are here to protect you.

I think if you say you are concerned that someone is going to come round to your house and harm you (very unlikely but from what they said they have indicated that this is what they may do) , they have an obligation to take it seriously; to not take action would be negligent.

After some digging around, ukcashadvance.com appear to linked to Northway Broker Ltd (search webcashadvance) who have the loan company Pounds Till Payday

 

Does your partner have a loan with them?

Ok, the basis of me suspecting ukcashadvance is connected to poundtillpayday is that on the webcashadvance website all of the lenders are linked to Northway - I think it is fair to assume that all of the "payday loan matching websites" listed are also connected however, it is not possible to confirm this. Now that you have confirmed your connection with poundstillpayday, it would be a major coincidence if the calls are not related to this loan.

 

I dont know how you would deal with this, perhaps the SiteTeam can help.

 

But regardless, you must go to the Police to stop the intimidation.

Sounds like a phisher. report it to the police. Get a crime number, then file a complaint with the OFT and leave it in their hands.

When I received a similiar type of call made to my work once, I placed them on hold and that seemed to get rid of!

That seemed to throw them as they were obviously working of a well versed script only

There is also the trick of answering, not saying a word or putting mobile phone in somewhere like a draw - they will want to give up then

Not really quackquack. It will block that specific number, but its all too easy for a PDL to utilize a whole host of options to get around it. They could even tie their line into a VOIP and get around it that way.

Oh, i agree that the first step should be to block the number quack. Dont get me wrong on that. Im just of the opinion that its pointless, but the only reason to do so is when you complain, you can inform the relevant authority that you made attempts to block it. The sad fact is blocking a number is very VERY easily gotten around.
