Hi.

I have today been reading alot on this site regarding my PPS Parking Charge which I received last week.

 

 

I was unfortunately held up and returned to my car ten minutes late and had a ticket which was timed at 6 minutes over my due back time.

 

I have been reading that this is not an official charge.

I am a very black and white person and see this as either something that I should or shouldn't pay as I am either legally or not legally required to pay it.

 

 

Obviously I am stupid to get it, but neither am I in the greatest financial position to pay the £75 or £100's.

 

 

My 7 days runs out on wednesday and I was today going to phone and pay as I would not want to get in to any more trouble, then I came across these threads.

 

My husband will be less than pleased if I don't pay and we get a hefty fee or court fees.

I have read their website where they say that they have successfully acquired fees etc.

 

The car is registered to my husband. Is it really ok to ignore- it worries me.

Their success stories are just that stories, they have posted up a list of parking charge numbers and claim they have been enforced, what this probably means is that people have folded upon receipt of the debt collectors or solicitors letters and paid.

If they had been successful in the county court they would certainly post up the judgements or case numbers. After all they posted up the case details of the case where they were sued and won!

I am sure if the had taken the number of people they claim to have to the County court we would have heard about it!

By the way, at least almost all of their successful recoveries in court are likely to have been default judgments where the defendant failed to respond or to show up for the hearing

Completely ignore them. You do not owe them anything. You are not obliged to pay or contact them in any way. You will not get into trouble or get court fees.

 

They get people's money by frightening them. Don't let them frighten you.

 

This is what their website says:

 

"With regards to our ongoing enforcement services against those drivers who do not pay their outstanding Parking Charge Notices (PCNs), PPS have just obtained a number of County Court judgements and admissions".

 

What does this mean? What are admissions? It means that people they have been pestering have been frightened off and paid up. This is very different from successfully suing. If these people had ignored Premier Parking Solutions, then they'd have saved their money!

 

The question is, how many of their "successes" resulted in County Court Judgements. One or two, which they probably set up themselves.

You are in an absolutely safe position to ignore. When their junk mail starts, (which it will unfortunately) it will all be addressed to your husband as the RK of the vehicle. As he was not the driver at the time, he did not breach any of their silly little rules so they cannot sue him. (well they can but they will loose on that fact alone!) and he is under no legal obligation to name who was driving the car at the time, so thye can't sue you either coz they don't know who "you" are. :)

atleast two of the people taken to court on PPC tickets were

known to be 'stoogies' from the companies relatives etc.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

My advice would be not to pay.

 

 

Follow the links if you're unconvinced,

especially the one to Martin Lewis's site,

but everyone seems to be in agreement that PPS have no right to charge you a fine.

 

 

Since July when I had a 'fine' taped to my windscreen,

 

 

I've been sent a series of increasingly threatening letters, followed by two letters from debt collectors. (Be prepared for that!)

 

 

Then... nothing. If it says 'Parking Charge Notice and not 'Penalty Charge Notice' it seems these charges have no status in law, and should be ignored. Best wishes

Hi.

Thanks for all the wise words and information. With regards to the fact that it was not the registered keeper driving how do we prove that and/or how do they? Should my husband write and say that he was not using the car and was at home that day with our daughter (and maybe they will then know not to persue) or should we do absolutely nothing?
