Hi All

 

throwing this up for my brother, hes been off work for 7 weeks and does not earn enough for ssp, so he received his ssp1 from the employer and has sent this back to the job centre as well as his medical certificates from the gp.

Now, he was told by these people when he made his claim over the phone that he does not need to contact the WTC office as he is employed at 16 hrs a week but only is gonna get ESA until hes fit enough for work.

 

Does this sounds right?, and will he have to attend the local job centre for any reason

I'm afraid I can't give definitive answers based on that information. Also, I'm not familiar with WTC rules beyond a few vague generalities. All I can really say is this:

 

I'm sceptical about the idea that he doesn't need to contact WTC since he's been off work for 7 weeks. Others around here may know better than I do, but my general approach is that you should tell government departments anything you think might be relevant. And critically, it's certainly possible to get bad advice from DWP about HMRC's rules. So I would discuss this with the WTC people.

 

From an ESA point of view, any WTC he receives is fully taken into account (that is, deducted from his benefit) so he most certainly needs to tell the ESA department if he's getting any WTC.

I know that if you actually receive SSP then you can continue to receive the tax credits payments util that exhausts when the tax credits will also cease. As he has been told he desn't qualify for SSP I would advise that he contacts the tax credits to advise them of the change in his circumstamces,
