    • Well we can't predict what the judge will believe. PE will say that they responded in the deadline and you will say they don't. Nobody can tell what a random DJ will decide. However if you go for an OOC settlement you should still be able to get some money
    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

We've been trying to deal with our debts with help from people on here for a few years and something happened yesterday which I'd appreciate some comments on;

 

One of my OH's smaller creditors, a New Look store card (Ikano) has written to us to tell us that on 30th August, the account was sold to Lowell Financial and that our reduced repayment can just continue as normal, but to them instead.

 

We've had these sort of letters before, so no problems there. HOWEVER;

 

The letter was sent to my OH's EMPLOYER (to be precise, she left less than a month ago).

 

Bearing in mind that my OH used to work for an Accountancy firm, this has caused considerable embarrassment.

 

We have literally NO IDEA where they got the address, and why they have so clearly totally fudged up their address records.

 

There's only less than £140 left owing. I'm seriously, seriously annoyed that they've done this, especially since they point out in the covering letter that they are 'aware that you have been working with a Debt Advice Agency to help you manage your financial affairs'.

 

Surely this is a breach of data protection or something?!

 

The address of the previous employer is made out to look like a street address (i.e. 25 something street, somewhere), when the actual 'proper' business address is a unit number on a business park, so it doesn't make sense where this address has come from. The original card was taken out way way before she even started working there, so my idea that maybe they asked for her employer when she applied for the card doesn't tally.

 

Anyone else had this experience?

 

It might sound daft, but I'm so bloody annoyed!!!

 

And how do I know they haven't sent other stuff elsewhere?!

You see for that mahoosive error on their pathetic part, I would retaliate and pay no more than £1 a month whilst you exhaust their complaints procedure and escalate it to the ICO, the OFT&TS need to be made aware of this also, every complaint helps.

The problem is, if Ikano don't own the debt any more, will kicking off the Lowell make any difference?

 

I'm assuming it's Ikano that have screwed up, so to be fair, is it Lowells fault?

 

Can anyone suggest any letters etc I can send to Ikano to ask them exactly HOW and WHERE they dreamt up that address from and *bit cheeky this* - tell them to p*ss off and close the account if they can't deal with it in a proper manner?!?!!?!?!?

I wouldn't care whose fault it was, lowlifes sent the mail to the wrong address they get to carry the can, let lowlifes and Ikano argue it out between themselves whose to blame.

The more people who kick up a stink every time DCA's or OC's make a hash of things the sooner they will be made to act in the correct manner, LAWFULLY!

 

Don't go soft on lowlifes, they know only too well the OFT's stance on things, if they can't act in the correct manner then they will lose their licence.

 

I'm serious, drop the payments to £1 a month and your reason for doing so, is that they have acted outside of the OFT guidelines and until the start behaving in a mature professional manner then they get what they're given and they'll like it.

I have recently received letters sent by both Ikano and Lowell Portfolio 1, sent to my employers address (photocopies enclosed). This has caused me a great deal of embarrassment and distress. It is not uncommon for my employer to receive work-related mail addressed to me and as such, you letters have been opened and read by my colleagues, who are now fully aware that I am in a debt management plan and that I am in debt (as clearly stated in your letter).

I have not provided you with the address you have sent these letters to at any time. Nor have I given you permission to discuss my account with, or disclose information to, anyone other than myself or my legally appointed representatives, for which I have provided prior written authorisation.

As such, I will be contacting both the Information Commissioners Office and Office of Fair Trading/Trading Standards, as it is clearly apparent that you have broken both the Data Protection Act and the Office of Fair Trading Debt Collection guidance.

As it is clear that you are incapable of handling my account in an accurate and lawful manner, I will not be sending further payments to this account and demand that you close my file with immediate effect, or face further action in court for committing the offences mentioned previously.

I look forward to receiving your written confirmation of this.

I'm no lawyer either, but I would drop the last para and not make any reference to any offences they may have committed, they will clearly see it differently.

 

A bloody good effort mind!

 

And the 3rd para, I'd be a little bit more in their face, with "Due to your inept and unprofessional work ethics, I have reported your failings to the OFT, trading standards, and the ICO.

 

You won't end up in court, your simply telling them to treat you with a little bit of respect and your not going to bend over and adopt the position.

Oh right - I'm a bit confused....and I've just posted a copy to both Lowell and Ikano!

 

I thought BB meant 'do not include the bit about them facing further action in court', so I took that last paragraph out!

I was half tempted to say - "the account balance is approx £140 - I'll pay you, say, £10.00 as a settlement right now if you close the account" - but I'm that annoyed, I'm hoping they'll just bu**er off!!!
