since June of this year i have informed MBNA that i cannot keep up my repayments on my Virgin CC.

 

Current debt is £7700+ and rising.

 

!st i sent a letter.

 

Then i sent in an income expenditure form.

 

Next was another cover letter and another income expenditure form.

 

Lastly i sent a cover letter another income expenditure form and 2 of the previous letters including Proof of Postage.

 

I have made 3 payments July,August,September as per my 2nd cover letter.

 

They seem to be ignoring this fact though and keep sending me letters stating i have must pay the arrears (over £1200) and the payments i have been making have been underpaid.

 

Today i received a notice with the intent to place a default on the account and i have 30 days to pay the arrears.

 

Obviously phoning these people will be a waste of time.

 

What are my next options reguarding this matter.,

 

how do i go about forcing the issue with them and when can i reclaim interest/Charges from since i have informed them over my difficulties.

Continue paying them with the "token" amount that you have been paying to mnba since July. They are obliged to accept that amount, as per the oft agreement they signed back in December.

 

The letter quoted above is more important, is it asking for the full amount? is it a default notice or something else. Can you please scan in the document and upload to the forums. Please remove personal id stuff such as acc no and your address. Obviously do not write on the originals ..

 

Come back with the letter and i'm sure others will help too :)

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

as for you paymentsdo it via internet banking

 

and stand your ground

they'll go nowhere near a court

its YUR money, taake control!

 

TELL THEM they will only be getting £XX for XX mts

 

then do it.

 

£1 will od , its NOT a priority debt - end off

 

as for the charges

 

get reclaiming - you can get EVERY unlawful fee back since day one!

2 questions now

 

1 How do i go about getting my charges returned to me

 

2 What is the best way to continue this since they seem to be ignoring the fact i have wrote to them may times trying to arrange a payment plan of which they have never acknowledged. in fact they see the payments i have made as underpayments on the account. They must be breaching the guidelines that the OFT imposed on them back in January so do i now bypass MBNA once the default is issued or do i next to to MBNA and dispute the account till this matter is resolved.

Mbna have signed an agreement with the FSA, (dec 10)

 

1. accept nonimal amounts when clients are in hardship.

 

2. Give 30 days notice when a default would be placed on the account.

 

3. To work with the client when they face difficulty ..

 

Seems they have goldfish memories with your case :(

Sadly MB$A are rubbish when it comes to reduced payments.

 

I recently helped my Mother in law we sent a National Debtline I&E and a letter firmly stating that she could only pay X and this would be done by standing order this was sent in June the Standing order was also set up as promised. They never responded. In August they requested her I&E details on their Mickey Mouse I&E form we responded with a copy of our initial letter the I&E form we sent in June and a very firm letter stating our confusion at the lack of any response to our first letter.

 

They have only just accepted our offer they neither froze the interest of stopped charges luckily this account was sub £1k.

 

Just keep at them
