    • I have read through a number of similar threads, but one thing i'm not sure how to proceed about is that I live abroad in the middle east and have done for several years. The claim letter was sent to my parents address and I really don't want them to be harassed about this. I am sure I sent the original creditor a registered letter with my change of address but can't find this currently. I am not in a position to pay this, and tend to come back to the UK to see family at most once a year (less since Covid), so not particular bothered about my financial score...more concerned about harassment of my parents. I have not registered on the gov gateway or anything like that.  Details below (as best as i can), and thank you for taking the time to look into it. Also redacted claim form attached: Which Court have you received the claim from ? Civil National Business Centre (Northampton) If possible please scan redact and upload a full page copy of page 1 of the claim form. (not the response page or AOS) Name of the Claimant ? PRA Group (UK) Limited   How many defendant's  joint or self ? Self   Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to. 23/5/24   ^^^^^ NOTE : WHEN CALCULATING THE TIMELINE - PLEASE REMEMBER THAT THE DATE ON THE CLAIMFORM IS ONE IN THE COUNT [example: Issue date 01.03.2014 + 19 days (5 days for service + 14 days to acknowledge) = 19.03.2014 + 14 days to submit defence = 02.04.2014] = 33 days in total   Date of issue XX + 19 days ( 5 day for service + 14 days to acknowledge) = XX + 14 days to submit defence = XX (33 days in total)  if your defence filing date falls on a W/End, you must file by friday @4PM Tues, 11/6/24 (19 days)  Thurs, 25/6/24 (33 days)   Particulars of Claim   What is the claim for – the reason they have issued the claim?  The Claimant claims the sum of £7926 for an outstanding debt owed. Is the claim for - a Bank Account (Overdraft) or credit card or loan or catalogue or mobile phone account? Credit card   When did you enter into the original agreement before or after April 2007 ? After   Do you recall how you entered into the agreement...On line /In branch/By post ? Online   Is the debt showing on your credit reference files (Experian/Equifax /Etc...) ? I have to do some proofreading of an English grammar book for an Italian publisher this weekend - for money! - so I'm afraid corrections and suggestions will come in dribs & drabs.  I've totally knackered the layout, the numbering and the order of your Exhibits but there will be several versions done so don't worry about that ATM. Your arguments are superb. What is less superb is the way you jump from one to the other and back again, so I haven't changed your words, but I have moved the paragraphs around and given each section a heading. New bits are shown in red. Crossed out crossed out in black is something you've quoted from the government Code of Practice, but that has since been withdrawn so unfortunately that argument has to go. Your paras 7 & 8 don't harm your case but to me are waffle and can go.  Keeping the arguments clear & concise will always impress a judge.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

Having checked my bank account I can see that my step daughters car insurance company has debited money from my bank account using my Visa Debit card without my agreement on the 20th September; it says POS on the statement (Point of Sale)

 

I used my Visa Debit card online to pay ONLY her first installment on 25th July, she provided her bank details for a direct debit for subsequent monthly payments. I remember doing the Worldpay password process for it.

 

My step daughters insurance was taken online and I entered my debit card details separately to pay only the first installment and she entered her bank details separately along with all her own details for the insurance policy itself. The policy is entirely in her name and address (her surname is different to mine and so is her address) I have not even seen the policy or the payment schedule.

 

Surely they are breaking some rule for them to have done this. When I made the single payment I did not enter into a credit agreement with them, I did not give permission for them to store my card details or use them again!

 

Please can anyone kindly advise what my postion is before I make some irrate calls in the morning.

They'll be relying on recurring authority for payment. Oops sorry, did we charge the wrong account kind of response is to be expected!

 

Go down the 'gentle' route first, if you have an e-mail addy for them I suggest a tempered request to refund your money or you will effect chargeback. Remind them of the direct debit authority. If not send off a less than tempered notice to their CEO............ who is the insurer?

 

If you have incurred any charges they will be liable for them [assuming you have evidence of payment authority]

Thank you both for such quick replies!

I had a look at the chargeback process and that was exactly what I was hoping might be on my side.

The insurer is Hastings Direct. Just to clarify that I was not party to any direct debit agreements, all I did was pay the first installment which seemed to be a separate part of the payment policy completion process, the DD was all in the policy holders name.

 

I must admit I am hopping mad about it and tempted to invoke chargeback straight away. I did not incur any bank charges but it is really the principal of the matter and having to spend a load of precious time sorting it out.

 

How do I know that they will destroy my card details? they have obviously used the CVV code just yesterday as it was Point Of Sale without me present, anyone with a light finger in the Hastings Direct office since the 25th of July onwards could've ordered themselves something nice online, used a gambling site or order a food delivery courtesy of yours truly!

Heres my update;

I phoned Hastings Direct this morning, I made my position very clear as you can imagine..... they told me that when I had made the first installment I had apparently agreed to them using it for "subsequent payments if required".......I recalled no such thing, only the worldpay authorisation.

I asked them in that case to email me a copy of what I had agreed to, she said she couldn't do that, I said she will have to otherwise I would go to the FSO, suddenly I was asked to hold, she said she had spoke to her supervisor and refunding the amount to my card as we spoke. I asked her are they storingmy CVV number? she answered she was deleting my card details. I told her any payment of that policy must be directed to the policy holder. She didnt break any data protection rules which was good.

 

That was at 9am, I have not recieved the amount in my account yet. I expected it to be instant as it was being refunded to my Visa Debit card? does anyone know how long that would normally take before I phone them and verbally bang some heads together (they are open until 9pm)

Card refunds can take a few days to be available to you.

I have recently returned something to Argos which was paid by card-it took around 4 working days to show on my account.

It happens a lot across the board.We know mistakes can be made especially in the days with so much reliance of computers and automation.Those who are passionate in dealing with putting things right speedily and completely when it does happen are the ones who are likely to be given the stars,and a second chance from those who are aware.

This is what sets service providers aside,and as more people look to put this at the top of their list as well as price,it will (or should) drive customer service people to strive every inch to deliver.

Hi all everyone needs to start claiming when these companies do something wrong, Banks charge us if we do something wrong so

why not turn the tables on them.

Hampster777 get a demand into them for your time on this matter, they failed to do the job properly.
